A proceeding that Is entirely out of the ordinary has been commenced In the county court , being a move on the part of the Hock Island Hallway company to ret aside the ap pointment of an administrator. The proceed- IriK Is , ( n a way , an aftermath growing out of the burning of the Hock Island's bridge near Lincoln , In August , ISO * . In June , 1895 , about one year after the burning of the bridge and the wreck of a parcongcr train on account of the destruction of the bridge , a petition was filed In the county court of Douglas county , asking that fieri S. Adam * , a South Omaha attorney , bo appointed administrator of the estate of Calvin Streets , a colored man , who wao alleged to have been killed In the wreck referred to. It was represented In the peti tion asking for Adams' appointment that Streets died possessed of an estate valued at $5 and Adams was appointed by the court In accordance with the prayer of the petition. In the fallowing October , about four months after his appointment , Adams , as adminis trator , brought suit against the Hock Inland company for 15,000 damages for the killing of Streets , It being set forth In the petition that Streets had left a widow and six minor children. In the application filed yesterday by the Hock Island company It Is represented to the court that the appointment was secured by Adams for the sole purpose of bringing the null against the railroad company and not for the purpose of administering the estate of Streets. The petitioners allege that they have made a full Investigation Into the merits cf the case and have found that Streets had no estate whatever In Douglas county ; that he was never a icitdcnt of tve state of Nebra ka , nor of the county of Dauglao ; that he was a resident of the state of Iowa and had no debts and no creditors In the state of Nc- l-rasko. The allegation In the petition for appointment as administrator that Streets hid property of the value of $5 Is denied by the railroad company and the claim that Streets was a passenger on the tra'n Is ques tion or was killed in the wreck Is not ad mitted , every statement regarding the death of Strcts being qualified by the clause , "II he Is dead. " It Is further alleged that the suit brought against the railroad .company d'.d not con stitute an estate , but was a claim or da- mand belonging solely to the widow or next of kin. The petition states that the policy was written March 12 , 1895 , and that four days later the stock was destroyed by fire. It Is alleged that the company has refused to pay the claim and suit Is brought to compel It to do so. It Is also stated In the petition that the stcck was Insured for $4,100 , ? 2GOO of thin amount being In other companies. Shortly after the flro referred to In the petition the husband ct the plaintiff , to gether with another man , were arrjsted and tried In the police court on the charge of arson , the chief cf the fire department rnd members of the detective force testifying to the finding of strong evidences of Incendiary origin of the fire. Heretofore Judge Gcrdon has beenlenlent. . Inflicting a fine , but suspending It on condition that the offenders take out licenses. Llceneo Inspec tor Hurst has complained that this pro cedure renders all arrests practically void , and therefore Judge Gordon has decided to enforce the payment of the fine , or send the offender to jail. The first victim was Jacob Drown , who was fined $1 and costs. Ho was unable to pay and was therefore put on the chain gang to work out the fine. He refused to work , eaylng that ho was sick , and ho was therefore confined In a cell. Brown's family Is In de-stltuts circumstances and the mem bers almost starving. As the Barber company IB largely Inter ested In the paving business In nearly every largo city In the United State ? , the result of the litigation Is ot general Interest. The plaintiff In the case was General Wil liam W. Averlll , n Grand Army veteran , who wan the discoverer and perfccter of asphalt for street paving. For six years ho possessed the exclusive right to Import asphalt from Trinidad Island , off the const ot Venezuela , After several years spent In experimenting ; ' he succeeded In laying the first stretch ot asphalt pavement on Pennsylvania avenue , In Washington. Ho formed what was known aa the American Asphalt Paving company , ono of the stockholders of which was A. L. Uar- bo.- , who Is uow the head of thu Harbor As phalt Paving company. General Averlll'a contention hasi been that Harbcr and h9 ! as sociated took title to and Infringed upon cer tain patents which tbo American company had taken out. Ono of thcso patents , In fact , \a \ Known as the Averlll patent , bearing the general's name. Barber formed a company ot his own , and hla success soon led to the disruption of General Avcrlll's company , and the general became nearly bankrupt. Thirteen years ago General Avcrlll brought suit against Harbor to compel htm to transfer back to the American company the patents relating to the composition and construction , ot asphalt pavement. One Judge died bcforo ho had heard alt the evidence , 'but ' as far back as 1SS7 Judge Patter&on of the supreme court of New York decided that Harbor and hla associates had no Individual right to the pat ents , and that they must make an accounting of the profits acquired by the.n from the use , of the patents. The case dragged along In the courts , and a referee was finally appointed to determine at what figure the profits should be assessed. This referee filed his report last Wednesday , and declared that General Avcrlll Is entitled to a Judgment against Har bor for the sum of $106,401 and costs. Gen eral Avcrlll'u counsel said that this account ing had reference only to the work done by Barber's company In the city of Buffalo , N. While the men were having a good time a colored woman entered the raloon and no sooner had she spied Voak than she made a frank avowal that his charms of person and mind were too much for her feminine heart and she confessed herself smitten.
