The information . formation , which was fed a few minutes after the frais occurred at O'Donnell's res- Idence on Park avenue , was found to , con- taln allegations which Stevtck , In his more teiJperato moments , could not back up , for when placed upon the WItness stand he ad- mitten that he had not attempted to levy on any property or showed any execution. This effectually queered the proceedings and the court was about to dIscharge O'Donnel , when the defense asked IJermlsslon to file an amended information , charging that the resistance - sistance took place when Stevick was tryIng to servo an execution. The court would not permit this however , on the ground that Slevlck bad already borne testimony which would put the new proceedings In the same condition as the old. O'Donnel was discharged - charged without further delay. During the testimony the fact was devel- oped that when Stevlclc called on John Do- hary , to help him he did so In such an inarticulate - articulate manner that Dohany had no way of knowing whether Stevick wanted him to help arrest O'Donnel or help O'Donnel brain the officer . and so he very wIsely kept on his own side or tfe fence.
