names given by two tramps who went Into

Joseph Nansel nnd M. McCarty commenced
a suit In the district court > esterday against
J. H. Melualil , doing business as the Rich
Hill Drain company , for an alleged broken
contract entered Into by them last September ,
by which the defendant was to deliver the
plaintiffs 500 tons of baled hay at $9 per ton ,
the plaintiffs to advance $1,000 for It. In
their petition they allege that the advance
was made , but the hay was never delivered.
They claim to have been damaged In the sum
of $1.000 , and tmcd out a writ of attachment
on the ground that the defendant was a non
resident of the state.

Dr. Wells of Lemars , Mo. , who had seen

OPENED Tim ARGUMENTS.
In the afternoon the arguments were com-
nenced Judge Woolson extended the usual
iour and a hilf for each side to two hours.
He notified the crowd that filled all the
space outride the railing and most of that
nslde that If any demonstration were made
iy any ono nt any stage of the arguments
the offender would b.- brought before him
or contempt.
T. 12. Casady made the opening speech for
ho government , dwelling chletly on the evl-
lenco In the case. The only question , he
sild , was whether or not P. M Edglngton ,
he defendant's father , vvis a soldier , and he
did not believe from Ihe evidence that he
was , or that his son ever saw his dead body.
T Genung , on behalf of the defense ,
said that the strongest reason for believing
iliat Edgington was In the army lay In the
'act that there was a family tradition to
that effect , a tradition like that to be found
n the family of eveiy soldier In the land
Up supposed that ol all the soldiers within
.he sound of his voice there were very
few who had children who could tell In what
: ompany their fathers had fought ; all they
< new was that their fathers had fought In
.ho bolld phalanx that charged under Grant
The fact that In miking the affidavit by
Edglngton the date of his father's death was
given as 18SC , Instead of 1SS8 , he attributed
to an honest mistake , on the part of Edging-
ton or Pension Examiner Hrown , he did not
konvv or care which.
J. J. Shea devoted some HttJe attention to
Pension Examiner Drown , detailing the
scheme concocted by him to secure an affl-
ilavlt from young Edglngton when he knew
that the government suspected some one In
the case of fraud. Drown , he said , possd as
the friend of the Edglngtons , and catching
them off their guard , entrapped thorn Into
making dangerous admissions , to bo used
later on In securing their conviction. "do
liome to your children , " ho said , "and tell
them , after hearing the evidence In this
case , never to make nffl lavlt about any
thing under nny circumstances. Ar.J tell
them If they over see a pension agent
around to lock the door. "
M'PIIBRSON'S SPEECH IN DEFENSE.
Smith McPherson followed for the defense.
Ho held that outside the testimony of Edg
lngton No 2 there was not the slightest evi
dence to prove that the defendant'8 father
was not In the army. He did not know as
Edgington was In the war , but he did Know
that his client believed he was. The failure
of "Lieutenant Somebody or other" ( refer
ring to Daxter ) to recognize the names of his
comrades he did not think nt all strange ,
but his testimony only went to show that
the evidence Introduced by the government
did not rlio to the dignity of proof. Voting
Edglngton could not have known. Indeed no
one was simrt enough to tell beforehand ,
what the next congress would do , so that his
making a false affidavit would have been
without any purpose.
When District Attorney Pullen rose to
make his closing speech he was plainly
angry. The attorne > s for the defense , he
said , scorned to be very much exercised over
the "collar" which he and his associates
wore , and to which reference was made by
McPherson at the opening of the trial. The
only collar he wore was his oith of office ,
and the Jurors wore the same sort of collar
The attorneys for the defense also vvoro
a collar , but It was a collar mads of gold
dollirs. The * second burial of old man
Edglngton he considered a myth , and the
fact that young Edglngton was willing to
make a false affidavit when he was talking
to Pension Examiner Drown , a supposed
friend , he considered put him In even a
worse light. The visit of Mrs. Edglngton to
her husband's parents , nnd never once , In
the course of a visit of several days , hearing
them called by their names , was an Im
probable story. Young Edglngton had Inher
ited a streak of crookedness from his father ,
and it had manifested Itself In the false affi
davit " to which he had placed his signature.
T"he refusal of his mother to Identify her
signature to the affidavit she had made was
a suspicious circumstance.
Mr. Fullen hnd still half nn hour to his
credit when court adjourned , and he will
put that In this morning , after which the
case will go to the Jury.

A search warrant was Issued from Justice
Vlcn's court yesterday for Julius Petcrson'8
place at Cut-Off. Julius has fnlled to come
ur with his mulct law tax. Constable Uaker
searched the building and found n number
of bottles and Jugs containing liquor , all ot
which Peterson declared had been left over
from last > car , when he admitted that he
kept a saloon. Hut ho denied that he was
In Unit lort of business now. Uaker confis
cated the liquors , however , and the case will
be tried In a week or so.
About the same time a notice was served
on him of a suit Just commenced In the
district | court to enjoin him from keeping a
saloon. The case will come up for hearing
before Judge Smith next Saturday. Peter
son , however , claims that ho will pay up
he eforo that time arrives. In which event the
ult will probably be dismissed

but this , too , was suspended on good be
havior , providing the costs were paid.

Sherman house. Monday morning Mr. Ing-
ham received a letter from her which left
no doubt that she had committed suicide
