Estate that 11m4 No sI4tf'lIC" The old game ot teclng eastern Investors with bogus mortgages seems to have been pl ( , Iayed quite successfully In Omaha within the past few ytars. Just how many thou. sllnlls ot dollars have been loaned on property which never bad any existence nay never wbe bo known , though It Is certain the amount bew w ill \ foot up to a big tolal J. A. Cavanaugh , attorney for Snow , Church & Co. , has lately run across s few Instances I of such operations \ , consummated by a late hroker anti money lender of Omaha , Frank H03eberry , In which Mr. Cavanaugh's clients wl1\ \ lose 2000. In 1890 Hoseberry , through his acquaint. ance with eastern parties Placed two inort- age loans , each for $1,000. One was taken by Nelllo Shipman of Phllilpsburg , N J. , upon lot I , block 17 , E. V. Smith's addition , the loon being made November 1. 1 1890. The other loan was taken by Irs. Sarah A. Str'ker at Easton , Pa. , for n like amount , pen \ lots 10 and 20 , In block 1 , Terrace Place. Par a time all went smoolhly and the p3r- ties congratnlate(1 ( thEmselves on their good Invcstr.ents , ns Interest at 8 per cent was prom\ltly \ paid until within a ye,1f. when It sUddl1ly ceased \ and the parties determined to foreclose. .ir . Cavanaugh has looked tip \ the ProPerty anti found that the parties who g ave the first mortgage , l. D. lIetts and I.lllian lIetts , never hall any existence antI that the land mortgaged by them was oWnEd by Chnrles Deuel. The second mortgage mentioned - tioned was gIven by unknown parties also , John II. Watts and Mary : I . Watts , on property - erty whIch has no existence except In the Imagination i at .tho drawer of the Instruments - m ont ! , whoever he may be. The signatures to all of the Instruments arc forgeries , 'Ir. Cavanaugh says , anti T. A. : 'le eath'B name as register ot deEds Is also Ilronouncd II fi forgery. The name of the register of deeds Is i written on the back or the Instruments admitting - mitting the bogus mortgages for record , and on the face of the Instrur.ents It woulll ap- \lear I that both had ! been duly reordeul . The Ihtes which the Instruments bear are the tlatell upon which they purport to have been lIIed. Inquiry at the register at deeds office showed that no offer ever was made to have thco t Instrulllrnts Illaced on tile , as manifestly conld not have been the case on account of the condition or thl' records. ' The description In the mortgage ! ; given to M rs. Str'leer Is mlslearllng , the name of th : ! alldltlon being written ns "Terraeo Place. " lIad It been written "Terrace ntldltlon" the mortgage at least would have been on property - erty which had an existence. The mortg1Pe3 arc bath acknowhcdged b- ! fore " \1. ; D. Uyde , notary public , " but Mr. Hytle says this Is a forgery and that he did not witness the signatures or take the a cknowledgements . In fact , upon even a casual Inspection It Is plain that lnere was no great attempt by the writer ot the mortgage - gage to make a serious attempt at the Iml- tatlen of signatures , as the several names are written In almost tbe same hand , aJl- parontly. It appears that other parties are mournIng - Ing l the possession of paper similar to those mentioned , one CalIfornia lady In particular ' having been In the city ortly a week before Hoseherry left to look up a loan she lucId on similar security. Hoseberry was last beard at In Chicago , where he went several weeks ago after ho had failed In some speculations on the Board at Trade. George Stryker Is personally Interested - terested In Hosebcrry because Mrs. Stryk'r at Pennsylvania , .who holds one at the mortgages - gages on the lots which can not bo found on the maps , Is his mother. She Is out $1,000 In i cash. Mr. Cavanaugh Is just In receipt at a letter - ter from Jacob Walters Sons ot 141 South Third street , Easton , Pa. , In relation to the case of Mrs. Stryleer , stating that the eastern ; parties arc "just In receipt at a letter from I another 'victim , ' who went from Easton to Omaha to lock after his Interest stating that every dollar and there are thousands ' that went from here ( Easton ) Is thousnnds'l Is I nothing but a. lot of forged mortgages to show what went with the money. " . TIIME NOTE NOT TO BE PAiD , Ceurt . lIold8 that It n'II8 Equivalent to nil - Election lIet. Judge Hope\yell succeeded In laying to. . rest a knotty point at law relating to nn old ! election case which had Its origin In the fall election of 1890. A $500 note was being sued upon , the note contaInIng a peculiar conditional - tional clause at payment-"lf I am elected county commissioner. " George E. Timme was the man wh $ made the note and slgnetl It with this proviso. In 1890 Tlmmo was anxious to secure a scat on the Board at County Commissioners at Douglas county. At that time W. Ii . Vaughn had embarked In II newspaper undertaking - dertaldng which he had dubbed the "Demo crat. " Timme wanted some democratlp sup port and made nn agreement with Vaughn to take $500 worth of the Democrat's stacIe : , and was to draw up a note payable In six , months after Ilato , October 15. 1890 , the one sale condition being that Tlmmo would pay In the event ho was elected commissioner. The election came around and as the event , turned out 'flmme was elected , but In the meantime the note bad ! passed Into the hands of Christ Specht anti M. Maul , who hall accepted the seine as collateral : securlt ) ' for signing a $300 note as guarantors Ye t In spite at this turn In affairs , Timme refuse _ to pay and after consulting : with attorneys , claimed that the Instrulllent was void because : It was clearly against public ; p6l1cy to male such an Instruuilent , the basis of which appeared I- peared to be a bet on the outcome at the dec - tion. tion.Tho The suit was brought In county court by : Maul anll Specht anti the estate of Timme , as Tlmmo himself had since died , was n I- lowed to go out ot court without Olaklng pa'ment. Before Judge ! Hopewell the earn outcome was reaclled.
