Weekly SeuHlon of the Execu tive Committee , The executive committee of the Council Bluffs Transmlsslsalppl association held the regular weekly session last evening. The sec retary was Instructed to call a meeting of the finance committee at once and get the work of raising ? 5,000 under way on the lines previously agreed upon. President Gra ham , William Moore and H. II. Walters wcro oroolnted an auditing committee. A copy of < ho articles of Incorporation signed by a suf- iklont number of the members was presented tOKether with the report ot the secretary and president announcing that the papers had fecon filed for record In the ofllco of tbo sec retary of state , and the association now has a legal status and existence. The secretary presented thd application for SDaco on the exposition grounds , and tbo Association authorized the president and sec retary to elgn the eame and return It to the Omaha management. There has never been any oc casion to Interfere with money set aside for the Improvement and maintenance of the iiarks and aono has ever been attempted until yesterday. On Monday nlsht at the regular monthly meeting ot the council a resolution was passed Instructing the city auditor and treasurer to expropriate a small portion of the park funds nnd wver It into the general fund ofMhc city. The necessity lor It arose from the fact that for many years all of the expenses for the collection of the city taxes have been borne by the gen eral fund. The law permits the county trcas urcr to diargo three-fourths of 1 per cent as a commission for the collection and keeping of the city taxes until they are turned over to the city treasurer. The practice has been for many years past to draw warrants on the general fund to pay this commission. The finance committee and the heads of de partments got to figuring this up the other day and discovered that there had been taken from the general fund for this purpose dur ing the last elglit or nine years nearly $10,000. As the general fund Is the one that causes the chief anxiety , the iilati was sug gested of relieving It of this burden. The matter was referred to City Attorney Hazel- ton , and ho gave it careful consideration The investigation resulted In the discovery that there was no particular reason for the practice , and no authority preventing the de termination to make each fuad bear its own burden. When this conclusion was reached the next problem that came up for con sideration was the right of the city to go back a few years and transfer from the Various funds their oroportlon of this expense. Noth ing was found to prevent this , but it was decided not to go back further than three years , and the reaolutlcn that came up In the council authorized the transfer. The transfer was made from the other funds with out objection , but when it came to make the change in the park funds the commissioners registered an energetic kick and refused to permit the transfer to bo mode or the coun cil to assume any sort ot control over the fund. BOARD WILL ACQUICSCB. The board hold a special meeting yester day largely for the purpose of considering the matter. There was no objection to the act of the council , for all of the members of the board realized Its Justice , but the de termination was adhered to not to permit any interference on the part of the council with the park funds. As a compromise the commissioners instructed the clerk to draw a warrant en the park fund to pay the amount. This was done yesterday arter- nosn , and hereafter the beard will ray the expense of collecting the taxes levied for the parks. The whole amount turned Into the general fund amounts to between $3,000 and $4,000. Another matter considered was the propo sition of 'tho ' Omaha & Council Bluffs Rail way and' Bridge company to supply a line of entertainments in Fall-mount park next Eummer. The proposition wiis submitted to the commissioners several weeks ago and has been discussed more or leassince. . Some opposition was encountered from citizens \v.io feared 'the ' attractions would induce such a multitude of people to visit thoi park that the 'grass' ' would all bo trumped out and the general beauty of the great pleasure resort sadly marred. No consideration naa given to these pessimistic views , and the com missioners only took Into account the char acter of the cirtertalnaients proposed and the liability of the compiny for all ex penses. The plans of the motor company contem plate providing for the public a series of amusements that will cover the entire season. The usual band concerts tot each Sunday afternoon and evening are provided for , but the chief thing Is the purchase by the company of ono of the largest and latest Improved cinematographs for the exhibition of film pictures. The series of free entertainments of this character Is the outgrowth of a scheme orig inated by Manager Dlmmock and Superin tendent Wells of the motor company. Cor respondence was begun with the park boards and street railway companies , which has re sulted In the establishment of a circuit. In cluding Denver , St. Joseph , Atchlson , Lin coln , Salt Lake , Des Molnes , Burlington , Rock Island and others. Omaha has ex- ircesed a desire to enter the circuit and will firobably bo admitted , The plan provides 'or ' the purchase of the necessary machinery } y each of the street car companies , and the purchase of a largo number of films which will bo common property of the syndicate of cities and will be Interchanged. The park commissioners yesterday gave their full approval of the plan and entered Into a contract with the motor company by which the company Is to pay all of the ex penses , which may include the necessity of running an additional feed wire from tbo power house to supply the heavy electric current needed for the proper wording of the machines. Warrant buyers In their anxiety to get hold of some of the evidence * of the city's Indebtedness were willing to bid up to i)9 ) cents , and a number of bunches were sold at that figure. The commissioners of the Insane held a meeting yesterday aftcrnon In the office ot County Clerk Heed for the purpose of paus ing upon the cases ot'a number ot patients now confined for treatment in the hospitals , An order was made releasing Herman 3ay- fleld , a young man who has been receiving