In earnings was due to the miners' strike and

cent of nil available revenue , Including that

Central Labor union says : "It seems to me
that some ot the criticisms on Mr. Powers
era unjust. While I do not believe Mr.
Powers to bo the greatest man In the state ,
still I believe ho Is one or tile best men lIt
tile state , and I am satisfied If he Is left
alone ant gIven an opportunity ho will prove
to be a good labor commissioner. Mr. Powers
Is very much In earliest In the reform movO
mont , and with an active young man as
clerk. such as Arthur Edgerton. they will ,
In my opinion , gIve the state as good service
as any who have fled the place. Mr.
Powers Is In perfect sympathy with the
working people of the city. and has been t
member or the Knights of Labor for several
years. lie has also held high positions In
the Farmers alliance , and through the Ne-
braska State Federation or Labor the al-
ances assembles and trades unions are worlt-

Yesterday a number ot prisoners who
have been indicted by the grand jury were
arraigned before Judge Scott , anti \ pleaded
not guilty , except W. E. Dnkle , who rc-
fused ( ] to plead. After the Indictment was
rend , Dlnkle started out to tel that whie he
was Imprisoned In lie county Jan the jailer
had trIed to poison hIm. lie saId that ho
was given a email dose of polson every lay
anti that he did not hike It. On being
cautioned by the court that It would bo at
no use to ply 'possum , ho responded : "I
am no 'possum ; 1 am a man. " I Is
thought that Dlnlo Is playing the insanity
racket to get off , as at his preliminary hear-
Ing ho appeared to bo rational. lie Is
charged with having entered the bar ot
Jerome Alien on the night of December 16 ,
IS9t , stealing harness and other articles ot
the value ot $18.75.
Wilam O'Brlen was chargctl with com-
mitng an assall with Intent to commit
great bodily injury upon Sergeant Whnlen
on the night ot January 6. O'Brien was
arrested for being implicated In the robbery
ot a gold watch from Sandow at the llarll
hotel " 'hen ho was being searched at the
polco station he Illcled up I spittoon and
threw II at the sergeant , narrowly missIng
his head.
Andy Ryan was charged with assauling
Herman J. Meyers with thl Intent to com-
mil robbery. Ryan entered Meycrs' saloon
on tile night of December 21 and ordered
a\ those present , five In number , to throw up
their hands and hln . over their money.
To emphasize his request he gently shoved
1 revolver In the face or Me'ers. Ryan
was fInally overpowered and handed over to
the police.
John W. Carter was arraigned ] on the
charge at holding up Joseph F' . C. lumohr
on the night ot November 1 ant robbing
him or $76.
Charles Sherman was charged with having
robbed Philip Kraus or property valued at
$16.Cilarles
Charles I. Nolon was arraigned on the
chnrge ot entering the barn or Alrel L
Lynch and taking there tram a bag of bran
valued at $1. The crime was committed on
January 21 at thIs year.

ChristIna Wassman Is attempting to ob-
tiln from JUdge Blair ant I Jury I judg-
meat at $2,000 against Joseph luzlclta and hIs
daughter. The principal witness In tile case
ID the husb3nd of Cilristina. He was on the
stand yesterday and furnish considerable -
able amusement to thE spectators aiM the
jury on account or his ability In misunder-
standing the questions put to 11m by the
counsel He Is a German , and on account I
or his lack or knowledge or the English
langagE time lawers' questions elicited an-
swers considerably foreign to the ones de-
sired.
According to his story he and his wire had
considerable trouble with the lallori and
hli daughter during the latter part or 1"9
over tile rent or the house they occupied ,
This trouble finally culminated In a personal
encounter on December 29 between Chris-
tina and the dauller oC luzlcla , In which
the later used a broom upon Christina with
considerable effect. Thlis however , did not
end the trouble , ns he caIms that when he
anti his wo retired to peaceful slumber oa
the night of thaC day luzlcll came around
and took out all the windows or the room In
which they were sleeping. There were only
two rooms In the homr and they were not
able to protect themselves from the cold ,
although they took sheet from the bed and
put them In thc windows As a result or
Mr. Ituzicka's method ot getting even , Wass-
man claImed that his wIe contracted rheuma-
tsm , from which she has become perma-
neatly crppled. !
Wassman did not know how 0' Christina '
waD for the very sufficient reason that sIte
herself did not Imow. But before the culmi-
nation or the trouble between her and her
landlord he dil know that she was earning

he was perfectly cognizant c tie fact thaI
he had to pay doctor bills for several months
for his wife all that once le had to take
her to Cleveland to see It the change at air

Power company Is again beIng brought to the
front In the district court. Otis H. 310u
has led an amended petition In whIch he
asks the court to render a judgment at
$17.tiOO In his favor against John T. Clarle.
Balou says that In August , 1892 , he was
induced to purchase 120 % shares at the capi-
tal stock of tile company for the purpose or
engaging In the business or producing elec ,
trlq lights In the city' The stock was
Ilate1 ! 'at nar. but he paid $115 a share on
the representation thaf I was worth that
much. lie claims that he paid In full for
alt or the shares He also alleges that another -
other representation , whlen was raise , was
made to the effect that the company owned
appartus for which It had refused 0 lease
at $150 per month. . I was also alleged that
the company hatl obtained a franchise from
the city to engage In the luslness or pro-
ducing electric lights In competition with the
Thomson-Houston Electric LIght company.
In addition It was represented that tile company -
pany was solvent and did not owe anything

except a $10,000 mortgage. On condition
thal Clarke would cancel this mortgage
plaintiff was Induced to gIve his note for
$2.300 to Clurke.
Balou avers that he bought the stock
solely on time representations or Clarw ! and
that he knew nothing about the value or the
stock himself. Clarke was at that time
