Judge Jenkins of tlie United States coufl presided today In the continued hearing oC the Application of the Northern Pacific receivers for leave to Issue $5.000.000 of receivers' certificates. Henry Pnyno , one of the receivers , vvns present , with ex-Senator Spooner of Wisconsin. M. II. Cordozo ot New York represented the second morlcage bondholders , opposed to the Issue ' , clnlmltiR that tt wns unjutt to the second anil tli rd mortgage bondholders. At torneys for the receivers followed with argu ments for the application. Mr , Ncucll , for the receivers , said the receivers had liabilities aggregating $6,000- 000 to moot within the next few months and . the assets av.illnbla do not exceed $400,000. At least 11,610,000 la due now and must be paid. The honor of the court , which Is In control of the road , must be maintained by meeting the liabilities as they fall due. The attorney said that while the attorneys had petitioned for $5,000,000 they could possibly get along with less , but they must have at least $1,800,000 to meet pressing debts and carry on the business of the road. He said the receivers would be willing to have the or der for the certificates drawn In such a way na to meet the objections of the bondholders. Mr. Petit followed with on argument In opposition to the certlilcates. In referring to the securities to be | iut up by the re ceivers , ho said the Northern 1'aclflc securi ties were like Northern Pacific memories , considerably below par. It Is believed that the result of the argument will be an agree ment between the different parties as to the manner of the bond Issuo. The argument was concluded In the after noon and the court decided In favor of the receivers. Judge. Jenkins granted the ap plication for leave to Issue certlflcates to the amount at $5,000,000 and ordered the re- caIvors to report to tbo court on Octobsr 22 the bonds which shall have been received for them and tha rate of Interest offered. The court took up the report of the master lu , chancery on the application for the re moval of Thomas V. Oakes as rcoalver. The report tI , which was submitted to the court at tI Milwaukee some wccke ago , exonerates Oakes from the charge * of Illegal practices In the manipulation of the Northern Pacific prop erty , and the company and bondholders ( lied a motion rejecting It. At today's meeting of the advisory committee- the Emigrant Clearing house of the Western Passenger absoclatlou a formal protest was sent to the Trunk Line association , declaring that the distribution of the emigrant business was made a matter of agreement between the two associations , and that the action of the trunk lines In canceling the agreement without conference and apparently without cause lias caused much surprise to the- west ern lines. It Is asked that all action In the matter be suspended immediately and until a conference- can bo held between the two associations In New York Tha western lines say that If such a conference is to bo held they would prefer that It should be cither on October 15 or 17. The protest winds up with the declaration that It IB the belief of the western lines that the trunk lines are not willing to- push matters so far that the western lines will be forced to take Inde pendent action , which simply rruans that If the trunk lines persist In their present course the western lines will find , it necessary to establish ticket ofllees of their own through out the cast to look after their Interests , The trunk lines have made a. demand on the Western Passenger association lines that they at once- withdraw all their orders from trunk Una territory. They declare that the Invasion of the eastern territory by the west ern lines is without reason or excusa , and Is resulting In much loss of revenue to trunk lines. There Is much doubt as to whether the association will pay any attention to the demand , for the reason that tha matter Is one that Is hardly In the jurisdiction of the association agreement , and all the lines are free to act as they see lit In this matter. They first put all their orders In the tcrrl- toiy of the eastern lines because they thought they were not being treated with entire justice In the matter of routing through business , and so took this remedy Into their oun hands , The association , aa an associa tion , will very probably take no action of any kind in the matter. All In all , there seems to bo an excellent chance for some warm times between the Western Passenger association and tha Trunk Line association before things are adjusted.
