Not many moons ngo Peter Mlllicld , a
young man who tags cars In the yards of
the Union Pacific Railway company's yards ,
was happy us he basked In the smiles ot a
young and beautiful lady , whose name he
desired to have changed to conform with the
one posse sed by himself and secured by
him from his forefathers. Now , however ,
Peter has discontinued his basking and. Is
putting In his extra time illustriously
striving to earn Hudlcletit wealth to liquidate
a line of $75 and costs , adminl-tcrcd In po
lice court , a mill of justice , which ho at
tended yesterday.
While Peter has labored under the Im
pression that he has been solid with this fe
male , the real facts have been that ho has
had a rival , a very active one , who was los
ing no time , but Instead was doing the nice
thing In the way of buying Ice cream and
giving street car rides in the gleaming of
the warm summer evenings. Some days ago
the fact flashed upon Peter's mind that this
rival had laid siege to the heart of the fair
one and that the citadel where his love had
been securely entrenched had capitulated
and gone- over to the enemy. It was with
feelings of mingled hatred and disgust that
the young railroad man recognized this con
dition of affairs and at once he thirsted for
revenge and good , rich human blood.
The hated rival was C.V. . Hlgelow , a
printer , a handsome fellow and a perfect
Apollo , so far as slzo and strength were
concerned. This young man had met Peter's
fair charmer and from the first he was
simply Irresistible , so much so that the
young man from the railroad yards was
given a case of dumps , from which ho
never 'fully recovered. '
, , Two or three days ago , shortly after the
sun had gbno behind the bluffs on the west
sldo of the Little Papplo , Blgelow had the
girl out for an airing , ho having avowed
that he would parade her to a number of
the Ice crenoi booths of the city. Several
of the places where frozen milk Is sold
were visited and then It was agreed that
another place , located nt Fourteenth and
Howard , should be visited , as a sort of
night cap. Here Dlgelow and the girl were
sitting at a table , over which they were
discussing the flavoring of the cooling deli
cacy , when Peter came along and noticed
what waa going on. Seeing the girl In the
company pf Ills rival , his angry passions
welled up In his bosom , and hissing through
his teeth , he bolted for Blgelow , while
lllgelow bolted for liberty nnd nn open
street , that he might show his sprinting
ability to the best advantage. He was Just
In the act of scaling the high board fence
when Mllhold closed In upon him
nnd pulled him from his perch ,
ruining a pair of pants and causing
the girl to glvo vent to a few screams that
resulted In having the riot call turned In at
the central station.
Having como down off hU perch , Dlgelow
Biiuared himself for the conflict , which he
ought to have won , as he is ever so much
larger than his antagonist. For a time the
men had jt right and left , fighting like two
demons and creating dire havoc among the
chairs , tables and dishes of the refreshment
garden. Several small boys went wild with
delight while the two men , cut , brul cd and
bleeding , broke away nnd glared at each
other llko a couple of wild beasts. For a
time they sparred for points and then they
closed In again , to break away a moment
later , Blge.ow bleeding from a dozen
wounds and declaring that he had been
stabbed.
By this time the police had arrived and
after separating the two combatants carted
them away to the station , where Police Sur
geon Dlbbern dressed DIgolow's flesh
wounds , after which both of the men were
rclea ed on bonds , conditioned that they
would appear In court.

Adjutant General Gage of the Nebraska Na
tional Guards , who was In Omaha Wednesday ,
stated that all preparations had been made
for the nmmal encampment of the state
troops , which will occur In the month of
August. The encampment this year will bo
entirely different from that of any gather
ing of Its. kind ever held by the state troops.
Within the past eighteen months the National
Guards hnvo bcijn entirely reorganized. Many
of the wealt companies In small towns have
been mustered out and
new and stronger com
panies from larger cities added. Among
the new companies are the Omaha Guards
and the Thurslon miles , an exceptionally
strong company at O'Neill and a fine com
pany at North I'latto.
When tlio state troops go Into camp In Lin
coln Jn the latter part of August they will
be supplied -with new uniforms , now camp
equipage , now tents , lings nnd everything
that goes to make military life pleasant and
showy. Among the little things recently
added to the equipment are two large silk
flags , valued at $1G5 each , presented to the
First and Second regiments by the national
government. They uro among the finest
specimens of "Old Glory" over made In the
country.
The encampment will be held on the shores
of the lake at Burlington beach , and In addi
tion to the regular features of a military
encampment there will h9 a program ar
ranged by local enthusiasts at Lincoln to
Include a naval engagement on the lake and
a combined land and naval attack upon n
largo fort to bo constructed und garrUoncd by
Improvised troops. A signal corps has been
organized and the entire encampment will
take on all the aspects of war. The sham
battle to bo fought promises to bo one of
the most Interesting events In the history
of the state

