bulletin sajs : The drouth Is practically
broken In all parts of the state , though In
the central district more rain Is needed to

Is remarkably even , and In the larger part
of the etnto It Is about ready to "lay by. "
Oats have headed with short straw , and the
heads are generally dellclont In number ot
grains. The quality of the yield Is likely
to bo greater than In recent years. The
harvest of winter wheat and rye Is In pro
gress In southern districts with fair yields.

SCOTT AGAIN TURNED DOWN.

Yesterday Judge Scott was pretty sharply
turned down by the supreme court. In 1S91
Edward Hargeshelmer was convicted of for
gery In the Douglas county district court
and sentenced by Judge Estelle to four years
In the penitentiary. An appeal was taken
to the supreme court , on the refusal of Judge
Estolle to grant a new trial , and Harges-
heiiner was released on bonds , pending a
review of his case by the higher tribunal.
In April last the supreme court affirmed
the decision of the district court and the
sheriff was Instructed tq see that the sen
tence was put In effect. Sheriff Drexel had
placed Hargoshelmer In Jail , preparatory to
taking him to Lincoln , when nn attorney em
ployed in the prisoner's behalf placed before
Judge Scott a bunch of allldavlts purporting
to show that the prisoner wus insane. Judge
Scott , disregarding the mandate ot the su
preme court and Ignoring the exclusive Juris
diction of the Insanity commission In such
cases , adjudged Hargoshelmer insane ,
granted a now trial and released him on
bonds to appear on the first day of the Sep
tember term of court. County Attorney
Kaley objected to such procedure , but his
objections were promptly overruled by Scott.
Yesterday the attention of the supreme
court was called to the matter by Assistant
Attorney1 General Summers , whereupon a
peremptory writ of mandamus was Issued
ordering Sheriff Drexel to at once curry out
the judgment of the lower court In the first
Instance and take Hargoahelmer to the peni
tentiary. _ _
.Minor Court Matters. '
Judge Hnpcwcll has announced that after
Thursday of this week he will hear no more
Jury cases during the present term. He has
also announced that on June 29 and 30 and
on July 2. and 3 ha will hear motions , de
murrers and o.xparte matters.
Cunningham R. Scott of the criminal bench
wai not In a happy frame of mind yester
day , for at on early hour ho learned of the
action of the supreme court In the Harges-
holnier case. From that time on until tbo
noon recess ho devoted a goodly portion ot
the time , to rousting the members of the supreme
premo bench , especially Chief Justice Norval ,
bccauae that gentleman overruled one ot the
decisions made In the Ackerman case.
Adam Snyder , the ex-treasurer , who U
charged with having embe/.zled county
money , was In the criminal section yes
terday , where ho renewed his bonds In
the sum of $4,500 , James Stcphonson signing
as surety , after which the case was con
tinued until the next term. In the sumo
cuso the men who were on the oftlclul bond
of Mr. Snyder have filed a motion asking
that the complaint and Information bo made
more specific.
Tim case of John Scarda , a minor , by his
next friend and against William Hughes ,
ThunaR Rock and Joseph Kalson , has been
dismissed as to all except Hughes. This
IB the case against ono of the policemen of
South Omaha. The petition recites n long
Btory , which Is to the effect that ono day
Hughes ; the policeman , wan chasing a bad
man , who took a turn over a vacant lot
where a number of boys were playing. At
this particular point the olllcer fired , but
Instead ot winging the bad man ho shot the
boy who Is the plaintiff In the present
damage bull.
