ship Texas , which left .tlie North Atlantic
squadron this afternoon for the purpose of
getting a supply of torpedoes here , struck
a rock while coming Into the harbor at 6EO :
o'clock , and Is hard and fast. She rests on
the rock amidships and resists all attempts
made by the tug Aquldneck to dislodge her.
The position of the vessel Is dangerous , and
should a storm set In , It would KO hard
with It. The place where the vessel struck
Is almost directly opposite the torpedo sta
tion.

The Texas left the North Atlantic squad
ron after the Massachusetts had left the
harbor and Joined the other ships. . When
Bho reached the harbor , the tide was run
ning out strongly , and was at about "half-
ebb. " The first warning the olllcers had
of the danger was a slight shock Just for
ward of amidships , Captain Glass at ouco
ordered the port anchor out. The hook
held firmly and the ship gradually swung
broadside on the beach. She was flrm , and
could not be moved so as to make the least
headway by means of the anchor. The
ebbing tlilo left her a fixture for the night
at least. Captain Henry Glass and Lieu
tenant J. D. Kelly were both on the bridge ,
and nclthe : supposed the water at that point
to.be so shallow. An examination was made
at once , and It was decided to send for a
tug. With the tide below half ebb , five
fathoms of water were found under the
bow and about the same depth under the
stern. As the tide fell , the bow began to
appear above water , and tonight It Is out
of water. The stern Is on a line with the
water. All the naval officials who f.avo
seen the vessel admit that Its position la a
dangerous one. The tug Aquldneck arrived
alongside the Texas within half an hour
after she struck , and quickly got a line
out. The war ship , however , proved too
heavy for the tug to handle , and was ap
parently firmly fixed on the rocV.
.The lug was obliged to give up the at
tempt to lloat the monster battleship to
night , but will make another attempt at
high water , which will bo at 3 o'clock to
morrow morning. Several other tugs , and
possibly the giant wrecker Right Arm , will
assist. Captain Glass , when seen tonight ,
refused to bo Interviewed. He gave orders
to let no one come aboard the vessel. The
department at Washington has been notified
of the accident.

The defendants nro charged wllh violating
the first , second , third and fourth sections
of the Interstate commerce act In that they
have established and maintained rates and
regulations , and have given terminal privi
leges to the other parties which are un
reasonable discriminations against Ne\v
York. The complaint tuotrs ] thu rfllabllahcd
rales on grain. Hour and provisions , show
ing that they are from 2 to ,1 cents per 100
pounds higher to New York thnn to the
other cities except Hoston. where the rat
are 2 cents higher than to New York. On
grain the Boston and New York rates niu
the same and range about 1 cent higher
than to Philadelphia and Ilaltlmorc. But ,
the complaint declares , In the cane of Dos-
ton the defendants crnnt shippers twenty
days' free storage and free Insurance , which
lirlvllegea are not granted to New York.
These discriminations , the complaint
charges , nullify the advantages of New
York , both natural and those created by the
expenditure of public and private funds ,
nnd unjustly and unlawfully divert trade
nnd commerce from New York. In conclu
sion. the petition asks nn Investigation , spe
cifically clmrces the violation , prays that
the defendants be restrained from continu
ing the discriminations and requests the
commission to llx rates and charges to the
seaboard cities nnd markets.

chickens were all raised by hand and wcio

found necessary , owing to the confilct of
testimony , to call an expert to show that
the fowla were of the < juallty claimed , The
chickens lost by Palmer were taken from
Forty-third and Lake streets. The prisoners
wore held to the district court , ball being
