An eastbound eXtlre running at the rae of
forty-five miles per hour ran In on the side-
track and struck 1 westbound freight that
stood there. A large number of persons
were killed and wounded . the engines and
several cars were broken to fragments . and
the whole scene. which Is shown In nhoto-
graphs that were : introduced before th jury
yesterday , was one of Indescribable ruin :
Yates was among the Injured. The attorneys
for the company wi try to prove that his
InjurIes were not so serious but that he has
been able to work at his usual occupation
ever since.
The case of Heggerty agaInst the Union
Pacific occupIed a porton of Judge Wool-
son's dar. legerty also claims a big dam-
age fee as the result of a railroad wreck . and I
the evidence was heard lt the last term of
court JUdge \oolson at that time decided
that a release which the plaintiff gave the
company upon time paymenl of a certain
amount relieved the company from any fur-
timer lIability. Hegerty admis time release
Is genuine but wants I set aside. Time case
Is now being prepared for an appeal.

against Hart for $11,000 and a condemnation

the United States cruclt court to have the
case remanded to the district court of the
county . upon the round that the controversy
between her and the deendants was not a

the presence of all the defendants
whom she had made parties to her
stilt . This moton to remand was
decIded by Judge Slmlm'as who In his opinion
which was quite lengtimy and expressed In
the clear and terse language for which he Is
noted said that the right of removal from a
state to a federal court was one which should
be apparent from the record as It existed

of making arrangements to entertain the
