President Graham reported yesterday the

The 'Board ' of County Supervisors has sus
tained the protest fllcd by Max Mohn against
the establishment of a saloon at 213 South
M.iln street. The location comes within the
titulary fifty feet of the hotel owned by
the complainant and 'the ' law rcqulrce the
board to hold the protest to bo effectual.
Word has been received from the officers at
the 'Clarnlda asylum announcing that the
physical coalition of 'Harry Leland has
greatly Improved slnco ho has been an Inmate
there , but there lina been no favorable change
ki his mental condition. There Is no hope *
entertained that he will ever recover hla

Twenty-eight recruits offered themselveo at

vice. Of the whole number that have enrolled
themselves so far under the second call of

final examinations are had.
Bishop Perry will hold a special meeting In

Hazel camp , Modern Woodmen of America ,
passed a resolution at Us last meeting di
recting the treasurer of the lodge to keep
up all dues of absent members who ( lave en
listed In the United States army. The camp
also completed arrangements for. a benefit
dance which will be held In Woodmen hall
next Wednesday night for the benefit of the
Dodge. ' Light guards. The money will go to

The employes of the court house yester
day afternoon made up a purse and pur
chased a fine tea set , which- was presented
with appropriate ccremonleo at the close of
office- hours , to the retiring janitor , T. H.
Rlley. The presentation speech was made
by County Auditor Matthews , and was fully
worthy of the occasion. Mr. nlley was
taken completely * y surprise , and was al
most overcome by the emotion excited by tue
pleasant and unexpected event. Several of
the daughters of Mr. Ulley happened to be
prcient < ind the event was given Eomcthlag
of a social character.

The preparation of the petition In the
mandamus suit to compel the city treasurer
to pay the U'st warrant authorized by the
counc.ll was nol completed In time last night
to file It In the office of the cleric of the
district court. Judge Smith wsa ready to
hear It nnd although there was no session
of the court , ho remained about the room
and In the chambers all day. The petition
will be filed and heard the first thing this
morning , and Judge Smith has agreed to
defer the regular calendar business for that
purpose.
The suit Is regarded as one of the most
Important that has occurred In connection
with city affairs for many years. It has In
It several of the questions that were raised
at the last hearing of the Injunction sulta
brought by Mr. Shea , and he naturally takes j
a lively Intereat In the outcome. E'.i-Clty

and City Attorney Wadsworth Is defending.
If the decision of the court la for the plain-
tin' , the city must go at once upon a prac
tical cash bosls.
The formality of preparing the case was
watched yertcrday with a great deal of In
terest. The little $ G warrant that had been
especially selected for the purpose of making
the test waa submitted to Treanurer. Heed.
Payment was refused upon the grounds that
there were many other wanants nearly
$135,000 worth of them-uhcad of It and It
coald not be paid until the prior warranta
were gotten out of the way. The refusal to
pay waa endorsed on the back of the war
rant In the usual way. The ceremony took
place In the presence of a little coterie of
city hall repreaentatlvcs and was watched
with a good deal of Interest , In view of the
fact that the payments of salaries In cash or
warrants depends upon the Issue. The work
of preparation of the petition and the defense -
fenso to be made by the city were at once
begun. The Intention Is to cover as nearly
ca possible every point Involved and leave
the case In an unassailable condition , Ex-
City Attorney Hazeltca has voluntarily taken
hold of the matter for the recson that the
procedure let on the lines recommended by
him to the republican city administration.
Speaking of the matter yesterday he said :
"It Is the only way the city can provide
to comply with the aim and purpose of the
now charter law requiring municipal affairs
to be placed on a caah basis. The case will
In a manner settle also all question KB to
the legality of the warrants now outstanding.
It will leave , If we win , two ways of dis
posing of the outstanding warrants. One
plan will be to have the council refund them ,
and the other Is to have them put Into judg
ment and then refunded. The latter will
neat probably be followed , for once In Judg-
nent , all question of the legality of the war
ranta la settled , and refunding bonds based
upon court judgments could probably be more
easily deposed of. Wo have no doubt but
wo will win the case , and expect to make It
lust as strong as possible. "

FINDS NEW LAND FOR TAXATION.
Count- Surveyor Cook Ileturnn the
Area of Accretions.
County Surveyor Cook has completed the
work of surveying the accretions to lands In
he county lying along the Missouri river an ]
las filed his report ( or the Inspection of the
Joard of County Supervisors. The report
was somewhat a surprise to the board , for It
brings uuder taxation nearly 1,200 acres of
valuable 'farm ' lands. The owners of property
to which this land had accreted were using II
and receiving all of the benefit derived , but
as It did not show on the records It could
never be assessed for taxation. It was a
snap that many of them did cot like to re-
Inqulsh and perhaps there would have been
no occasion for It at the present time If at
tention had not been called to It several
months ago by a suit that was filed In the
district court , la wlilch ono farmer near
ttoney Creek made a large number of bis
neighbors defendants in a suit to compel
the surveys to be made. This was a friendly
suit , designed to fix the boundaries of their
farm lands. The surveys wore ordered by the
court and the result Is that a large tract ol
now land Is placed on the books for taxation.
The 'board finally ordered a general survey
to bo made , with the satisfactory results
mentioned. The total cost of making the
surveys was $606.60 , but the taxes for the
first year will more than re-pay the ccst.
The survey resulted In giving the Cres
cent Land company 245 acres of new lands
much of It worth J40 an acre. Nearly fifty
tracts altogether have been Increased b ]
the addition of greatly varying amounts. The
work lias been all done In the vlclotty of the
mouth of the Boyer river and other smal
streams. It has not been finis-he ! In that
vicinity yet. and there Is more land yet to
be discovered. The accretions In the south-
era part of the county have gone the other
way and more than 2,000 acres of the fines
and roost highly Improved farms In the
county have slipped into the Missouri river

