I Is not ofln that a man hu to break

Judge Smith yesterday against the firm of

A short tIme ago Goldsmih , nn Omah saloon
keeper , was defendant In an attachment pro-
ceellng In the district court , In which the
firma of Baker Jyer & Co. appeared as
lilaintiffs. This suit like several others
greW out of the failure of Henry Hotholz of
Neola , whose creditors were somewhat numer-
ous. Rothschid Brus. had a claim and tn-
structed their attorney to push It to a sette
meat A suit was accordingly commenced In
the superior court against Hotholz and a
notice of garnishment was served on Gold-
smith upon court while he was actually In attendance
The probability ' ' that neither Goldsmith
nor verz many or the lawyers practicing at
the Iotawalamle county bar knew that
Goldsmith had been cheated out of any of
his rights by being served with the notIce In
the presence ot the court but from a chance
remark dropped n few days ago by Judge
Smith In the course of I con-
"orsaton with Riley Clare , Gold-
smith's attorney , an Idea was dropped I
Into Clark's brain and an affidavit was med
yesterday by Goldsmith setting forth the
facts as above stated . Judge Smith nt once

miss the suit or appear In court on the first
day of the August term and plead to the :
charge or contempt. There Is not the slight-

work some little Ircom'enlenco to the news-

the cimammge Time ordinance pased some tme
ago prohibitIng young America from jumping
on or off moving trains Is to be enforced
strictly. An exception has been made here-
tofore In the case of newsboys while selling
their papers , but from now on cOnductors
are Instructed to cause the arrest of all news-
boys who violate time rule The only places
wherl they will be allowed to sell their
papers on the car are at the Hock Isbn
anti Northwestern depots and at the corner of
Broadway and Pearl street , when the cars are
)
standing.
In explaining his acton Mr. Dmmock
states tha n day or two ago there were four-
teen nelHboys on a single train , each armed
wIth newspapers , which , upon investigation ,
were found to bo several days behind time
and could not have been intended for sale
but ' to be used In lieu of paues. hereafter
the newsboys wIll have to pay their fare to
go to and from the depots like anyone else.
The boys have become careless all I Is nol
so much because the motor company objects
to their riding for nothing a It Is to prevent
serious accidents that this acton Is taken.

A letter was received at police headquarters
last evening from Sheriff W. E. Kelly at

According to the calculation made by Ed-
ward I' . Barker , presIdent or the Department
of Taxes and Assessments , the total number
oC taxpayers In Now York City . out of a popu-
"laUon of about 2,000,00 Is 79,000. In other
words , says the New York Sun , less than SO , - .
000 people pay all the tues levied by time
city for state and local purposes and the
smalness of the number when contrasted
with the whi" population has been a subject
of remark. The truth Cf the mater Is that :
the largest part of tno taxes which go to sup-
port the city i. paid by real estate. About
four-fifths of time city taxes arc laid upon
lands and buildings . aniI tnoush. ostensibly '
land owners , pay them , In reality many of
them are little more than collectors . for they
In turn shlfl the hugest part of their burden
upon the tenants , whb thus become at last
the real taxpayers.
The absorption of land In large cite Into
the hands or a few owners has been going on
In this country for many years , but by no
means to so great an extent as abroad. In !
the United States out of 70,000,000 Inhabitant -
tant , 4,500,000 are owners of real estate
These figures do not seem large when compared -
pared with statistics of some foreign coun-
tries. Thus there are 10,000,000 registered
land owner In Russia , 6,000,000 In Austria ,
3,500,000 In France , 2,500,000 In Germany , and
1.200,000 In Italy. The country above all
others In which land may be said to bo almost
. monopolized by a few persons Is Great Drlt
aln , where there are only 180.000 owners of
an area of 120,000 square mUes. In little
Belgium on the other hand , which Is les
than one.tenth of the size of England ( laIn \ ' -
ing an area of 11,000 square miles ) ; there are
215,000 land owners. In Holland , a country
somewhat larger , the number of land o\yner
Is smalier . being 154,000. Greece whIch has
twice the number of square miles that there
are In Belgium , bas just hair as many land
owners.
As a medIum for securing the revenue requisIte -
uisite for local expenses , taxes on land have
always been found to bo the most satisfactory -
tory bec1uso tim property thus taxed I not
sUbject to removal , as Is the case w/th / personal .
sonal property , all evasions as regards value
or Iwnershlp are practically Impossible. I
Is I n fact not generally l\own. except to the
' 79,000 taxpayers In this city . that the burden
of maintaining the city government or New
York Is not assessed against the real estate
owners , but against real estate. A tax Is not
Imposed upon the owner of a certain house
all lot or or a lot wihout a house , but against
the property itself , and the city looks for
payment not to the owner of the land , but to
the land , taxes being on their confrmatDn a
lIen against the land. I I therefore possible
for a man owning a large amount of personal .
sonal estate to be a delinquent on real estate
to the city . and It 18 also ponble ! for the city
to have recourse against a delinquent on per-
, sonal estate by suit . whereas the city's claim
against the same IndLvldusl on real estate
wi be by the sale of the property wihout
direct notice to the owner. Technically
speakIng the only real taxpayers are those
who pay taxes upon personal estate : the real
estate taxes are paid by the land The actual
number of persons contrlbutnl each year In
the way of rent or taxes to the payment of
the city's expenses Is much nearer 1,000,000
than .

learn that this concern rivals the govern-

within the bounds of the city a two pfon-

private post carried 2,2GOOOO packages The
company employs 1.000 men and many horses.

The caoHal of the concern Is nol large , for

19-year.ohl belle , who came from Washington

her foreheall to her neck. her eyes arc

Comment being made over the coincidence
that out of eight candidates for beauty prizes
four should be Washington girls , Miss Green
volunteered the information that "Washing-

A Washingtonian , Nettle Eckles , who
Is spoken of separately because of her de-
cIded superiority to her sister townsgiris Is
running Ida Prime a close race for the
beauty champIonship of Black AmerIca. Net-
tie's strong points are her dimples. Lillian
Russell would give a month's salary for them.
When Nettle's face Is In repose the dimples
are only faintly suggested , but when she
smiles they blonom forth as the lilies In the
field anti simply throw the observer Into a
condition of helpless admiration . As may
be InaJlne.I , Nettle smiles often. The
rivalry between Nettle and Ida Is not at all
bitter. The two girls are warm friends and
are generally seen tpgether. The camp Is
pretty evenly divided on the opinion as to
which or the two leads , but the parties . one
wouh naturally suppose to be most Interested
seem to care verI little about the nmatter. .
A charm sharel by all of the pretty colored
girls Is grace all shapelness of form ThIs
Is probably due In a large measure to the
fact thaI none of them have ever worn corsets -
set . and to the fact also that most of them
imav2 lived much out of doors. A well known
artist said the other day , after seeing a per-
