trust company learned of the conveyance
of the pioperty crion after It occurred , but
negleclod to notify the Insurance company

mortgage debt , guaranteeing- collppllon
nnd pavment thereof , but did not assign
the insurance policy nor part with its iws-
pesslon. The mortgage debt was unpaid

of the Insured property.
The trust company brought suit against
the Insurance compimy to recover the
amount of the less. While this action was
pending the mortgage debt matured , nnd
the trust company , in tiursuanco of Its con
tract nt .guaranty , nnlil It off. Held :
(1) ( . That neither the sale nnd conveyance
of the mortgaged property by Crew without
iiermlssloii of the insurance company , nor
lilt failure tn give the Insurance comi > my
notice thereof , voided the policy as to the
trust company ,
(2) ( ) That the status of the trust company
v\ns not of a mere assignee of the Insurance
policy iHsued to Crew , nor tliat of a person
appointed to collect the loss for htm ; that

company could net be made to depend upon
