rental , and were about to Issue A warrant
for the amount.
The charge was made that there wna n
conspiracy between the city authorities and
the' water company to have the wntcr com
pany recognized anil the validity of Its al-
Ugod franchise established. The plaintiffs
claimed that the company had no franchise
and that the city had the right and power
to nwuinc possession of the plant.

It. Webster , nnd the city was represented
by City Attorney Council. The arguments
In the case lasted until Just before the ad
journment ot court , the greater part nf the
tlmo being taken up by Mr. Webster.
Mr. Webster took the position that when
the American Wntcr company lost the water
plant under foreclosure proceedings and
ceased to operate It the franchise terminated
and that the Omaha Water company did not
acquire * n franchise by purchasing tlio prop
erty and I : , therefore , not In a position tn
ask or demand compensation for furnishing
water to the city. .Mr. Webster also called
the court's attention to two points raised tn
the amended petition filed by the plalntllTii
and stated that the fact that these points had
not been controverted or denied In the
answer tiled by the city must be taken as an
ndmhslon that the statement * therein made
were true.
These two points , ho stated , were specific
allegations that the company now operating
the plant Is not complying with tbo provi
sions of the contract under which It claims
to bo working. The first of thusc provisions
ho stated to lie the section of the ordinance
requiring the water furnished to bo "settled
and purified" and fit for use. The other
provision was the one requiring Biifnclont
pressure to bo developed to throw a certain
number of streams of water to a speellled
height at numerous specified paints and also
to have force sufllclent to afford "ample lire
protection within a radius of 1,000 feet of any
hydrant. " Mr. Webster said that both these
sections were continually violated. He took
the position that this violation dcsposcd of
the whole matter without regard to the
question of whether the company acquired
a franchise by the purchase of the plant.

Seven-year-old Grace 31 ay Hubbcll was
lost early Sunday morning nnd was not
found until late that night. During that
tlmo slio tramped for miles nnd miles
through the brush and over the prairies west
ot tbo city in an effort to flnii her homo.
She had nothing1 to cat during all the hours
and was almost famished.
The little girl lives on a farm about a
mlle west of Florence. At nn early hour
Sunday morning she went out with her
father to get some cows. She wns so little
that she could not be seen above the tops
of the weeds and consequently when she
became separated from her father , aho was
lost. The father spent some hours looking
for the child , and not succeeding , reported
the mutter to the police. The girl was seen
by several people In the country weal of this
city Sunday and they so told the police ,
but no one thought she was lost , and there
fore all let her go her way. About 10 o'clock
that night , however , tire little one became
frightened by the darkness and rapped nt
the door of farmer John Peterson , who lives
south of the now fair grounds.
The Petersons took care of her Sunday
night and yesterday brought her to the po
lice station. The Hnbbells were notified and
took her home later.
