reason that the document bad not been
executed as require * ! by the statutes. This
decision sots aside the will and leaves the
entire estate , valued at $350,000 , In the
hands of Clinton H. Ilrlggs , the only son
and heir of the deceased.
The county court room was crowded at
the hour announced for'tho decision to be
banded down. The contest over the will
excited a great deal of Interest and formed
a topic of Conversation for the past two
months. During tbo hearing , the attend
ance at the court room was qulto large.
The expressions of opinion heard about the
court house were almost unanimously In
favor of the breaking of the will. Mr. Briggs
was the icclplent of many congratulations
at the termination of the case
Mrs. Bmlly J. Brlggs died September 21 ,
1896 , leaving an only son , Clinton H. Ilrlgga.
In her will , dated Novembr 12 , 1805 , she
named George I. Gilbert and C. Will Hamil
ton executors , nnd these two men , together
with C. P. Catlln , trustees. It was pro
vided that the estate should be administered
In such a way that the son was effectually
barred from exercising auy control over the
property , although It was provided that the
estate should be In his name. When the
will was offered for probate , it was contested
on the ground that Mrs Brlggs was of unBound -
Bound mind at the tlmo It was executed , and
for the reason that the document had not
be--a executed In accordance with the stat
utes. In that the witnesses and the testatrix
did not subscribe to the will In the presence
of each other. This last point was sus
tained and the probate of the will was re
fused for that tvason.
DECISION TURNS ON ONn POINT.
The testimony offered In the caae was vsry
voluminous , the examination of witnessed
occupjlng about three weeks. The great
volume of testimony was devoted to proving
and disproving the all gatlon that Mrs. Brlggs
was of unsound mind at the time the will
was executed. Tor this purpose witnesses
wcro brought from distant points and the
greater part of the time waa devoted to this
ono point.
The only testimony on the point on which
the decision turned , viz. ; the execution of
the document , was tlmt.ot W. H. Ijams and
C. Z. Gould , the two witnesses to the docu-
m ° nt. Mr. Ijams testified that bo could not
positively remember Whether Mrs. Brlggs
was in the room when ho signed his name
OB a witness or not. Mr. Gould testified Miry
positively that Mrs. Brlggs was not In the
room when Mr. Ijams' ' signed , and he was
not certain whether she returned to the room
when ho ( Gould ) signed his name to ths
document or not.
Judge Baxter's opinion In the cose covered
nineteen pages of typewritten legal paper ,
and was very exhaustive. He said he should
not attempt an elaborate discussion of the
law and the facts In .the cose , but would
confine himself to a slrqplc statement of the
principles of law Involved and the conclusions
reached as to the facts. Ho first took up
the point of tha mental'capacity ' of the testa
trix. Fourteen pages of the decisloii ivero
devoted to discussing flic evidence on this
point and the law bearing upon the question
ot what constitutes mental Incapacity.
Curiously enough , the evidence which -weighed
the heaviest with the court In determining
that the testatrix was of sound mind was
that contained In a largo number ot business
letters Introduced by the proponents of the
will. These letters wcro signed by Mrs.
Briggs and were in her handwriting. They
were clear , business-like documents , and
great stress was laid upon them In the argu
ment by the attorney for the executors By
an oversight , the attorney for Clinton Brlggs
neglected to Introduce evidence to show most
positively that these letters were written at
the dictation , of Clinton. The attorneys say
they have the strongest evidence on this
point , but were desirous of breaking the
will on other grounds If possible.
It Is not known Whether the casa will bo
appealed to the district court or not. All
the costs In the case BO far will bo taxed
against the estate , as announced by Judge
Baxter this morning. General Cow In , attor
ney for Brlggs , said after the case was de
cided , that ho did not believe the case would
bo appealed , as no one had any Interest In
the matter except Brlggs

the beginning was mode upon a steel vault
12x14 feet In size This vault will bo the
second largest In the city , and It will cost In
the neighborhood of $1,000
Sovereign Clerk Yatcs , one of the officers
In attendance at the St Louis meeting , was
decidedly Jubilant at the defeat of the move
ment to remove the headquarters IIo said
that the lo ° s ot the olllces would bo qulto
a serious blow to the business Interests ot
the city All the lltcrnturo and notices
sent out are dated from Omaha , and consequently
quently the city gains a great amount ot
advertising In that way. All the money
from assessments coni'vj Into the offices and
ta disbursed through them Most ot this
money Is moving continually , but jet the
offices continually retain a balance of some
$30,000 In a local bank. This Incoming
and outgoing money , however , la Included
In the bank clearings. The sovereign clerk
estimates that the order will add $1.000,000
to the clearings this year. Klnally qulto a
sum Is spent In salaries In this city , some
thirty people being employed In the offices.
The difficulties between the sovereign offi
cers and Alpha camp of this city came up
for consideration In the meeting. The
trouble was thoroughly sifted by a commit
tee of the delegates which reported a resolu-
tlon , supporting the sovereign officers and
censuring tha disaffected members of the
subordinate camp.
The department plan failed to bo adopted
by about three votes. The plan of assess
ment will therefore icmaln as at present
The sovereign camp , however , decided to
start a reserve fund. The first two assess
ments paid In by new members will bo place * '
In It and also all the surplus over and above
$10,000 that may accumulate In the genera
fund at the end of any year. Whenever the
death losses amount to more than the pro
ceeds of sixteen asscrsments In any DHL
> ear the difference Is to be drawn out ol
this fund.
The assessment upon now members be
tween the ages ofIS and 52 years was In
creased about 30 per cent. Railroaders will
In the future be admitted Into the order
but the assessments will be about 20 per
cent higher than that ot other members In
less hazardous occupations.

Pomcroy. founder of the Initiative and

, A highway lobbery occurred about 9 o'clock
Sunday night on North Eighteenth , between
Callfouiia and Webstei streets. The victim
was Mrs. Stroud of SIC. South Twenty-fourth
street. As she was about to get Into a car
riage after leaving church a couple of joung
men rushed up to her and snatched a pocketbook -
book from her hand. It contained a smal !
sum of money. A report watl at once made
to the police regarding the occurrence. Mrs.
Stroud was able to furnish a good description
of the thieves. Detectives were assigned to
the case , but they failed utterly to locate
the men.

proceedings against the recount ot the % ole

attempt to change the constitution and count

for that after the commission was appointed
and were refused. Whatever stops may now
