LINCOLN , July 28. ( Special. ) The nown-
paper libel law and the liability of the editor ,
writer and owners of the paper In which
the llbelous article appear * Is to bo passwl
upon by the supreme court In an appeal case
that come * from Ouster county. K. 0. Garrett -
rett brought stilt against , the Republican
Publishing company ntul J. II. Chapman be-
catmo of the publication of a llbeloua article
that appeared In the Drokcn How Republican
on the 30th of April , 1805. At the trial In
district court It was shown that the paper
wan owned by the Republican Publishing
company , and that J , II. Chapman was oper
ating under a lease , which contained a con
tract that ho wa to "manage It In the beet
manner possible for the best Interests of all
the parties , " defray all Its expenses and
divide the profits of ltd publication with Its
owner , tlie publishing company. In the
course of the trial a motion was made to
dlamUa the action as to the publishing com
pany , which wan sustained by the court.
Then the Jury brought In a judgment against
Chapman for $261.10 and costs. Garrett ap
peals to the supreme court , maintaining that
the district Judge erred In dlsink-slng the ac
tion as to the publishing company. In hh
brief nieil today he holds that ho should
have also a Judgment agalnot the owners
of the paper , and says that ho would rather
take the chances of a new trial than to hold
the Judgment ho now has. The point
to bo pissed upon by the supreme court Is
as to liability of both the editor and thu
owners of n newspaper , whore they are dif
ferent persons.

Irrigation was out In the western part ol
Cheyenne county a few days ago , looking
after Irrigation matters , and a letter has
Juat been received from him In which he
says that hu had Just been caught out In
a three and a half Inch rain storm. Ho saya
that It Is evident thpi weather bureau Is not
treating the Irrigation department right , and
he has concluded to leave Cheyenne county
until the high water subsides.
Secretary Nelson of the land commission
er's olllce returned yesterday from Lincoln
county , where ho had been arranging for
an auction sale of school land leases. Thf
aalo Is to occur at North Platte on August
14. Commissioner Wolfe returned this after
noon from Thomas county , where ho had
been holding a sale.
The proof reading of the new session laws
has been finished and It Is promised thai
the now volumes will be Issued the last ol
the week.
A requisition has been Issued tor the return
of Harry Knox from Brighton. Colo. , to Lin
coln , to answer the charge ot stabbing Wil
liam Nelson with fellonlous Intent to wound ,
The crime was committed on 'May 29 , and was
entirely unprovoked , Knox haa Just been
anorehendcd at Brighton , and S. M. Mellck
will go after him.
The Alaska gold fever has struck Nebraska
nnd as a result the Lincoln and Yukon Gold
Mining company was Incorporated today , with
n capital stock of $100,000 , In shares of JU
each. The principal office ot the company Is
to be at Lincoln. Neb. , but the operations ante
to be carried on up In the Yukon river coun

Preparations are going forward for th
Nebraska Epworth assembly , which Is to bt
held at Lincoln Park , August 3 to 10. ; \r
excellent program has been prepared , and
there will bo an able corps of speakers and
other attractions. There Is promise of o
largo attendance , and already 150 tents have
been rented for the season.
Colonel II. C. Russell delivered a lecture
on "Tho Battle ot Shlloh" at the * Lincoln
Normal this evening.
The health officer reports that there Is nol
now a case of contagious disease In the city ,
the last diphtheria card having been taken
down yesterday.
Three gangs of men are now at work cut
ting weeds In dlfXerent parts of the city.
Among the citizens to receive a notice from
the health officer to cut the weeds on his
premises this morning was M. D. Welch ,
jvhose wlfo Is one of the prominent memberc
of the city Improvement society.
A thief entered the house of Mr. Towne , at
the corner of Twenty-nlnth and Q streets , this
afternoon , and was discovered. The neigh
borhood was arouted , and the man was pur
sued down the street by about twenty men
and boys. Harry Towne shot at the fleeing
thief twice with a shotgun , but failed to hit
Iilm. The man returned the flro with a re-
rvolver. but nobody was hurt. I' was
finally captured In the loft uf a livery slabU
and is now In Jail.

terrific rain , hall and wind storm IKIESed
over this place nnd west of hero Monday
evening. Not much damage was done neir
this town , but n few miles west and south
west the hall and wind destroyed much corn
ftnd fruit. At Hlverton , six miles west ,
houses were blown over and some damage
done to crops.

heavy rain fell hero on Monday evening , ac
companied by hall In the northwestern part
of the county. A large amount of wheat has
been cut and some thrashing has been done.
Wheat la yielding from twenty to twcnty-
flvo bimhcls per acre and ta of fine quality.
Corn In In line condition and the prospect
for a large crop was never better. Fruit Is
also promising a Very large yield.

