H. Chappie , was net for hearing before Judge Keysor yesterday and nt the hour for convening court the corridors of th building were thronged with a crowd of met nnd women who were anxious to gain admls slon as npcc'atorg. In order to prevent a crush during th preliminary proceedings n bailiff stood guan nt the door and admitted only members o the bar and Jurors on the regular panel Just a mlmito before the time for the open Ing of the court , a deputy sheriff appeared In charge of Ish , who was conducted to th court room and seated with his attorneys ready for tLo hearing. Ish shows the- effect of his confinement In. the county jail during the pau : six months , "ills usually florid countenance tenanco has bleached to a colorlcssness am ho has gained flesh from lack of exercise He was neatly dressed , as usual , cleanly shaven and apparently In good spirits. Of course a case of such Importance couh not bo fairly entered upon without a little legal rparrlng , and It came up In this In stance on the right of the tate to endorse the names of two additional witnesses on the Information. The defendant's attorneys op posed the proceeding and quoted law am rules to show that It was Irregular. Among 'tho other cl'atlons ' was a rule printed In the bar docket , providing that under no clrcum utancci should the names ot witnesses he entered upon an Information on the day o the trial. "Now , so far as that rule Is concerned , ' Interrupted Judge Kcysor , "I want to sa > that U Is not a rule of the court , vfas never adopted by a meeting of the judges , but was made by one Judge for his own purposes and I am not bound by It. Judge Keysor naked the number of available members o the panel and was Informed by the clerk that there were seventy-two jurymen , Including the twelve men who had served on the Morgan case , and that Jud o Scott was taking a jury trom that number for a cassIn his court Judge Koysor stated that ho would order a tpqclal venire for 100 Jurymen for the Ish case That caused the t-prlnglng of another law point. According to the statutes an order for n special venire should have been Issued one day before the day S3l for the trial of the else. The dofenfe did not want to agree that a. special venire should b ? Issued at this tlms. Since Friday , November 29 , there has been a cas ; of considerable Interest on trial be fore Judge Duffle. It U that ot Charles L Efforts against Hiram Heel and other : , Including the Manhattan Ueach Improvement company , th ? company which Is operating the Lake Manawa pleasure resort. The legal squabble has been brought about entirely by the vagaries of the Missouri river. It appears that In 1SS6 P.V. . Hitchcock took possession of a tract uf land In Sarpy county , along the Missouri river. Some time later he pold sixty-eight acres ot this to Charles Lcffcrts , the plaintiff In the suit. The land was situated along the river bank. In time the river considerably Increased the area of this land by accretions of sand , soil and debris. In fact , It mad * It three or four times Its original size. Then , however - over , the river left its original channel and cut dltectly through west of Lefferts' land and has remained there since. At that Urn ? Like Manawa was formed , It having been originally a part of the bed of the river. Lef ferts' land , Including the accretions , was thus transferred to the Iowa side of th ° river , being situated between Like Manawa , the Missouri river and two streams which con nect the lake with the river. On the accretions since they have been formed a large number of squatters have settled and have taken possession. They went further and sold or transferred some of the land to the Manhattan Ueach Improvement company. The suit Is over the title to this accretion which has ben squatted on. L'ffetts alleges that the property rightfully belongs to him , as the river gave It to him. The squatters , however , charge that they have been allowed to remain In undisturbed pos- seoslon for yeirs nnd ought to be allowed to remain , on the principle that possession con stitutes nluo points ot the law. In the criminal court yesterday Judge Scott mad ; a beginning on the cases against the thirteen members of the Druton gang , There tun a full half dozen of these cases , and they charge cither grand larceny nnd burglary or the rccoUIng of stolen property. The names of two or three of the members of the gang arc on each of the Informations and they have each Invariably demanded a separate trial. The case called v > as the- one wherein James Druton , Stephen Hall and Wil liam Olascowero charged \\lth highway robbery. It Is alleged that on the night of May 1C the three men held up a street car conductor , Thomas II. Fell , while his car was standing at the south end of the Itans- com park line. They entered the car , sho\cJ n mohcr In Fell's face and took his month's wages and some change , 'amounting In all to $ S5 , from him. The three men demanded a separate trial , and the case against William Ulapcowns becun. The attorney for Qlascow made a motion for u continuance , saying that ho was not ready for trial. The motion was overruled , the court holding that the defense had been given plenty of time In which to get ready. When