al l grain actually purchased by counties or
private Individuals ,
I Is quite evident that house roll No. I ,
I.amborn's bill , to allow counties to vote
bonds for seed grain Is a dead letter. 'Vord !
has gone out through all the destitute couni
tes that the act was unconstitutional , and
wherever the proposition was voted on I
met with defeat Boyd county was an cxcep-
ton , all carried the bonds ta the amount of
20000. These bonds , however have never
been printed , and It Is understood that
'
Audior Moore would not register the bonds
I they had been presented , under advice of
Atorey General Churchill. Hepresentatve
Lambor appears qllo Indignant because the
atorney general declined to gIve an opinion
on the bill while I was In the hands of tie
c ommittee. Barry urged a motion In the
house that a demand be made upon Attorney
General Churchill for such an opinion , but
, 1 t was voted down. There Is said to be
something behind this mater In connection
with the permanent school fund. An
amendment was tacked on to the bill In
the senate providing for an Investment of a
porton of the permanent school fund In
these see grain bonds. So soon as this
was done Lincoln and Omaha bankers Imme-
diately wrote to theIr country correspondents
showIng that I would Involve the drawing
from the banks of a large portion of the
permanent school fund money. ThIs clinched
the mater and to this , alone , Is attributed
the general defeat of the seed grain bonds

LINCOLN , March 9.-Speclal.-Tho ( ) jury'm
In i the murder trial of the state against
George Washington Davis was excused today
at noon tram . further service until 1onday ,
The testimony this morning proves almost
conclusively that \ the wreck was llurposely
nnd maliciously caused by certain partes ,
J. I Shouse , formerly a section hand on
( . lie Missouri Pacific . positively identified the
claw bar as one owned , and repalrell by him.
Since October , 1893 , It had not been In his
possesslou , This' evidence 18 important os
showing that the claw bar was not the
property of the Hock Island conipany The
coat of the 11erellant was identified by Ira
S hiortridge , who found It In the weeds near
the t wreck
It.V. , Day gave the distance between the
Lincoln hotel and the wreck by the nearest
route as five miles. This testmony was
Introduce i to show that tint defendant could
not , by any feat of ability , have reached
the wreck before others . starting from the
colored club house behind the Lincoln ,
Daniel Sullivan had heard many conflicting
reports of the cause of the wreck , and
went there out or curiosity to see If he could
discover anything. Sulvan Is road master at
the Lincoln street railway. Saw a dIsplaced
r ail and noticed that the bake hall been re-
m iioved by a monkey wrench and also noticed
t hat the angle bars had been removed The
winess was positive that a monkey and not
I track wrench had been Used , because the
mark made by the wrench proved it. The
rack wrench would have left no marks for
the reason that It Is manipulated from above
the nut and not on the side. lie lad examined -
amined the' cst rail and found that ten
or fifteen spikes had been drawn with a claw
b ar . the dent of the bar being plainly die-
I cernlble. The witness was fully satisfied
, that , from his examination , some one had
I wrecked the train. Ho had test ed before
, the coroner's Jury that le did not believe
the Job was done by one man. lie still holds
to t that opinion and told the jury that some
one had first tackled the west raIl , and
breakIng the head off a spike there , had
abandoned that rail and begun to remove the
s pikes from the cast rail. From the manner
In I which the work was done he believed timnt
tmt
one man had taken the nuts oft the angle
bars and another had pulled the spikes.
STOny OF A PASSENG
Mrs. Lulu Rutherford of Lawrence , Kan. ,
was a passenger on the wrecked traIn. 'Vhen
the smash came she was seated In the rear
or the coach. She was thrown to the center -
ter of the car by the shock. When the train
reached the bottom of the declivity witness
walled out of the rear door of the coach
and saw a colored man standing there She
approached him and said : "For God's sake
go down and help them. " The negro had
moved off .lowly , and witness had given hIm
a push to accelerate his movements. Time I
negro had made a pecular sound , not ex-
. acty a yell. and went on ,

who lost his life In the wreck , was In deep
mourning , and with ' difficulty restraIned her
tears while - replying to the brief queries '
necessary to establish the death of her hus- :
band.
One of the strong cIrcumstances brought
out to show that the traIn did not Jump the
track Is the fact that the flange of the frt
e nglne wheel that struck the displaced rail
has left Its mark on the tie In a manner
t hat 'speak' . louder than the testimony , of experts -
Judge Tibbets today decided the peculiar
cao of Alexander West against Columbus
Lee. The judge finds that the plaintiff was
an Ignorant , illiterate man , who was frIght-
ened into deeding a large amount of real estate -
ate to the defendant. Lee represented to
West that some one was about to levy on all
of his ( Lee's ) property and. thus secured a
deed to I himself. The court ordered the
lands l t13 fraudulently obtaIned to be recon-
'eyed to West. No consideration was found

of great value , namely , requiring that all )
boys and girls under 1 years of ago after
the hour of 9 o'clock at night , should repair
to their own homes. I has been enforced
and there seems to be but one sentiment re
spectng it , and that Is that every city In the
country ought to enjoy the benefits of n
l ike ordinance. I was claimed by PresIdent ! -
dent Hogeland In his address In the Baptist
churc hero on Sunday that I a sImilar
ordinance existed In all the cites of the
country respecting children being at their

would In a comparatively short time lessen