hope of Retting the matter settled for some
time at least.
In the meantime the citizens nrc feeling
and seeing the effects of the present lack of
system In disposing of garbage. One dump
and another has been closed by Injunction
and then ngaln Injunctions have been Issued
restraining officials and citizens from Inter
fering with certain garbage haulers who , as
a result , arc dumping where they plcaso and
they apparently plenso to dump garbage and
offal In the most convenient places. The
first grounds were established over In Bast
Omaha , on Iowa territory , but this was a
long way to haul the loads and the haulers
were not slow In finding grounds nearer home.
As one result the territory north of Grace
street and cast of Fifteenth has been pre
empted by the garbage haulers aa a. dumping
ground for all sorts of garbage nnd night soil ,
greatly to the annoyance and danger to
health of the residents of the northern part
of the city. For several nights several of
the heaps have been on fire and have covered
the city north of Citming street with a thick
cloud of smoke and the noxious odors arising
from the burning of the rubbish.
The garbage men have even become bold
enough to dump their loads on paved street ?
In the northern part or > the city and have
unloaded great quantities of manure and
refuse over tha embankment cast of Sherman
avcnuo and north of Lake street.
There Is quite a history to the events that
have led up to the present complications In tha
garbaga muddle. When the city asked for
bids for the removal of garbage about a year
aeo there were several propositions submit
ted. Frank Dungan made a proposition In
which he offered to remove the city garbage
for ten years for the modest sum of $1,675.-
000. Mr. Dungan's proposition was referred
to the garbage heap.
Hlchard S. Uerlln , under the firm name ot
Nlday & Co. , offered to do the work for
$2,500 a year from the city In addition to the
regular tolls from the owners of the garbage.
Or the firm would build a crematory for $5,000
In addition to the regular prices charged to
prlvato citizens. Mr. Berlin's proposition
was also dumped nnd the council finally
accepted the bid of Alexander Macdoimld.
who agreed to pay the city $250 a year if
ho should bo given a ten ye.ars' contract for
the removal of garbage at the usual rates.

Nu sooner had Mucdonnhl secured the con
tract than the other follows commenced a
warfare upon him that brought on the pres
ent muddle. Four garbage mun. Henry
Coombs , Henry Clark , James Fuller and
Samuel Ovcrgard , found their occupation
gone and they commenced suit against Mnc-
donald to restrain him from enjoying the
fruits of his contract. They charged a
great many things against MacdonuM. They
alleged that he was'a figurehead for S. L.
Wiley ; that he had four partners , Wiley ,
Herlin , Oungan and Hunt ; that he was dis
obeying the laws of the city ; and that he had
a monopoly of the garbage traffic. These
facts Impressed themselves upon the minds
of the court and Jmlso Ferguson Issued a
perpetual Injunctloa restraining- Macdonald
from proceeding with his contract. Mac
donald immediately 11 led a bond and carried
the whole matter to the supreme court ,
where It Is now pending.
Mr. Berlin was numbered among the men
who commenced and have kept up the fight
on Macdonald and his contract , although he
was ono of the original promoters of the con
tract and claimed an Interest In the firm for
hla Influence In getting the contract through
the council and over the veto of Mayor Do-
mIs. On January 1 of the present year Mr.
Uerlln wrote a letter In which he claimed
that Macdonald had promised him one-elev-
onth Interest in the contract , without pay
ment of money , and a salary at secretary of
the company of $1,000 a year. He demanded
that the contract be carried out or ho would
take legal steps to enforce his rights. The
letter was Ignored and was followed a few
weeks later by a second demand from Mr.
Herlln'a attorney. This was also Ignored.
For some unaccountable reason Mr. Ber
lin's tin eat to commence a Hilt against Mac
donald and the others was never carried Into
execution. Seme time In February , how-
ovar , Berlin went Into court with an affida
vit which he had s.gned for the benefit of
another man who was fighting the Macdon
ald contract. In this affidavit Berlin made
solemn "ath that ho had had a conversation
with S. L. Wiley and that as a result of that
conversation he had agreed to work for the
success of the Macdonald contract. In re
turn for his service ! lie claims that Wiley
agreed that a stock company was to
bo formed with a capital of $55,000. Of this
stock Berlin was to have cna-eleventh of the
entire amount without the payment of any
money whatsoever. lie was also to be em
ployed as "secretary" at a salary of $1,000
per annum.

