acting In the Interests of the Ycrkes lines
nnd the City Railway company , has filed a
brief in the supreme court of Illinois In'
which ho attacks the light of a city or other
municipal corporation to demand any com
pensation , more than a license on the cars
run , frorr. a street car company In considera
tion of being allowed the use of the public
streets. The brief was filed In the appeal of
the Chicago General company from the suit
of the city , in which the latter seeks to
collect the $500 a mile compensation which
Is agreed ( m In the former's franchise
oidlnanco. Its rcopo Is much wider than
this , however , as the principle set up Is that
the city cannot demand such compensation
In any case. If the supreme court thould
sustain Mr. nonncy's position , Its decision
would apply to the ordinances extending Iho
existing street car franchlBn under the Alien
law when they arc Introduced ' In the city
council , as they soon will be. Mr , Uonncy'H
argument applies to gas , telephone and other
franchises , as well as those of the street