the trial \\SB about to begin , however , It developed that the state had also been derelict In falling to have any witnesses on linnil. "I'll not wait on hour for you , " said Judge Scott to the county attorney who was tryIng - Ing the case. "If > ou are ready , proceed. If not , 1 will continue this ca e until next term and you win ha\c to set at work nt once upon some other case. " After a few minutes' delay the county at torney raid that he would go ahead with the empaneling of the jury and \\ould hustle up sumo witnesses In short order. Qlascow was at once airnlgned on the Information and pleaded not guilty. He was also arraigned on another Information In which he Is ac cused of having stolen from the Twenty- second street power house or the street rail way company $218 worth of goods. Ills part ners In this crime are named as Stanley Clay- comb and lleiuy Dean. The robbery occurred on August 12 , Ib94. Glascow pleaded not guilty. Another member of the gang , James Smith , was also arraigned yesterday on the charge of receiving stolen property of the value of $203. Ho pleaded not guilty to the charge. The goods were found stowed aay In some potato barrels In Smith's house ? . He nc- countcJ for them by saying that Stephen Hall , another member of the gang , roomed with him for several days and left the goods. Smith's wlfo bscamo frightened because she thought they were stolen and placed them In the barrels. The thirteen men who are supposed to con stitute the gang wore arrested last October. Robert and James Druton , Stephen Hall and William Glascow have been picked out as the rlnglsaders. They have been charged with grand larceny and burglary and have ad mitted their guilt on some of the charges. The other members of the gang are chiefly lipld fnr rnrolvlncr atnlfn nrnnprtv. The headquarters of the gang appear to have been at the residence of the Drutons In Central pork. A largo quantity of stolen goods was found there , as well as In the houses of the other men arrested. The piop- erty found Indicated plainly that the men had been pursuing a systematic course of robbery. They admitted as much and In con sequence the police charged up against thorn almost e\e'ry extensive burglary which oc curred for fame time previous to their ar rest. Glascow left the city In short order after uoiiio of hla alleged partners were arrested. He was biought back a short time later. In the middle of the afternoon ths trial of Glabcow was completed and the cai'3 was nlvi'ii ( o the Juiy. A verdict was returned an hour later , Olascow being found guilty of lobbery. Satisfied that something was wrong , lUuman got beneath the counter and In a few minute : wai rewarded by seeing Abbott start acrosi the street \vlth a valise H ? went to a tailor shop nearly opposite the hotel and left the grip nnd contents with some party Inside. When ho appeared again at the door of the etore Dauman captured him and took him back to the hotel. Detective llmlon wai called and he placed the offender nnrtnr ftrroflt. Abbott had been employed nt the hotel for o\er five months. From time to time during the lost few months guests In the house haO been missing articles of clothing nnd jewelry and the hotel management had been put to a great deal of trouble over the matter. Abbott's room was searched and a fine gold watch nnd socral other articles of jewelry were found , which were taken to the police station for Identification , A warrant lias been Issued , charging Abbott with grand larceny. The case of Landergren against the city cf Omaha * which had been on the records ol the district court for n long time , was decided by Judge Ferguson Saturday In favor of the city. city.This This was the case In which the Judges and clerks of election sought to collect double pay for their services. Before the charter was amended there was no provision by which the pay of the judges and clerks In cities of the metropolitan class was fixed. The city paid tliC93 olllclals $3 as usual , but the judges got. together nnd obtained legal advlcs to the effect that since there was no express pro vision in uio ctiarter relating to cities or tno metropolitan class they were In a position to collect the amount fixed for cities of the first class , which was $ G. The city took the posi tion that since the charter was silent upon the subject the city was only obliged to pay the judges and clerks the amount fixed by the general state law , which was $2 , and con sequently that the officials had been overpaid , If anything. The ca'e was argued substan tially on these lines and the decision Saturday established the position of the city. If the case had been won by the plaintiffs the city would have been compelled to pay the elec tion officials of that year ? 3 additional , which would 1m e amounted to about $1,500 In the aggregate. Ramos had formerly worked for the minister , but had been discharged. He knew the Interior arrangement of the house and the habits of Its occupants , so that when the descent was made a clean sweep of the valuables belong ing to his former employe was the result. The police have been unable to get any trace of the burglar or or the articles stolen , but late Information Indicates that he Is moving west.
