duplicated for $25,000 tier mils , in which
c&se the Union Pacific proper would not
bring an amount equivalent tb its first
mortgage. Should this prove true , the gov
ernment debt would be cancelled as well as
all outstanding Indebtedness against the com
pany , and the first mortgage holders enter
Into Indisputable possession ot the property.
These conditions arc not charceable to the
clover minds among the receivers , but arc

Moloney has prepared his amended petition
In the quo warranto proceedings commenced
by him against the Pullman I'alaco Car
company. Mr. Moloncy has served notice
upon the attorneys for the Pullman com
pany that ho will appear before Judge Gib-
ions at the criminal court tomornw afternoon -
noon and ask leave to file the amended peti
tion and also the Information against the
company which follows the petition , accordIng -
Ing to the law governing quo warranto pro
ceedings.
The main additional charges made In the
amended petition are In relation to the Pull
man company without charter authority op-
crating a gas plant and brick works. The
court la also told that the Pullman com
pany realizes a large profit by selling water
to the Pullman residents. The company also ,
It Is represented , supplies stenm neat to
many of the business houses and apartment
houses for pecuniary profit. The malnten-
ence of a "truck farm" by tha company Is
charged , and this , the court Is told , cannot
bo covered by a charter to manufacture
railroad cars. The sale ot liquors by tlio
Pullman company In Its cars while In tran
sit , Is also deemed by the petition to be a
direct violation of Its charter rights.
The ownership of seventeen acres ot un
occupied land south of Lake Calumet by the
Pullman company Is attacked. The petition
says that tills amounts to a real estate
speculation. _

another , by that I mean that there Is con

ern Pacific half way. The latter road , whll

The bearing of lllshop Scanncll on the
charge cf contempt growing out of the St.
Paul's church litigation was begun before
Judge Scott yesterday. The matter was
set for 0 o'clock , but was continued until
afternoon In order to allow the attorney
for the bishop to make a written showing In
answer to the adldavlt cf the complainants.
At the afternoon session the court room
was filled with witnesses and other Inter
ested parties. Attorney Smytho read hla
answer. In which ho alleged that the blahop
had never been eervcil with the restraining
order and that ho had never had the posses
sion of the keys to the church , which seema , ,
to bo the principal thing In the controversy. 41
He tcok the ground that the restraining order ' . \
was not mandatory In Its character , that the
court did not Intend that tha bishop should
give up the keys , but simply leave matters
as they were until auch time as the original
suit should be decided.
Some time was occupied In unimportant
discussion of legal points between the at
torneys and then Judge Scott ruled that
the showing of the defense was not sufficient
and that the order of attachment for con
tempt should issue.
This paved the way for the Introduction
of evidence and Anton Inga was called as
the first witness. He stated that he was a
member of St. Paul's church and had known
lllshop Scannell for about three years. With
John Kcwaleskl he bad been appointed us a
committee at a parishioners' meeting to call
on the bishop and find out what ho was going
to do about opening the church. Thin was
Berne days after Father Treska had closed
the church and loft the city. On that
occasion the bishop had accused him of being
the author of the Injunction proceedings ,
which ho denied , and Kawalcskl' shouldered
the responsibility cf that action. Ho had
called tha bishop's attention to the fact that
they wanted the church opened BO they could
have the regular meetings of the church
societies and the children's school , but the ,
bUhop had told them that until they had
ceased their factional fights and had in a do
arrangement t pay their debts he should
not send them a priest or allow the church
to bo opened. Ho refused to give them the
keys and declared that If they went near
the church or attempted to open It ho would
have them all arrested.
Kowalcskl was called and corroborated the
facts stated by the first wit nets. Thesa
proceeding1 ! lasted until , C o'clock , and the
further hearing wag adjourned until 0:30 :
o'clock this morning.