treatment in the Clarlnda asylum , ube has "boon " reported by < the superintendent of the Institution to bo fully cured. Similar orders were made In thp cases of Peter Moellcr , Lotta Jensen and Slaty Ilasmusscn , who have been confined In St. ( Bernard's hospital In this city , Wille the board was In session the matter of making a complete report of 'the condition ot all ot tbo patients being cared for in the hospitals at the expense of tbo county was discussed. The report baa been under consld- V / t - - oration for some tlmo and It was definitely decided yesterday to complete It. It mill show the exact number of county patients , their present condition collectively and In dividually , and the exact cost of keeping each with estimates of the cost for the future. Dunlap against the city for the recovery of $15,000 personal damages reached a verdict yesterday after noon , finding for the city. The case was regarded garded as being something of a test upon several points that have figured In many of the numerous recent personal damage suits against the city , nml the verdict la receive 1 by the city ofllclala with more than ordinary satisfaction. The Instructions ot Judge Orcen were very fair nnd full. Particular stress was laid upon the contention ot the attorneys for the city that Dunlap's Injuries resulted from no negligence on the part of the city. The court held that U the city had placed a light at the street Intersection where the accident occurred and the light was not burning at the tlmo. and that due diligence had been made by the city to keep all of the lights contracted for and paid for In proper condition and burning , then no liability could bo claimed as against the city. If there waa any negligence anywhere It was on the part ot the contractors furnish ing the city lights. H was also held that If the defendant knew of the presence of the obstruction In the street nnd there was nn- othcr and safer way to cross , ho was guilty of contributory negligence If ho did not use It. It was shown In evidence that there was a cinder path commonly used In crossing the street at the point and that It would have been nearer nnd canter for the de fendant to have taken It than to go the way ho did , which resulted In the tall over the ridge of earth. The Jury was out only about an hour nnd a half. The suit of Mrs. Jane Johnson against the New York Llfo Insurance company to re cover an Insurance policy ot $25.000 on the llfo of her husband , Frank Johnson , was on trial In the district court yesterday. The attorneys on both sldco are from Omaha , where Mr. Johnson formerly lived , but H was brought here for the reason that Mru. Johnson Is now a resident of this city. The evidence taken so far shows that Johnson had paid the premiums demanded by the In surance company for many years and shortly before his death ceased paying nnd made application for a paid up policy. While these negotiations wcro pending he died The Insurance company resisted payment on the ground that the policy had lapsed on account ot the failure to pay the regular premiums. Smith & Co. and was of sufficient Interest to fill the room with a throng of delighted people. The -display far exceeded In brilliancy and beauty even the most sanguine cn > ectatlon of the friends or the members fad even of the members them selves. Exhibits -were made by fourteen members of the club , each occupying a sep arate table , and altogether several hundred pieces of most elaborately and exquisitely decorated china wcro displayed. Many of the pieces fully deserved the high praise that \\aa accorded them , and the lovers of the beautiful decorative art were given un limited opportunity to admire. The tables wore garnished by a profusion of rose sprays gratuitous ! ? furnished the club by local florists. The display will be continued today and tomorrow. Including the evenings. A new Industry. At present the Institution Is supported largely by state appropriations , but the state has no control of. It. The dis charge of Mrs. S. 'R. ' Woods from , the su- perlutendoncy by the executive committed 3f the Women's Christian Temperance union has caused a scandal , which gro.vs more serious ns It Is Investigated. Mrs. Woods charges openly that she was retired 'because ' she would not allow funds of the homo to bo used to pay the debts of the Iowa Women's Christian Temperance 'Messenger ' , the oniclal organ of the organization. The money was a bequest to the home , and when the state convention of the order passed a resolution to use It to pay tbo dubts of the paper , 'Mrs. Woods threatened an Injunc tion suit , the result 'being that the Intended use was not mode ot the .funds. As a re sult of 'feeling1 ' growing- out of this , she was discharged 'without ' n hearing , on a gen eral charge ot Insubordination , anil refused even permission to leave her private effects In the house a few days , tiino demanded that the state executive council look Into the matter , and Governor Drake and Auditor McCarthy made a full Investigation. As a result they declare that ( Mrs. Woods did a disagreeable duty In preventing the union from misappropriating- held in trust by it ; that she 'has been the main' ' force In building up the Institution , having so licited subscriptions for a large part of the funds ln\ested In the property , and that under the circumstances the state- ought to make no further appropriations for the In stitution \\lthout control of the manage ment. Today the Wild Hose Coa company announced that It will open four oao on the south side 'In DCS Molnes , one at tunnells , ono at Summerset and one a Madrid , Boone county. Today a mittimus was Issued am Sheriff 'Metcalf ' started to the penitentiary with the [ prisoner. They arrived hero at 1 o'clock and were Intending to go to Ana- nosa at 5:30 : o'clock. Shortly ibeforo 4 o'clock Sheriff 'Metcalt ' received a telegram from Chief Justice Klnno of the Iowa supreme court ordering him to take Novak 'back to Vlnton , a writ ot habeas corpus having been ssued. Last night , when Attorney Mllner earned that no time was going to be granted u which to secure bonds , ho hastened to' DCS 'Molncs ' and made application to the su- ircme court 'for ' a writ of 'habeas corpus and the supreme court granted a stay In. the execution of the mittimus.
