Judge Mccy yesterday pronounced sentence upon Charles Mcllugh , convicted of shooting with Intent .to murder ex-Deputy Sheriff Nick O'llrlen. The sentence was ten years In the penitentiary , the severest that could bo Imposed under the law. Colonel Dalley , who defended Mcllughva not present when the ssntcnco was Imposed , and won very angry when ho learned that Ills client had been cal'cd up and sentenced without the court having llrst notified him. Judge Macy called up the case In the morning nesslo'n rud overruled the motion for a new trial but the sentence was not pronounced until after noon. When asked If ho had anything to say Mcllugh arose and asserted Ills Innocence of the crlmo with the greatest vehemence. Judge Macy's remarks to the prisoner were pronounced a moJcl court lecture. When the officer went to lead the prisoner out of the room It was noticed that his legs trem bled so violently that ho could scarcely stand. In pronouncing the sentence Judge Macy referred to the following remarkable letter which ho had received a few days ngo from Wilson , allaa "Doc" Butler , one of the two men captured at tie ! time who were brought beta to testify on behalf of Mcllugh. Hon. N. W. Mncy , Council Illuffs. In. : Dear Sir I received a letter this evening Informing me or .Mellimh's conviction. 1 have before me "clippings" giving tin epi tome of the evldenec offered by the state , and I must say that It la more than mifll- clunt to convince- one nol knowing tne truth of AlclHiKli's guilt ; yet the CUM.- will become historical as showing the most remarkable Instance of mis akcn Identity on record. Mcllugh Is Innocent , Innocent as youriHr , FO far as tnc O'Hrien shooting la concerned. He will be released In a short time , for the evidence offered against him , however strong and apparently conscientious , Is yet false , 'Without one lota of fact for Its basis. Viewed from L mbrosl's standpoint , such men as Mellugh and myself are beyond the pale of humane thought and may Justly be considered lit subjects for extermination. In fact , I feel that society Is justified In ridding Itself of Its diseased members either by killing or caglup. Hut so long as justice throws her protecting arm around all of us poor mortals , tin1 Jift and unlust alike re- cilvlng recognition. It remains for the agents of the law to see that justice's ipreccpts are ktipt lu harmony with truth , for truth , law and God arc synonymous and represent the Unking and lner-llnklng : of the past , present and future. Destroy truth and society will reach a state of chaos. In the Mcllugh case truth was butchered , mercilessly butchered ; but 1 venture the prediction hat within six months the dark mantle of guilt that now enshrouds James 'McHugh will be removed and his entire Innocence be shown , and that Nick O'Brien mill be among the llrst to move for his release. The truth of the "Grlswold" mattc-r will probably never be known , but of this you can rest assured , JudR McHugh U Inno cent I would like to say some word , your honor , that will rencn your conviction , but I know not what I can say to convince you that I am writing- this letter In a snlrlt of honesty and trvith. McHugh \ confegscJIy a bad man , but I will not presume to judge him , for , sitting here In the solitude of my I cell , my though's go back over a wide ex panse of years , nnd I can see In memory a. young boy sitting in solitary confinement , nvcndcrltfg at man's Inhumanity and ask ing , as many others have done , why God should allo.v injustice to prevail. If 1 wcif before my God this nlcht I would defeiul myself boldly for I hold that that unjust first conviction was the sole cause of mj criminal acts In later life. In tracing my tottering steps backward through years of abuse and abuliis" , I find vast difference In the boy sitting In solitude trying to master the Intricacies of words , an 1 the awakened , reasoning man writing to the learned judcc. A confessed thief ! Poor McHughl His candor did not save him. Your honor , I am about to make a declara tion fiat will cause many people to smile In derision. It Is this : If I regain my lib erty at any time. In the future I will nevci offend again. At this moment I am praying God to wither the hands that pen these lines If I speak falsely. And now I declare a ir.il n , Mcllug'i Is innocent. It seems like fate. I received writing paper - per from the warden to write to a friend , not kno.vlnpr that McHugh had been con victed. Had I not had the paper when my letters came. In this evening I should possi bly never have written this letter. A ff.v facts * . I never knew 'McHugh Inti mately , never associated with him and met him but once. It was In Cleveland. O. , thai he was Introduced to me In a house kept by a man named Moore or Ray. Both men were saloon keepers. I am not certain at which house I met McHugh. To the best of my recollection I never met the man but once In my life , and that time was in the fall of ISfll , In Cleveland , O. It Is hard for me to convince myself that all of the people who gave evidence In Int ense wore entirely honest. However I wl'l ' be wllllntf In the- future to accept the axiom t at "the only Indubitable fact Is conscious ness" Hoping you will not misconstrue the Im pulse that caused me to write this letter , I remain yours respectfully. Beforo'sthc readhig-'of the complaint Attorney , Stewart for tbo deforfso asked that the com plaining witness be compelled to put up bond for costs before the case was proceeded with , as the prosecution seemed to be largely a personal ore with the governor and of polit ical significance. This was overruled. Hippie was arraigned and asked for an im mediate bearing. His case was then post poned to 2 o'clock to secure a stenographer and Messrs. Muyhew and Anderson were ar raigned and alee asked for an Immediate hearing. At the afternoon hearing the first move was a demand on the part of the defense for information as to what statute the pros ecution was being brought under , as there are three different ectlons covering the question of embezzlement. The court sus tained the demand and the prosecution named section CC9'8 , Compiled Laws , in which fraudulent and wilful appropriation of money must be proved , Public Examiner Taylor was then called to the stand and questioned as to his knowl edge in regard to the records of the audi tor's office while J. E. Hippie was auditor and the whole examination was a prolonged legal fight between the attorneys as to whether It was necessary to produce the books themselves or whether the examiner's memoranda was sufficient evidence. Ho was allowed to state from his notes that the total receipts of the insurance department during the term of Hippie was $108,136.03 and the amounts turned Into the treasury $102,404.01 , leaving n balance of $3,732.02. The whole afternoon was taken up with the public cx- ammer on the stand and adjournment was taken till Monday morning , when ho will continue.
