Wheat Startctl Up a Hot Ptica Yesterday
and Closed Stroag ,
SHORTS IN THAT CEREAL WERE ROUTED
lu Corn the Market Wn Only Slightly Itc-
njionilro to the Urrnt Strength
lu Wheat Oiiti ttcro
Quito Active.
CHICAGO , April 15-Wieat started up n
liot pace today , making n 2c advance und
closing IJio higher for May. Covering by
shorts , geared by the expectation of reduced
stocks , the excitement In oil. the advance
In slocks ttnd the ncnernl Improvement In
speculative markets caused the strength.
The other markets followed wheat , May
corn closing lie higher , Muy oats 'AC ' higher
nnd provisions at slight advances.
The shorts In wheat were on the run
today , having apparently become Impressed
with the Idea that stockt ) are pretty sure
to be materially reduced , nnd hence there
wns n scramble to cover. The meager offerIngs -
Ings created n good deal of warmth and
there were rumors that Armour nnd other
elevator men were working the bull side.
All domesllc markets were on the rampage
nnd the bull sentiment wns still further
helped by n large decrease In the visible
supply and by the small deliveries In the
northwest ns well as at other Interior points.
The excitement which has been going ou
In oil for some time , the advance In stocks ,
the general Improvement In spueulatlve mar
kets , ns well ns reports that the northwest
wouM sow less wheat thnn usual this
pprlng , nil tended to sliengthen the feeling
In wheat. There was some rein'tlon before
noon , but the feeling was generally Btiong.
All the foreign exchanges are still closed ,
but will be running us usual tomorrow. The
Jtlnnetipolls receipts weie lir > earn , and Du-
lulh got O : ; , making together 17S cars , com
pared with 2ra cars n week ago nnd 4MI on
the similar dny of the year bcfnrp. Pri
mary receipts all t > , ld w.-re 131,000 bu. ,
ngalnst 2i'j,000 ' bu. a year ago. The visible
supply decreased l',2tfi,000 bu. for the v/cek
and the total Is now 70.137.000 bu. . compared
with ( , U,217 , < XX > bu. n year ago and 7ii,03'i.00 < )
bu. nt the corresponding time In 1S93. The
price opened today nt from 634c to CB-rtiC.
The close on Saturday was nt O.Te fellers.
The feature In the pit was more the smallness -
ness of the off 'tlng.i than the heaviness of th'
amount that wan wanted. The demand In
creased as It became more dlfllcuH to buy nnd
n great business was done In the end. ihe
price rose to DCo , then up to f > G'c , nnd In a
few minutes It shot up from DGVfe to 57c. A
mere reaching out by Pnrdrldge's brokers
for some wheat caused the latter bulge. The
market quieted down after 12 o'clock.
Izlng sales caused n reaction to from
to GG c , but GC'.fec wns the closing rate.
The ctrn market was only slightly respon
sive to the great strength In wheat. It
could not , however , Ignore the bullishness of
Its neighboring receipts , although 2) ) carloads
over Saturday's estimate are still very light
for this time of year , but the concurrent
demand for shipment was oven lighter
relatively than the receipts. The visible
supply decreased CG9.000 bu. for the week.
May opened up lie , nt 45-c , advanced
Blowly to IGc and reacted to 15c , cluslng nt
45 c.
The market for oats wns nn active one.
Fluctuations were ruled principally by
wheat nnd covered a range of ? c. May
ntnrted nt 2Sc , sold nt 2S } c , ndvnnced to
! ! 8c , sold down again lo 2Stc ( and closed at
28c. July ranged from 27 > ,4c to ! ! 7'ic. clos
ing Ho to Ho higher , at 27Vic to 27c. Trad-
lug wns general most of the day , although
there was free selling by the country nnd
Bartlett-Krnzler bought nulto heavily.
The provision market was dull , but firm ,
with wheat. There wns not much disposi
tion to trade evinced by cither the packers
or local speculators , nor had the commis
sion houses many orders to fill. Pork opened
with n gain of 7' c , rose Be more , nnd closed
with the whole gain. Lard made very little
stir and gnined only 2'Ac ' , while ribs almost
Blood still , nnd In the end were unchanged
The receipts for tomorrow are estimated
Wheat , SO cars ; corn , l&O cnrs ; oats , 2W cars
hogs , 17,000 head.