CLINTON , la. , April 29. ( Special. ) Lafayette -
fayetto Lamb , the millionaire lumberman
and steamboat man of Clinton , has a house
boat , In which he has surpassed all efforts
In that line , east or west. The boat la In
tended entirely for pleasure. It has no pro-
pelllng power , the Intention being to make I
as much llko a homo as possible. To this
end Mr. Lamb has built a special steamer
to serve as a tender to hla floating liome
While the steamer may be uaed for any o
the purposes for which wcall boats arc built
it is supposed to lay by within easy call o
the floating palace. The boats have been
appropriately christened. The palatial barge
Is called the Idler and its tender the Wan
derer.
The Idler Is 120 feet long , 20 feet wide
with a depth of hull 4 % feet. Forward la
the ealoon. six large staterooms leading on
on each elde of the hallway from the saloon
to the dining room , whlth occupies a position
nearly amidships. Aft of the dining room
la the kitchen , pantry and cold atorage and
attendants' roonw. Adjoining the forward
staterooms are two bathrocroa. Tue Idler
while devoid of weighty machinery , has o
boiler with a capacity to furnish hot water
and heat to the entire bsat. Bach stateroom
Is provided with a radiator and hot and
cold water. There Is ol o steam to supply
a. email Atlas engine , which drive * a Benton
dynamo , furnUtilng current to 100 Incan
descent lamps and a searchlight.

governor this evening settled the row over
the proposed reorganization In the National
Guard by prderlng homo the First regiment
and stating that the Second , Third and
Fourth will bo the ones sent to the front.
Adjutant General Bycrs addressed the offi
cers this morning and told them Just what
would have to be Oono , and they all decided
to stand by the decision. Tlio officers of the
First will return home and form a skeleton
regiment , which will bo the first to go on
another call. The privates in the First regi
ment , however , can enlist In the other rcgl-
monts and fill up the quota , and they will
undoubtedly do so.

gram. ) A mammoth mass meeting was held
today , presided obcr by Hon. John N. Ir-
wln , ex-governor of Idaho , and the follow
ing resolution against the action of Governor
Shaw in ordering the Second regiment con-

McCain , the 8-ycar-old daughter of Mr. and
Mrs. W. E. McCain of Deadwood , S. D ,

\as traveling with her mother and three

nto the night. The mother fell asleep in
ho car , and the child was playing In the
aisle. Suddenly she walked out on the plat-
'orm , and In an Instant had fallen from the
rain. The train was stopped as roon as pos
sible. It began to back up at a goad rate
of speed , when suddenly the trainmen saw
ho frail form on the track not fifty feet In
rctit of the moving cars. It was too late
o stop the train and three cars passed over
ho bo3y. When taken out the remains were
'ound to be terribly mangled. A question
still remains as to tow the child was
tilled by the fall or by the returning train. .

SIOUX CITY. April 29. ( Special. ) The
ndopendent school district of Sioux City
.as filed a suit against the American
Surety company askln ? a Judgment for $50-
000. This suit is to recover the money the
school district lost by the failure of the Home
Savlngrj bank In this city several weeks ago.
H. 3. Hubbard , who was the cashier of the
defunct bank , was also the treasurer of the
school district , and on effort Is now being
made to recover on his bond. It Is no )
thought possible to recover the money from
the bank , and about the only hope Is to hold
the ourety company liable on the treasu
rer's bond.
Severely Injured.
SILVER CITY , la. . April 29. ( Special. )
Yesterday afternoon Ilev. M. A. Mills , pas
tor of the Methodist Episcopal church at this
place , was quite severely Injured by the
overturning of a load of straw upon which
he was riding. One shoulder was dislocated
and he warj quite badly bruised. The
proper medical attention was given and this
morn In e he is resting as well as could bc >
expected.

The directors of the Ames and Nevada
schools are considering tbo plan of hiring
a competent instructor In music who shall
divide his time between the two schools and
bo paid from both treasuries.
The sergeant of police bis notified the
keepers of gambling houses In Sioux City
that they must report at police headquarters
for the payment of monthly fines. The de
partment has decided to advance the fines
for houses operating faro games and roulette
tables from $100 to $150 a month and the
poker rooms from $50 to $100 a month.
The Clinton Herald Is responsible for the
statement that the gambling dens In the
Iowa penitentiary at Anamosa have been
raided and all the chlp , cards and other
devices have been forfeited. The new war
den recently searched the cells of the cco-
vtcts , and the hack saws , tools and other
like articles , permitted to be kept there by
the former warden , which facilitated many
escapes , were confiscated. The haul amounted
to more than a carload , and Included sev
eral grlndstoneo two feet In diameter , ani
tools of all klnCs. About $800 In money
was found.

upon hero as likely to be any groit success.
The promoters called on Secretary Ward
of the Commercial exchange and through
him submitted a proposition to the people
of thl'J city to establish the shops of the
road here If the people of Dea Molncs will
pay the road a bonus of $160,000. Wardall ,
who has bean hero himself for several Uaje ,
says that they are backed with ample east
ern capital , that much of the preliminary
work of obtaining a right of way has been
attended to , urU that the scheme has the
unsnlmoua endorsement of tlio farmers of
the west and northwest They are selling
stock In the company to the farmers along
