The manner In which IIP has matin god his
case has Impressed many with the Idea that
ho Is far from being Insane. Ho was bound
over to the district court on the charge of
shooting with Intent to kill , but the charge
was nolled by the county attorney on rec-
onimondatlon of the members of tha Inard of
Insanity , as , after an examination , ho was
adjudged Insane. He was taken to the asylum ,
but an application for his release was madi-
out nnd habeas corpus proceedings begun In
the county court.
Judge \Vortzbilrg was busy all yesfprday
afternoon and this morning with the case ,
and during the hearing of the testimony this
forenoon the evidence of some of the officials
of the asylum was to the effect that Ber-
tleon was not In any way mentally affected ,
while the testimony of several friends told
of very curious action on his part. The
judga asked Superintendent Ility that If he
was sure that the man was not Insane why
It was that he was not released. The case
was postponed until this afternoon , but just
before the trial commenced the superintend
ent sent Clerk Uaker nn order of release of
Uerdeen , so the county judge could do noth
ing but declare the case then on trial In his
court dismissed.
The county attorney says ho does not quite
know what he will do about the criminal
charge against Derdoen. Ho was arrested
on a complaint and no Information has been
filed against him and he thinks that the
question of his sanity will bo brought up
again If the charge is reinstated. Ho says
that his life has not been put In jeopardy
as ho only had a hcarlnu ; before a Justice of
the peace.
At a meeting of the Lincoln Labor club ,
held last night , the following resolutlonb
were read and unanimously adopted :
Whereas , The sttlke of the Pullman em
ployes. Inaugurated some weeks since , hah
developed into n gigantic contest between
the laborlnu ; population and the millionaire
corporations ; and
Whereas , The president of the United-
States and the .corporation attorney gen
eral have seen lit to bring to bear the mili
tary arm of the go\eminent In behalf of
the corporations ; therefore ,
Hesolved , That we extend to the striking
employes of Pullman , who have been
driven to the point of desperation , by tin-
diabolical Breed of the corporation , und to
the American Hallway union , which has
rallied so manfully to their abslstunce , our
heartfelt sympathy.
Hesolved , That we deem the action of
the president in calling out the regular
army as uncalled for nnd unnecessary , nnd
that we unite with the A. H. IT. and the
laboring people In requesting the prp. ldent
to withdraw the troops now located at
Chicago.
An Interestinc suit was begun In the dis
trict court today by the filing of a petition
In which the state Is plaintiff against thp
mayor and city council of College Vlow , a
suburb of Lincoln , where Union college Is
situated. The suit is instituted by Charles
Hammond , who avers that the county at
torney would not prosecute it. His petition
alleges that ho Is the owner of forty acres

sessed. He asks the court to Intervene and
declare that the levy of $15 against his prop
erty be not required to be paid.
Articles of Incorporation of the Omaha
Manufacturing company were filed In the
office of the secretary of state today. The
business of the company is to do a general
manufacturing business In leather , metal
nnd wooden wares , which can be finished
with enamel and Japanese work. The incorporators -
porators are J. M. and A. C. Molcalf nnd
H. A. Smith. The capital stock is $5,000.
The case of John T. Clark against John
Stuben has been appealed to the supreme
court. The Judgment of the Sarpy county
court Is asked to be reversed.
Major A. J. Hastings died this morning nt
7 o'clock. The. funeral obsequies will bp
attended to by the Masonic fraternities.
The remains of Dora Moore , who died yes
terday at the penitentiary , were interred
this morning in Wyuka cemetery. She was
sentct'ced to tervo ten years for the murder
of a companion at Kalrbttry , Jefferson
county. Her death was caused by a loathsome -
some disease contracted some years ago.

living west of town , In Anlelopo county ,
became Intoxicated. Ho purchased some
strychnine and died at his Memo with nil
the symptoms of poison. Today his wife
commenced action agatast Tunforss & Co.
for damages In the sum of $5,000 , claiming
that her husband bought the liquor at de
fendants' store nnd that whisky was the
cause of his death. This tliaory Is sub
stantiated by Walsh's brother , wlio was with
him when lie visited the defendant ! ! . The

Tuesday. It lasted thirty minutes , during
which time two inches of rain fell , accom
panied continually by hall the size of hen
eggs and smaller. The one redeeming
"feature Is that It covered a strip only one
mile wide by fhe in length. Corn , potatoes
and gardens arc cut lo the cround. Water
ran from the higher ground in rivers. Every-

I'etltt , one of Crab Orchard's most respected
citizens , attempted to run his threshing
machine engine with a water tank attached
up aery fcteep hill , just west of town.
When about halt way up the hill the main
shaft that propels the engine gave wny , hav
ing been twisted out of the sprocket wheel.
The engine -nt once becoming unmanagenble ,
began running backward down the hill go
fast that It was Impossible for .Mr. Petltt
and a man named Blue , who was guiding
the engine , to Jump. In their efforta to
escape Petltt fell and was run over by both
wheels of the engine , breaking IIH ! right leg
in two places and Injuring him Internally
to such an extent that he died. .

Mr. nnd Mrs. James Jenkins and their three
sons were taken violently sick. When they
were found they were all In a nl- con
scious condition. The doctor pronounced It
poisoning. It Is supposed they wcro poisoned
by eating dried beef. Mr. Jenkins Is In a
critical condition , but the rest of the family
are resting easier now.
