Judge Hall yesterday gave the Chemical
National bank judgment against George and
M. i : . Smith for $340 , of which sum $300 shall
lie puld by the Capital National batik , The
court also found that plulntlft In the case
Is entitled to a receiver's certificate for the
bmoiint mentioned. The defendant bank took
inception to the finding regarding Its liabil
ity and moved for a new trial , which was re-
tubed. A similar brdcr was Issued In the case
of the Chetnlcnl National bank against S. J.
Alexander and the Capital National , the Judg
ment being- for $524.38 , . of which sum $ IDO
il assessed against the Capital National.

LINCOLN IN BIUEF.
The sheriff of Cass county , Iowa , was In
the city today for a requisition for Archie
3los8 , who Is now wanted for forging a checker
or draft for ( CO on a boot and shoo dealer
til Iowa. The governor being out of the
city the papers were not Issued , but were
held for examination. This Is tlio youth re
cently apprehended for attempting to pass a
forged" " check on an Omaha merchant for
$250. but In some manner managed to escape
punishment. Ha la the son ot State Oil
Inspector Ross and was recently before the
insanity board of this county.
Governor Crounso Is in receipt of a com
munication from II. U. Whltmore of St.
Loula , chairman of the Transmlssourl Mer
cantile congress , requesting him and ten
delegates to be present In that city on No
vember 26 , when the congress convenes.

GHIAND ISLAND , Oct. 12. ( Special. )
A lawsuit which has created a great deal
of Interest In this city was up before
Judge Clifford of the county court and a
Jury composed principally of leading busi
ness men , yesterday afternoon. Agent Me-
Means of the Union Pacific brought suit
against J. M. Peterson of the Grand Island
Mercantile company to recover $103,04 which
lift was compelled to pay for freight on a caret
ot sugar. The car came from San Francisco.
It wua billed through to Omaha. In some
manner the car was stopped hero and Mr.
Peterson asked If he could not unload the
car at once Instead of having to wait until
the car went to Omaha and back again.
The plaintiff maintained and bad evidence
to show that ho permitted Peterson to unload
the car hero upon the verbal promise idn
the part of Peterson to pay the return freight
from Omaha In case it was demanded by
the company. The car was unloaded , and the
company demanded the Omaha to Grand
Island freight. McMeans advanced the
money , but when he called on Mr. Peterson
for the same the latter refused to pay. Jnat
The defense urged that It wanted to get at
the company to test the validity of the
claim for freight from Omaha to Grand
.
Island when auch service was never rendered
and denied that It had promised to pay the
amount , The Jury , however , returned a
verdict of $107 In favor of Mr. McMeans ,
The defense will appeal.

Upon opening the store of Penney & Son
yesterday morning It was found that the
i Btoro had been entered during the night 1Cy
a rear window and goods carried away
amounting to several1 hundred dollars. As
far as1 could be ascertained the goods taken ;
consisted of 100 pair ot men's gloves , six
dozen Una silk handkerchiefs , neckties , one
tray of finger rings and several suits , of
clothes , with overcoats , underwear and about
$10 In money taken fiom the drawer. There
Is no clew to the burglars at present , though
It Is thought It was BO mo parly familiar with [ ]
the store , as the goods taken were all of
the best , and people Bleeping near were not
disturbed by any noise.

gram. ) The Buffalo County National bank
clo J Its doors this morning. The closing
was caused by n. $19,000 judgment against
the Samla' clothing house , In which the bank
U.H Interested , nnd a couple of the directors
demanding their deposits. Sands' clothing
house vvns closed at the same time , but no
otlitT business houses have been affected so
tar as known. The assets and liabilities are
not yet known , Following so closely on the
fa'lnre of the First National yesterday , the
closing ot the bank today has caused ureat
miensincss. I toss Gamble Is the president ,
and A. T. Gamble cashier of the bank. Ac
cording to the report of the condition of the
bank at the close of business on July IS last
the liabilities nro slated nt $273,163. The
i-upltal stock paid In amounts to $100,000 , nnd
: i surplus fund of 335,000 , and undivided
profits amounting to $3,07 < ! are claimed. The
deposits amount to $97.100.
The bank examiner Is now In possession ,
tint a statement of Its assets and liabilities
cannot bo ascertained. The county loses a
little river $11,000 nnd the city treasurer
about $200.

The sixth bl-cnnlal state council ot the
Catholic Knights of America , will convene
In Omaha , October 22. Tlio council was
culled to meet at North Platte , but on
account of the bulk of the membership be
ing In the eastern part ot the. state , It was
deemed advisable by the president , who
resides here , to call the council to order In
Omaha. The order Is having n steady
growth In the state , the two largest branches
being In West Point and Omaha. Omaha has
been selected as the next meeting place of
the supreme council of the order , which
will occur early In May next. H Is ex
pected that * stcps will be taken at the
forthcoming convention to assure the su
preme delegates of an old fashioned western
welcome.

DC WITT , Neb. , Oct. 12t There Is great
excitement In this city today over the hold
up of Henry Rupert , The robbers secured no
booty and escaped , but Mr. Rupert was shot
In the left lung , and , although the wounds
are not dangerous , ho was unable1 to follow
his assailants.
The outrage was perpetrated between 9 and
10 o'clock last night. Rupert was loavtng
his store and had just locked the door when
two masked men stepped up and demanded
that he give up the cash box which hc > was
carrying under his arm and his watch. This
ho refused to do nnd the robbers opened fire.
A posse was organized at once , but nothing
had been heard of the robbers up to this
afternoon.

beets arc being1 shipped from hero at the
rate of several cars per day , and there Is a
demand for labor In the beet fields.
Hon. D. II. Mercer's date at Valley has

Taylor , Neb.
Two society belles of Valley played the
roles of John L. Sullivan and Jim Corbett
near the school building last evening. The
trouble was over a young man. who clerks
In a dry goods store at Beatrice. No seri
ous damage resulted to either of the prin
cipals other than lost hair and bloody noses.
Hev. J. P. Yost has been assigned to the
pastorate ot the Methodist church at this
place and will preach his opening sermon
Sunday evening. Key. Mr. Yost was trans
ferred from the C&stcllar Methodist Episco
pal church of Omaha.
Superintendent Hill visited the schools here
yesterday.
Miss Myrtle Smith left this evening for
Omaha to make a short visit with her
parents.
Rev. Mr. Bergstedt. who has been the
pastor ot the Swedish Baptist church at
this place for the past two years , has moved
his family to York , where he has charge of
a church.
C. C. Chambers of Valley has challenged
Hon. R. II. Barnes of Fowler to a debate on
the political Issues of the day. Mr. Barnes
has accepted and the debate will take place
nt the Campbell school house Saturday even-

Mrs. Lucy Flnclr died at her home In this
city Thursday morning of B right's disease ,
She was raised' ' In Brownvllle , being a daugh
ter of Captain W. A. Pollock , for many
years postmaster at Brownvllle , and lived
there until her marriage to Thomas B ,
Klnch of this city. She leaves a large circle
of friends.
Thomas Evans , a young farmer living south
ot this place , died of typhoid-malaria Tuesday
night. He was burled at Prairie Union.
The B. & M. has recently finished a new
Iron bridge across the Little Nemaba at thU
place.
J. H. Llttrell , the well known apple ship
per , Is busily engaged with a large force ot
men In handling the large crop of winter
apples.
