Asrwclnto Justices Field , Hnrlnn , Brown nnd llrowcr of the supreme ccurt today In chambers gave a hearing to the attorneys who nre In terested In having the receivership ot the Northern Pacific railroad consolidated. The attorneys present were ex-Senator Spooner and Mr. Turner , representing the Farmers Loan nnd Trust company , Mr. 1'ettlt of the railroad company , Mr , Joseph Choato of the Adams company of bondholders , nnd Mr. Cariloza , the Livingston committee of second end mortgage bondholders. While the argu ments went Into the affairs of the road to groH length , showing Its financial condi tion and the fact of the conflicting views of the present receivers and the courts by which they were appointed , there was practically but one question before the court. That was the question of primary jurisdiction. With this matter pettlc.1 , It Is presumed there would bo no difficulty In agreeing upon one receiver for the road or a sot of receivers who would act harmoniously , as they wutd bo appointed by the court recognized no hav ing primary jurlsJIctkn. The road passes through tha Seventh , eighth and Ninth cir cuits. The receivers for the Seventh and Eighth circuits are now acting In harmony. Messrs. Spooner nnd Turner contended tor the recognition of the jurisdiction of'tho cir cuit court for the eastern district df Wis consin on the ground that the proceedings fern n receiver were origln-illy begun In that court In 1893 and that nil the other courts had recognized this jurisdiction until August , 1S94. Mr. Chcato agreed with them on this plnt. Mr. Cardoza's argument was for the recognition of "the Minnesota csttrt and Mr. I'ettlt's for that of this state of WasMngon. During his argument ox-Senator Spooner said that If the present condition of affairs was allowed to continue the road would KCon bo split In tno and It would bo necessary to operate as two separate lines , to the great Injury of nil concerned , and he assorted that It wno a matter of but a few days when a separate organization would bo necessary. Justice- Drown suggested to Mr. Sposnor the possibility of the local federal courts refusing to recognize any orders the justices might promulgate In answer to these proposi tions , but Mr. Spooner replied that ho did not consider thla prcbnblo. He sug gested In C393 that emergency should arise the Justices might visit the courts for the purpose of haying the orders entered. Whllo the fact did not develop Into the proceedings , It Is known that all the In terests feel that'If they can prevail upon these four Justices to unlto In n recommenda tion It would solve the problem , because they' represent almost ; one-half of the supreme court.
