The arrest ot Killtor Hltchbart for libel
was one of the principal topics of convcrsa-
tlon In the city yesterday afternoon anil
both frlcmls of the mayor and the editor
expressed regret that the matter had not
been settled without appealing to the courts.
Now that the light Is on It will bo piwhcd
and no doubt some racy testimony will bo
Introduced at the hearing of the case nrxt
, Saturday.

During the campaign last spring th Sun
supported Knsor and the democratic ticket
and Immediately after the new council was
organized Kllchhart commenced to got the
members In line for the printing contract
and the mayor alleges that with his assist
ance , succeeded In obtaining the promUn
of five councllmon that they would support
ho Sun. Dcfore the time for awarding the
contract arrived Ihe mayor's attention was
called to a section of the statutrs mtilch
irovldes that a paper must have bren
lubllshcd for fifty-two consecutive weeks
> efore the city printing contract can bo
awarded to It. As Hltchhart's paper was
only started last December , the tnaycr made
t known to the members of the council
and advised against such a move. Then
ho editor of the Sun commenced printing
paragraphs In his paper to the effect that
he mayor was a booJIer and that ho ( Hitch-
hart ) has been turned down because ho did
not bribe the mayor. Matters have been
running along In this way since the prlnt-
ng contract was let , and the mayors
'rlrnda ' have often advised him to take
steps to compel Hltchhart ts prove his asscr-
lens that appointive officers worn compelled
o pay for holding their positions or to
force the editor to print an apology. In an
attempt at a peaceable settlement letters
were exchanged between the mayor and
the editor and finally a conference wn
arranged , but as Hltchbart still refused lo
make a retraction the mayor caused his
arrest.
The case was cot for hearing Saturday
at 10 a. m , and Hltchhart gave bond for
Ills appearance at that time.
In order to substantiate his claim that ho
never " ankcd , demanded or received money
"rom persons holding appointive offices the
mayor has in his possession the following
statement , which was prepared and signed
by appointive officeholders :
"SOUTH OMAHA. Neb. . Oct. 26. We. the
underspend officeholders under the ap
pointive power of the mayor of the city
of South Omaha. Neb. , stand ready and
willing to make affidavit at any time , when
'ailed upon that wo never were requested
by the said city mayor to pay for our ap
pointment , nor have wo ever paid one cent
'or the eake of holding our situations under
the present administration , nor doe In
tend to. "
This Is signed by H. H. Montgomery , city
attorney ; Hermann Heal , city engineer ; all
of the members of the police and flrc de
triments ; John Carroll , milk Inspector ;
Robert Parks , building Inspector ; Peter
Lcnagh. garbage master : J. W. Cress , city
wel hmaster ; Clark Howard , stock Inspector
specter ; Joseph J. Maly. poundtnaslcr. and
John Hoia , street commissioner.
The statement which follows Is also In
possession of the mayor and la signed by
every city official-
"We , tbo undersigned city officials , having
been elected as such to serve In our re
spective capacities , arc personally and well
acquainted with the prreent city mayor , T.
H. Ensor. before and since hla election ; and
as such wo feel confident In stating , at
least to far as wo know , that ho has notfer
practiced , or attempted to practice , mal
feasance In office , directly or Indirectly , anil
w-e believe that the charges preferred . .
against him by the Dally Sun of this city
are malicious and without foundation ; but
to the contrary wo know It lo be a fact
that Mayor Knsor has admonished and fore
warned any one ueeklng an appointive office
during his administration against the use
of money , or any other undue Influence
with the city council : and on more than
one occasion ho has declared that he would
appoint no such party , or parties , to office
who would undertake to corrupt the coun
cil. In order to bo confirmed by such means.
"Wo further state that we have not only
the utmost confidence In T. H. Ensor's hon
esty of purpose as chief exrcutlve of this
city , but also ait to his Individual character
as t > . citizen. "
This document has been signed by Police
Judge Chrlstmann. City Treasurer Ilroad-/
well ; City Clerk Carpenter and all of the
members of the council.
Mayor Ensor says that he has stood the
abu o of the Sun as long as he Is going to
and intends to fight the matter to the end.
He says"H Is no more thin right In
the people of this city and the voters who
elected mo that I should either prove my
innocence or give Hltchhart a chance to
prove to the world that I am the boodler the
Sun tries to make me out. "
