LINCOLN , Dec , 17. ( Special. ) As forc-
slndowcd In The Dee this morning , the dry
goods house of H. R. Nlssley & Co. did not
open its doors today , owing to the filing ot
chattel mortgages Into yesterday afternoon
to the amount of $16,700. Today warrants
were Issued for the arrest of Nlssley and
his partner. Edward II. Wells. They were
Issued upon a complaint subscribed
to by S. II. Ilurnham. cashier
of the American Exchange Na
tional bank. The criminal proceedings
are the outgrowth of the failure. When the
bank got wind of the failure It oued out
a writ of replevin , claiming the right of pos
session under n chattel mortgage given sev
eral months since for $10,000. At an early
hour this morning the writ was served. A
request for possession was made upon L.
C. Burr , attorney for some of the mort
gagees. H was refused. Deputy Sheriff
Dillon secured entrance to the store by
means of a crowbar , shattering the windows
and seme of the furniture In liU effort * .
Then ho removed the sign announcing that
the store was In the possession ot the mort
gagees and put up another announcing that
the sheriff was In supreme charge. The
mortgages tiled last night run to H. B.
Claflln Co. for $3,500 , to the State Journal
company for $350. to Hargreives Bros , for
$330 and to Amoa Nlssley , Pennsylvania ,
brother of the head of the firm , for $12,500.
L. C. Burr , attorney for some of the mort
gagees , says the liabilities of the firm are
$25,000. The Block Is said to have cost
seme $35,000. C. E. Tlngley , owner of the
building. In the county court this morning ,
began suit for unpaid rent and Issued an
order attachment thereon , Nlssley and
Wcllg were admitted to ball In the sum ot
$1,000 each , which they gave.
Tomorrow morning E. H. Wooley , the
Lincoln attorney recently debarred by Judge
Chapman , will go down to Plattsmouth to
begin his fight for reinstatement. In Judge
Chapman's court he has filed a motion to
have his disbarment net aside and vacated
on the ground that no charge : were made
and filed In any proceedings to disbar him.
Should ho fall In the present proceedings he
will at once appeal to the supreme court.
Judge Lansing has decided that the claim
cf the county of Johnson against the estate
of T. W. Lowrey , although filed after the
statutory bar of time , Is nil right and ought
to be allowed. The estate appeals and will
SCB what the district court will do In the
promises. Originally the tnxes amounted
to $340. hut Interest charges have run the
total to $817.
From the Christian Church of Bethany
Christopher Owlngi and Mrs. Moss have
been expelled on the charge of "indiscreet
friendship. " Nothing moro than Indiscretion
Is charged by the church trustees , but there-
Is said to have been eo much gossip that
it was deemed advlsiblc to disconnect them
from the sanctuary.
L. J. Fowler , who runs n small grocery
and meat store , was today added to the list
of Lincoln's Insolvents. Ho has given chat
tel mortgages to Mrs. Sarah Chapman and
Mcta Wood for $370 each , and to Gsorgo
Fowler for $130.

Lcldlgh says that all rumors that he Is being
supplied by the Board of Purchase and Sup
plies or the Board of Public Lands and
Buildings with anything In the shape of
maintenance for the convicts In his charge
are false. Several papers in the state have
circulated the report that the board had been
supplying him with such maintenance dur
ing the pendency of his mandamus suit
against the Board of Purchase and Supplies
at the rate of ll'/i cents a day psr capita.
"They have not , " said the warden today ,
"given mo as much as 11 cents all told since
the controvcray about putting Contractor
lleemcr Into the penitentiary came up. In
fact , it would bs Impossible for them to dose
so , as they will bo obliged to secure ray
signature to the vouchers before they can
draw 1 penny of the legislative appropriation
for the maintenance of convlctn , and I am
sure I have signed no such voucher. How ,
then , are they going to get the money to do
in They attempted to Bend me some coal
through Beemer , but I refused to receive
it unless It was directed to the penitentiary.
It comes to mo billed that way now. Mem
bers of the board nay that It makes no dif
ference what the decision of the supreme
court Is In regard to the mandamus suit , I
will get nothing at all for the past , but only
for what lo supplied In the future after the
decision. I think , however , the stale of Ne
braska Is good for all Ii contracts for
through Its legal officers. "
At present the warden Is purchasing all
the euppllcs necessary for an economical
conduct of the penitentiary. Today ha re
ceived two carloads cf flour bought In the
nsms of the elate. One thing that evidently
puzzlei Warden Leldlgh U ths supreme
court'u construction of the term "man
damus. " The warden snyo he Instituted n
mandamus suit under the Impression that
such an action would ba given Immediate
prccedenco. Every other suit of the kind
that has been commenced In the supreme

The second day of the trial of the HawKins -
Kins case has been full ol Interest and has
been listened to by oven a larger crowd than
ntttnded yesterday , everybody being anxious
to hear the testimony ot the ex-city clerk ,
J. T. Phillips. Phillips took the stand ut
11 o'clock and remained until 3:10. : Ho
made no attempt to conceal his own guilt
and was positive in hli testimony ns lethe
the guilt ot Hawkins , and stated that no
Inducements had been held out to him to
turn state's evidence , but tint he was doing
S3 bccaiipo he wanted to make n clean breast
of It by telling the whole truth and have
It over with. He testified that General
Colby , who was employed to defend him-
sflf nml Hawkins , had threatened him In
thn jail , and told him that It ho nttemptod
to stick Hiuklns , Hawkins and himself and
friends would dog him lo his grave. He
stated that crookedness had been carried on
In his office under Mayors Fcgg , Phillips ,
Shultz and Cirablc. Ho did not renumber
of duplicating any warrants while Tail or
Ebrlght were mayor , although ho might
have done so.

The Fanners' Institute , which was held this
afternoon , was the most successful and larg
est attended of any meeting of Its kind hsld
in Hastings. Chairman Hart called the meet.
Ing to order and Introduced Prof. Taylor of
the Nebraska university , who spoke for over
an hour and answered all questions put to
him. He snld orchards never got too old
for a light cultivation , and where moat people
ple make a big mistake is by putting protec
tion on the north side of orchards In place of
the south side , as It Is the sun and summer
winds that hurt the trees. Mr. Richardson
also enclco for a long time upon the cultiva
tion of sugar beets. He said that Nebraska
was the best location on the globe for raising
sugar beets , and that It was no longer an
experiment , but a profitable business for the
farmers of the state. Thsre were many
prominent business men at the meeting , who
were deeply Interested.

FREMONT , Dec. 17. ( Special. ) There Is
some talk that the Valley will move the depot
at Dodge about half a mile east of th ? town
In order. It is alleged , to spite the people
who have brought suits for damages caused
by the lire there. The company is said to
liava purchasc-d forty acres of land adjoining
the tracks half a mile and to have had It
platted Into lots and blocks. The town Is
rapidly recovering from the effects of the
fire , and fine brick blocks are being put up
In place of the old wooden onfs that were
burned. Should the railroad company remove
the depot , as It Is rumored. It is doubtful If
they can got much of a town on the new
site. The buildings arc of too substantial
a niture to be moved , and the people would
probably prefer to stand the Inconvenience
rather than Incur the expense of building new
