celebrated damage case of Kendall & Smith
against Sanitary District No. 1 , or properly
speaking the city of Lincoln , was opened up
at 3 o'clock yesterday afternoon. The time
until ii:30 : was taken up in securing a jury
after which G. M. Lambertson made tin
opening statement for the plaintiffs ami At
torney Hlckctts niado the opening statement
for the defendants. Attorney Wilson for
the defense moved the court to permit the
sheriff to take the jury to view the mill prop
erty In Lancaster county , which was allegeJ
to have been destroyed or ruined by the
straightening of Salt creek. The motion was
argued at length , but the court has not yet
passed upon the motlou. The defendants
made an unsuccessful attempt to shut out
the record of ad quod damnum proceedings
which were held in 1S73 , and which gn\c
Kendall & Smith the right to maintain their
milldam. The grounds on which "this
objection was made were that tlio statute
had not been complied with. The court ,
however , permitted the records to go in as
evidence. The forenoon session today was
taken up In partially examining N. n. Ken
dall , one of the plaintiffs In the action. Over
( itty witnesses will bo examined during the
trial , which will consume the entire week.
The case was tried a year ago before Judge
Sedgwlck and a verdict for $151,600' rendered ,
but he granted a new trial on error In in
structing the Jury. Judge Scdgwlck is again
trying the case. The plaintiffs ask for dam
ages In the su n of $75,000.

WAYNE , Neb. , Feb. 2. ( Special Tele
gram. ) The coroner's jury In the Ilabh mur
der case reconvened to.lay and heard the evi
dence of three new witnesses. The testi
mony given showed that last fall Uash had
contracted a disease with which his wife soon
became nllilctsO and that they had had re
peated quarrels as to how It happened. The
testimony of Nels Anderson fallowed how and
where Hash might have contracted the dis
ease. The jury was out but a short time
when they rendered a verdict that the wife
and three children had come to their death
from the effects of bslng struck and beaten
about the head with a stone In the hands of
one Clarence Hash and that said blows were
Inflicted Intentionally and feloniously. A
warrant 'was Immediately sworn out for Itaah
on a chaigo of murder and ho will bs given a
hearing tomonow.
It now appeals that the 10-year-old son ,
while his mother was being killed , ran out
of doors In his bare feat in the snow nnU
hid In a cave , his tracks of blood showing
In the snow , but owing to the Intense cohl
returned to the house to bo annihilated by
his father.
It Is stated on reliable authority that Rash
has mailo a complete confession In every re
spect which will develop later. The prisoner
was forced to eat yesterday afternoon as ho
had eaten nothing since the night of the
murder , and ho inow oats regularly ,

J , J. Walker , the local agent of the Inter
national Publishing company of Chicago , who
has been on trial In police court on the charge
of obtaining money from Miss Ida II. Wlman
on false pretenses , has been found guilty
and fined ? 23 nnd costs. The trial was con
cluded Monday afternoon , but Police Judge
Gordon did not render his decision until
yesterday morning. Walker appealed the
case to tbo district court ,
Judge Gordon scoied Walker for the man