MR. WILEY STEPS IN.
When the garbage question promised to
bring forth a profitable answer S. L. Wiley
commenced to hold conference ! with Mr.
Berlin. It was to Berlin that Wiley mod
estly admitted that no contract could secure
the councllnmnlc approval that did not bear
the Wiley earmark. Berlin admits that he
saw the force of the argument. Ho agreed
to accept one-eleventh of the profits with an

It Is a little difficult to understand Just
what position Mr. Alonzo B. Hunt of the
American Water Works company occupies
with reference to the transaction. It Is
asserted by Berlin , Coombs , Overgard and
the other garbage men that Coombs Is one
of the men who belong to the Wiley com
pany. There Is no other evidence to the
purpose. Mr. Hunt denies It. He admits
that ho signed Macdonald's bond , but claims
that he did so because he had known Mac
donald for many yeara and know him to bo
all right. It Is nowhere charged that Mr.
Hunt bought any councilman or that ho used
his Influence upon the councllmanlo mind
to secure the adoption of the Macdonald
proposition. According to the aflldavlt of
Mr. Berlin the council was handled ex-
cluslvely by Wlloy nnd Berlin. Mr. Hunt ,
however , tells another story about Mr Ber
lin's share In the
alleged joint stock com
pany. He claims tljat lib was accimtcd by
Berlin and accused of being a party to the
garbage deal. Berlin Insisted that he had
InfliioncD In a certain direction and that he
would exercise It providing certain arrange
ments were made. At that time Mr. Berlin
did not claim to own any coiinclltnen. IIo
Intimated , however , that ho did own several
editors and that4 unless he was taken In on
the ground floor ho would cxurclso his In
fluence with his editors to havu the Mac
donald contract eternally damned , or words
to that effect. Hunt asserts that ho In
formed Berlin that he kiiou nothing of any
company and that he felt positive that Macdonald -
donald was alone In his efforts to secure the
contract from the city.

Councilman Jacohsen , who , It Is further
alleged , was bullduzt-d Into an alltunco with
the Wiley crowd after ho had voted ugalnit
the Macdonald contract ,

lish dumps Inside the city limits where Irre
sponsible parties may dump garbage nl prices
they may bo nblo to collect. The men who
secured the partial abrogation of the ono
contract arc themselves disregarding the
mandates of the court , for It can bo shown
that they are dumping garbage In half a
hundred places , many of them several miles
from the dump established at the dictum of
the district court.

United States Marshal Frank E. Whlto
returned yesterday from Sidney , where ho
went Monday night to satisfy himself as
to the truth or falsity of the reports con
cerning the alleged III treatment of the
Commonwealers held In custody at old Fort
Sidney. Mr. While went to Sidney unher
alded , with the Intention of surprising the
whole camp. He arrived there at1 o'clock
In the morning , before any ono was nstlr ,
and wont'at once to the quarters of the men.
He found , first , that every man was supplied
with quilts and blankets , the reports to the
contrary notwithstanding. IIo then went to
the guard house , before the knowledge of
hla presence In camp was known to any of
the deputies.
At the guard house he found thirteen Com
mon wealera who had been locked up for
the Infraction of the rules of the camp.
The guard house consisted of u largo room ,
20x10 feet in size , with small cells opening
Into the main room. The cells , as well as
the main room , were scrupulously clean , and
the place was quieter and cooler than the
big quarters where all of the men were
confined. With one exception the thirteen
men asked permission to remain in the
guard house after Marshal Whlto had sus
pended their sentences and told them they
were free. At the hospital he found three
patients , ono affected with erysipelas and
the other two with rheumatism. He ate
breakfast with the men and found that the
food was clean , well cooked and served In
sufficient quantities. On one or two oc
casions , he said , the meat had been served
In a tainted condition , but this fact was
explained by the extreme heat.
Marshal White released seventeen of > the
Commonwealers Tuesday and Instructed the
deputies to release another squad of seven
teen today. The men will all bo glveri.their
freedom In small squads as fast astlio
country will absorb them. The entire ibody
of Commonwealers will not be turned loose
upon the people of western NcbrasUa at once ,
but all will have been liberated August 5.
Five deputies were discharged yesterday.

using had bcn crushed In on the sides , con
vincing him that the man was short-meas
uring his customers. A test was made and
It was found that Instead of the measure
holding a full quart , It was moro than a
gill shy , even taking liquid measure Into
consideration , while if the test had bjen ,
made with a dry measure , the kind which
the ordinances of the city provide shall bo
used In the selling of small fruits and vege
tables , the shortage would have been double
as much.

Detective John Savage landed "Pony"
Welch , one of the best known western con
fidence and short change men , behind the
bars yesterday. Thu dctcctlvo was com
ing In on the Sherman avenue line from
South Omaha and at South Sixteenth and
Vlnton streets Welch boarded the , train.
Savage went over to where ho was sitting ,
recognized him and suggested that he should
go to the station. Welch tried to work a
bluff , declaring that he was n stock man ,
In town with a large consignment of cattle
and that hooiild make It extremely warm
for any officer who placed him under arrest.
Notwithstanding this , Welch was taken In
and locked In a cell , whcro he will remain
until the St. Joseph officers can arrive and
take him away.
At St. Joseph Welch Is wanted for high
way robbery , the charge being that he meta
a man In the suburbs one dark night and at
the point of a revolver relieved him of a
sum of money and a watch.
