Is the final result of his efforts The case has been before the courts for some time , nearly a year When the city decided to put n proposition before the people for the erection of a market house It was decided that the best place for thc building was on Jefferson square Accordingly - cordingly tim proposition as It came before : the people at lie election In the fall of IS93 pro vided for the erection of a mnrket house i on the square anti the bonds were 'voted. , This was not pleasing to the Boarll of Park Commissioners , and Injunction proceedings I were Immediately begun by Mr. Tuley nllll other citizens In the courts to restrain the i city from utlllzlng Ito square for that pur. pos e. The petition stated that the square had l bean dedicated for park purposes 011I1 I was so marked In the original plat and survey of the city Consequently It was argued I the city hllll no right to use the ground for IInythlng else tItan a parle. It was further claimed that a largo amount of money halt i been expended for trees shrubbery ' and grass S because It was thought ! the square would al ways remain a park. The answer of the city admitted most of the IIlIegations of the petition of the plaintiff , but denIed several of the main points. The city In the first place denied that he part had always been a park from the first survey or the cltv. . But even It It had It was claimed that If the ( citizens of the city wished to use It for any other purpose they had the rIght to do so. The claim was also put for . ward that the only citizens who could enJoin - Join the city were adjoIning property owners , who had some rights In the ( ground on account - count of their proximity. If this point had been affirmed by the court the case would have been thrown out , as l\Ir. Tukey Is 1I0t nn adjoining property owner. The case came up for trial for a temporary Injunction last spring , and In March JUdge Ferguson gran tea It. Proceedings were at , once begun to make the Injunction permanent - nent , and the hearIng was held two weeks ago , also before Judge Ferguson. Since that tlmo the Judge has had the matter under advisement. Judge Ferguson's opinion was very brIef , simply affirming his holding gvelly ! en the temporary Injunction was granted. Ho held that the ground was orIginally dedicated for pa rk purposes and coulll bo used for no other ; pu rpose. lIe also held that any cltlze of , the city , whether on adjoinIng property owner or not . could , on his own motion , enjoin lie ( city from using the grounds for any other" " purposes than park purposes , on the theory that all citizens arc Interested In public pa rks . _ _ _ . _ _ - DENIES THE CHABGES .
