Having become convinced that forbearance lias ceased to bo a virtue , County Judge Baxter has taken Ihe preliminary steps lookIng - Ing to the commencement oT a suit against his predecessor , J , W. nilor , and his bonds men for the recovery of a largo sum ot money that found Us way Into filler's hands by vlrtuo of the offlcolilch lie held and wh'ch that gentleman has never accounted for. Judge Baxter has notified the county commissioners of Ills Intentions and la only waiting their reply before suing Eller upon hla official bond. It la charged that when ex-County Judge Shields passed tlio office over to Eller on January 1 , 1892 , he turned over to htm a bond In the sum of 11,649 In the Platte Saunders estate , which bond was secured by a mortgage on real estate In this county , the tame having been executed by J , W. Lytle and wife , payable to the county Judge and hla succesBors In office. When Judge Baxter took possession of tinolllco the records thawed that thla bond and the mortgage com prised a portion uf the assets of the ofllce , but for some reason Eller did not produce It , notwithstanding the ( act that ho acknowl edged that It v.as In his custody and that he would hare H forthcoming In a , few days. Since then Eller has made any number of promises , but never has lie turned over the ' evidence of debt. In addition to tills the records of the ofllce furnl.sli the Information * that during Eller's ' Incumbency ho collected KSS In the F. A. McNamara estate , which amount has never been paid o > er to the parties to whom the money belongs , lie allies these Items there are a number of small amounts , ranging from { 10 to $50 , all of which grow out of the closing up of estates whtoh the records nbow are still In the hands of Cller. On August 22 , 189-1 , Judge Baxter made a formal demand for the money , but since that the ex-county Judge has Ignored everything In connection with the matter. Judco Kllor'a Disclaimer. An Information has been filed before United States Commissioner Anderson against Max Levy , a Tenth street pawn broker , charging him with passing a coun terfeit silver dollar. The preliminary hear ing will occur on Wednesday. Assistant United States District Attorney Hush will go to Loin ax today to try the case against William Young , assistant postmaster at Oconto , Ouster county. Young Is accused of opening ; a letter to Mrs. James H. Allison from her husband containing an express order for $5 , which ho Is alleged to have cashed. Judge Dundy of the United States circuit court will not return from Deadwood , where ho is now holding court , for about two weeks. Then ho will take up the docket here and assign the cases to be heard. Among the cases to bo tried Is one against W , B. Dorsey In connection with the Lin coln National bank failure. IllHtrlct Court On account of jslckness In-hls family Judge Ambrose was not upon the bench yesterday. The case of the state against Alva Cham bers , charged with assault , was urgued and submitted to- the Jury yesterday. In the criminal section of the district court the case of the state against August Wallen- burger Is on trial. The prisoner Is a resi dent of Florence and Is charged with as sault , In this , that last August he assaulted and threatened the lives of seven boys of the town , all of whom were annoying him by calling him uncomplimentary names. At 3:10 : o'clock yesterday morning fire was discovered In , the rear of residences at 1251 and 1253 South Sixteenth street. An alarm was sent In at once , but owing to the fact 'that the Sixteenth street viaduct Is closed the lire apparatus was compelled to make quite a detour In order to reach the fire. During this time the flames had gullied con siderable headway and were fanned by a strong west wind. Lines of hose were quickly laid and when the -water was turned on It was found that the pressure was very low and the streams were worthless. The two residences at the above numbers were completely gutted and a one-story cot tage In the rear ot these buildings was en tirely destroyed. These three houses were owned by Frank Kunzcl , who occupied ono of them. Frank Broder and Frank Adams oc cupied the other two. During the fire Pipe- man Reynolds of hose company No. 5 was quite badly cut by falling glass.
