Sentence was passed yeaterday mornIng - Ing by Judge II. S. Itaker of the criminal branch o the dIi- trict court , berore whore flolin wa9 tried , the vertlict of the jury having been returned May 9 , one week ago , after a trial lasting Just a week. This was the second trial , the first having reaulted in a disagreement of time jury. When court ConvCaed yecterday morning the court room was almost deserted , but well known citizens and husimiesa men soon corn- menced dropping in and when I3olIn was or- tiered to appear at the bar of the court the benches in the room were filled with men. The defendant was accompanied by his two attorneys and the state va represented by County Attorimy flaidrigo. When helm Dtood before the bar Judge flaker aldresed him , speaking in substance as foliow& : "Henry Balm , the jury whIch heard the OVIieflCO III your ease rettiifled a verdict of . guilty CII the fourth count of the informna- . lion filed against you of embezzling the r.um of $2,500 of 'time funds of time school district of Ornr.ha ; time jury also returned a verdict ' . finding you uiIty on the ninth count er the Information qt embezzling time suni of $3,000 of the money of the school dIstrict ; time jury also foimmid you guilty of embezzlement under the eleventh count , the amount being $100,000 o ( niofley belonging to the city of ,1 Omaha.
