Klllott. murderer of Clay Uutsonplller , were formally begun yesterday afternoon by the arraignment of the prisoner In police court on the charge of murder In the first degree. It had been Riven out that the arrnlRn- mcnt would occur some tlmo during the afternoi. and consequently when court convened at 2-o'clock the room was crowded with spectators anxious to get a view of the murderer. As the afternoon advanced , however , anil the prisoner did not appear , the audience wearied of the monotoncus grind of the court , and gradually thinned out. When the prisoner was finally marched up before the bar there were few more In the room than , the usual police court crov. d. It had been Intended to arraign the pris oner early In the afternoon , but County Attorney Ilaldrlge decided to add another count to the complaint against him. This necessitated the substitution of an entirely new complaint for the original one. It was 4.30 o'clock when the patrol wagon was iiummoned to the county jail to remove the prisoner to the court. When the prisoner was brought down from the "solitary" to the jailer's olllce , a change was noticeable In his appearance. When he was seen Sunday by the reporters Ills face was pa'o ' and white. Yesterday after noon color had returned to his cheeks. His eyes were not restless , as they were the day before. His confession seined to have removed a burden. The prisoner was arrayed In a dark suit of clothes , a dark overcoat and a derby hat , the same clothing ho was dressed In when ho was arrested and brought back to this city. When he entered the Jail ofllce ho asked for a brush , and with this ho ar ranged his hair. His appearance , all In all. despite a growth of stubby berd. was pleasIng - Ing and prepossessing and far from that of the typical murderer , as he Is commonly pictured. FILE A NEW INKOttMATWN. When the reading was concluded Police Judso Oordon asked for his plea and in a low voice he retponded : "Not guilty. I walvo examination. " Judge Oordon then remanded him to the county Jail without ball. Elliott wns taken Into the jaK and kept there until the vallsra and bundles he had when arrested \\ero ob tained. Ho had made A request for them , as they contained his underclothing and shirts. Hosas then carried back to the county jail and Into the "solitary" once more. County Attorney naldrlge fcald that the prisoner would not be tried within the next two weeks. Ho will be given that length of tlmo In which to prepare a defense. H Is understood that Criminal Judge Maker lian already decided upon the attorney whom ho will appoint to defend the prisoner. NO PROMISES OP CLEMENCY. U Is stated that Elliott has had It In hi * mind to make a confession ever since Saturday. He made a partial state ment then to Sheriff McDonald , but the authorities were not ready to take a complete confession. U was deemed ad visable then not to allow icporters to see the prisoner for the purposes of nn Interview until this statement was made. Sunday morning , however , permission was granted the newspaper representatives to talk with him , but ho had been evidently advised not to say anything , and therefore could not be Induced to tnlk. The confession will not Interfere with a determined prosecution of the case. It IB stated that no promises or Inducements of any kind were made to Elliott to bring out the confession. When spoken to regarding the matter County Attorney'llaldrlgo said : "Elliott made the confession voluntarily , no promises of clemency being held out to him. It Is plainly a case of murder In the first degree , and will be prosecuted as such. It Is evident from the. statement that he Is trying to justify the murder of the man , and thereby to get off with manslaughter. " Elliott has made no appeal to Ills relatives In Ohio and doea not know whether they know anything of his trouble. He told the newspaper reporters that ho had no Intention of applying to them for as sistance and 'lid not know whether they would come to his rescue. Ho received a let ter yesterday morning from fcome one at 31 North Seventeenth street , Columbus , 0. The address was apparently written by a woman and was In pencil. The boys are well dressed and evidently of respectable parentage. They have been beating their way west purely In a spirit of adventure and a recital of their troubles would nil a book of no mean proportions. In Chicago they fell In with some men who alleged they were police officers and who succeeded In extorting from them all the mcney In their possession , under threats of arrest. They arrived In this city In a penniless con- ' dltlon and were given lodgings at the union depot during the night. They Imd eaten nothing for two days , they asserted , and the sympathies of the depot employes were enlisted to such an extent that a small amount of money was subscribed for them and a square meal at a neighboring hotel furnished. , The boys left for the west with the heartfelt sympathy of their late friends in this city and a tic pass over the Union Pacific. _ _ _ nnr.viTins. Miss Minnie Smith , a domestic working foi a family In the northern portion of the city , reported the loss of a watch , valued at $15 , to the police yesterday. It was missed while the woman was on her way to ehurch. David Brandt , city editor of the Cedar Haplds Gazette , was In the city yesterday. He was In Cedar Haplds when Murderer Elliott was arrested and Interviewed him. His testimony will be used In the trial of the prisoner. J. P. City Attorney Connell remarked that It would be Impossible to frame a charter that would bo approved by ever > body. The thing to do was to work out the best result possi ble nnd stand for It unitedly without regard to Individual views In regard to any particu lar section. GOVI3HXMI3NT TOO EXPENSIVE. Councilman llasrall declared that the main point was the necessity of aecurlng a Ires expensive city go\errment. Some of the present boards should be got rid of and a uniform valuation of property secured. William Mulhall spoke for organized labor and made a vigorous demand for reforms that would make the burden of taxation lay on all classes alike. There were too many boards In the first place and the city had a government extensive enough to govern a million of people. He denounced ( he ac tion of the Hoard of Education In retaining the usele-H luxury of a paid attorney when the city attorney WES willing to do the work. The discussion turned to the .subject of luxation and the sentiment seemed to bo unanimously-In favor of the creation of the office of tax commissioner along the line of the amendment that wru proposed two yearn ago and which was read by Major Wheeler. Several Instances of the Injustice of the present system wore elted and the neces sity for a different system was vigorously urgcJ. A motion that such an amendment should be asked for was offered and laid over for future consideration. Hascall then called up the Hoard of Public Works matter and several councllmen cx- presrvd thcmselrca emphatically In favor of the cntlro nnnlhlllatlon of the board. Councilman Kmcnt declared himself In favor of reducing the number of councllmon to nine. These ehould bo paid a salary that would enable them to give their entire tlmo to municipal affairs. If this was done much of the work that was now done by the vari ous boards could be attended to by council committees. Kment was also In favor ot abolishing the Hoard of Flro and Police Com missioners end turning the management or the Pro and police departments over to the committee on police of the city council.