WAIIOO , Neb. , July 28. ( Special Tele
gram , ) Krlck Larson , a farmer residing
fioven miles northwest of this place , com
mitted suicide yesterday by taking parts
green. The poison Is thought to have been
taken In the forenoon and he died last night
at 11 o'clock. Larson was thought to he un
balanced from an accident which happened
him some three years ago. lie was also
a heavy drinker and this Is supposed to
have been partly the cause of his suicide.
After taking the poison , Larson secreted him
self until the evening , when he came from
his hiding place and told his wlfo what he
had done. She sent for a physician , but he
arrived too late to save him. Larson was
C3 years old and leaves a wife and twc
children. He leaves considerable property.

union picnic participated In by the Knlghtg
of Pythias , Modern Woodmen , Odd Fellows
and Workmen secret societies was held In
NlniB1 grove on the Nemaha yesterday.
Owing to the busy season the attendance
was below expectations. A parade of the
lodpes , headed by'the City band , marched to
the grounds at 10 o'clock. Grand Master
Scluiltz of the Ancient Order of United
Workmen , delivered an address on secret
societies and their purposes. In the after
noon lion , George L. Looinls of Fremont de
livered an oration. L. L. Combs of Table
Rock spoke In favor of fcecrct societies and
defended them against various attacks.
Visitors were hero from Uawson , Table
Hock and Hern.

MALMO , Neb. , July 28. ( Special. ) The
town board met with the voters Monday anil
yesterday for the purpose of considering the
advisability of erecting a new town hall ant ]
also for providing better means of protection
against fire.
The hall proposition was at once favorably
passed upon , hut that of the fire protection
took much more weighing and was not de
cided on till this afternoon.
It has been decided to build the hall and
to dig cisterns lu various parts of the town ,
to have a pump at the Malmo Grain and
Stock company's elevator , and to have the
cisterns filled with water , always ready for
use.

NORFOLK , Neb. , July 28. ( Special. ) The
disease of the eye which has been prevalent
among cattle In other states and In parta ol
Nebraska has made Its appearance In this
vicinity. Mr. D. White , who lives a mile
southeast of the Junction , has discovered its
presence in his herd. One of his animals Is
entirely blind and others aeem to be suffer
ing from the first stages of the disease. A
veterinary surgeon who > ls treating Mr.
Whlte's cattle has been very successful In
coping with the dleease thus far. It Is
said that the first indication of Its presence
Is when nn animal's eye commences to run ,
and If a stop Is not put to 'Us progress the
eye will be entirely eaten out.

driver of the 'bus of the Hampton bouso was
arrested and fined Monday for reckless and
c.n-elrss driving , Ho was In the habit ol
driving to nnd from the depot with his honeg
on tlie run. The marshal warned him to de
sist , but no attention WAS paid to the warn
ing. The fine and costs amounted to $1.50.

M'COOK , Neb. , July 28. To the Editor of
The Dec : I haveJint made a trip from
Peorla , 111. , to McCook , In the south
western part of Nebraska. Crops here are
the best of any I have seen. I never saw
shocks stand so thickly as they do here in
some fields. Thousands of acres of wheat
are good for twenty-five to thirty bushels
per aero. I think seme oats will yield sev
enty-five bushels per acre. Corn Is simply
Immense. There are thousands on thousands
of acres that promise a yield of seventy-five
to eighty bushels per acre. I have raised
corn in Illinois for over thirty years , but I
never saw such a corn crop as is growing
hero now. The farmers will have to pile
It on the ground , for they can never build
cribs enough to hold it. The alfalfa .Just
"takes the cake. ' Three- crops qt hay bave
been cut } n pome , Jidda this season , already.
I thought there was no grass equal to red
clover , but alfalfa is clear out of sight of
it. One acrn of-'alfalfa will pasture more
stock than three acres of red clover. More
stock can bo kept here on sixty acres than
en a ICO In Illinois. A ten-acre patch has
kept thirty head of cattle all summer. Four
acres have kept 175 hogs. With hogs to , cat
it a crop of alfalfa is worth $25 per acre
any year. I thought it would not grow on
upland , but William Coleman has a fine
patch , where It Is over 200 feet to water.
Ho has cut two crops from It this year
already. Ho has farmed here fifteen years.
He will answer letters In' reference to the
country If postage Is sent. His address Is
McCook , Neb. A great many could better
their condition by coming here. , TlTern ars

It grew en ; but land will be worth a good

Porter , president of the local phfslclans'
supply company and well known , died this
afternoon , after having taken separate
cioaes of morphine , strychnine and hydrate
of chloral and then turned on the BUS.
He was found In a dying condition In the
rear of his place of business. Tlie ina-

was well-to-do and apparently lived hap
pily.