CATTLE The receipts of cnttle today
were the largest since April 3. There were
n good mnny good beef stsers on sale , n con-
sldernble proportion of them b-lng west
erns , but there were nlso more corn fed
natives thnn hnv'e been seen In the ynrds
In some days.
The market on fnt cattle did not show
nny material change from Saturday , In fnct
It wns practically n. steady market. Holders
were generally pricing their cattle n little
higher , but It wns one thing to name the
price nnd nnother to get It. The buyers did
not nppenr to be ready to concede nny ad-
vnnce nnd the dny was well along- before
mnny cattle changed hands. Some heavy
alfalfa-fed westerns brought $3.55 and some
lighter natives J4.70 to $5.30.
There were not enough cows or heifers
here to make n market , there being only
three or four loads all told. What few
there were brought good , strong prices. A
part of a load of heifers sold nt Jl and
some cows nt fl.25.
There weio more outside buyers wanting
stockers nnd feeders , there being In addi
tion to others buyers here from Illinois
who had orders for quite a good many
cattle. As n result there was n little bettor
feeling nnd the market could be called
Htrong on that class of cattle. Representa

Where a sale of Roods Is not followed by
an actual and continued change of posses
sion the presumption Is that the xale was
made with the UUention of hindering , delaying -
laying or defrauding creditors of the vendor ,
nnd In n contest with such creditors the
burden Is on the vendee to prove that lit
purchased for g od faith and for value.
2. Therefore , where there was evidence In
n contest between a vendee and creditors
of the vendor tending to show that there
had been no change of possession. It wnf.
error to Instruct the jury that the burden
of proof was on the creditors to establish
fraud.
3. A c-nveyance of goods for the purpose
on the part of the vendor , known to the
vendee , of hindering , delaying or defraud
ing creditors Is void as to such creditors ,
even though the vendor be not insolvent.
4. All persons who were creditors of the
vendor at any time while the goods re
mained In his possession or under his con
trol are within the protection of the statute
against fraudulent conveyances.

The owner of live stock taken up under
the herd law by the owner of cultivated
lands , on whleh they are found trespassing ,
s not , while the stock remains In the poa-es-
slon of the land owner by virtue of his lien ,
under obligations to feed , water or care
for such stock ; such obligations devolve
upon the llenor.
2. In keeping the stock and caring there
for the Honor Is required to exercise only
such care as would be exercised by n per
son of ordinary prudence under the circum
stances.
3. The authority of arbitrators appointed
under the herd law Is merely to appraise
the damage and costs sustained by the
land owner , and therefore any right of
action which may accrue to the owner of
the stock by reason of the former's negli
gence In keeping the same Is not barred by
the fact that the statutory arbitration was
had , damages assessed and paid.
4. An Instruction which misstates the law-
Is not cured by other Instructions stating It
correctly , because the Jury would be left In
doubt as to which paragraph was correct.

Kvidence examined and held sufficient to
support the verdict.
2. The discretion of the trial judge to set
a verdict aside because not sustained by the
evidence Is broader than that of an appel

trial Judge , in overruling a motion for a
new trial , grounded upon the Insufllelcncy of
the evidence , has exercised his deliberate
Judgment thereon , nnd his ruling will not be

3. In an action on a promissory note by an

4. The permitting or refusing of leave to

oil product of the east has directed especial
attention to the oil Industry of the west ,
nnd , as the The Hee has heretofore pre
dicted , the time must soon come when the
oil product of Wyoming will supply the
western market. I have here a sample of
lubricating oil just as nature made It. It
Is suitable for use on any henvy machinery.
It needs no refining and the supply is Inex
haustible. Cuduhy's engineers tried It anil

can be refined , and Is being reduced to the
finest grade of oil , suitable for anv flue
machinery. These vast deposlst of oil may
be said to be next door to Omaha , com

later form the basis of a great Industry , of
which Omaha will naturally be the head

opinion It will not be long before capital
will be willing to Invest In a pipe line be
