" Held , that the term In- Ilammatory as applied to said charge Is a merited criticism. Cobb vs The State of Nebraska. Krror from Douglas county. Itovcrscd. Opinion by Justice I'ost. The questions presented by this cnse being In all respects Identical with the case of Clalr VH The State supra , It Is , for reasons therein stated , reversed and remanded. Qrand Island Savings nnd Loan associa tion vs Wasmer. Appeal from Hall county. A III r mod. Opinion by Commissioner Irvine. The transcript of a record Hied In this court for the imrposu of appeal Imports ab solute verity and In considering the appeal must be treated as the sole and cxcluclvo evidence of the facts. 2 It seems that under n prayer for the foreclosure of a mortgage nnd for general relief n personal Judgment may be allowed for a deficiency. .1. Where the prayer In In such form and after confirmation of sale the plaintiff Illes a motion praying for a deficiency Judgment , serving notice theicof upon the defendant , such motion will be treated ns an amend ment of the prayer of the petition. 4. A Judgment for a dctlclency may be rendered against one who purchased the mortgaged property after thu mortgage was made and In his purchase assumed and agreed to pay the mortgage debt. Cooper vs Foss , 15 Neb. E15 , followed. B. A mortgagee will not be precluded from obtaining n Judgment for a deficiency upon the ground thnt he knowingly procured too great an amount to be found due upon the mortgage when In the proceedings for the deficiency Judgment the finding of the amount due In the decree Is mutually dis regarded and a new accounting had. C. In the absence of special equities n pledgee of personal property will not be re quired to exhaust his security before enforc ing his personal remedy upon the debt. 7. A note and a mortgage securing It made contemporaneously are to be construed to gether. Therefore , where a note Is payable on or before a date named nnd the mort gage contains a provision that In certain contingencies prior to thnt date the mort gagee may elect to declare the whole amount due. Held : That such provision In the mortgage authorized the mortgagee upon the happening of such contingencies to proceed not only to foreclose the mort gage , hut also to enforce the personal lia bility upon the note. Jenkins vs Mitchell. Krror from Ilex Unite county. Atllrmed. Opinion by Com missioner Irvine. An assignment of error as to the giving enmasse of certain Instructions will be con sidered no further than to ascertain that any ono of the Instructions was properly given. Hlatt vs Klnkald , followed. 2. Under a general denial In replevin the defendant may show any facts tending to disprove the plaintiff's ownership or right of possession. 3. Therefore , where the defendant an swered by a general denial , followed by a special pleading of facts admissible under the general denial. It was not error for the trial court In stating the Issues to the jury to state the defense as consisting of a denial of the plaintiff's claims. 4. The defense In an action of replevin being that plaintiff and defendant were partners and the property in controversy partnership property , the burden of proof IM upon the plaintiff to establish his ex clusive right. 5. Where one partner , by a writ of re plevin , takes partnership property from the possession of the other , the vnlus of the letter's possession should be assessed at the full value of the property , as no accounting can he had In. that notion to determine de fendant's actual Interest. 6. Assignments of en or based upon over ruling challenges to Jurors will not be con sidered unless the record discloses that the challenging party exhausted his peremp tory challenges. 7. Certain rulings upon the admission of evidence examined and held not to bo erroneous. Uender et nl vs Uame , Error from Platte county. Ainrmed. Opinion by Chief Justice Norval. Where personal property Is seized under nn execution against a debtor who has neither lands , town lots or houses subject to exemption , nnd nn Inventory , under oath , is made nnd Hied by such debtor as provided by section C22 of the code , it is the duty of the olllcer holding the writ to call appraisers to determine the value of the property , nnd the neglect or refusal of the officer to do so will not deprive the debtor of his exemption , but he may sue for the value of the property. Shupe vs State of Nebraska. Error from Platte county. AHlrmcd. Opinion by Chief Justice Norval. , A recognizance for nn appeal In a criminal case Is not required to be signed by the de fendant and his sureties , but If so signed It Is not for that reason alone Invalid. If otherwise properly taken and certified , the signatures of the recognizers may be dis regarded as surplusage. 2. A recognizance executed under section 324 of the criminal code , for the purpose of procuring an appeal by one who has been convicted of a misdemeanor , conditioned that he "shall bo and personally appear at the next term of the district court In and for said Saundcrs county , on the first day of the term thereof , nnd abide the Judg ment of the court , nnd not depart the court without leave , then this recognizance to be void , otherwise to remain In full force nnd ef fect" sufficiently complies with the require ments of the statute and Is a binding ob ligation. 3. Ward vu Urtnson , Error from Frontier county. Petition In error dismissed. Opinion by Chief Justice Norval. STONE OR MACADAM ROADS Farmers of the County Differ as to Material to Bo Used , PROTESTS BEFORE THE COMMISSIONERS Mnttor Will Ho Further Cnnnldcrcd nt Meeting Next Saturday Prisoners Will > u Longer ICroj ) Court Homo Uruuntlii lu Orilor. Tlio county commissioners mot In nd- journcil session ycstcnlny afternoon and ap proved the bonds of the lucky bidder * for tlio paving of tlio countiy ronits. llcforo the bonds were approved , " however , the com missioners \\ero favored with some Ideas upon the question of material to be used In the construction of the thrco roads. "deorgo Hcdinnn and flfty-nlnojithcr prop erty owners from the country In the vicinity of the Military rend petitioned the board to reject the Colorado sandstone and use macadam In Its stead. This was followed by a petition signed by thirty other property owners , all of whom wanted the commis sioners to pave the road with the sandstone. Judge llradley. In behalf of himself and a number of the farmers from the country sur rounding Donson. appeared before the board and urged the commissioners 'to change the material from stone to macadam. Ho urged that If the commissioners would go out among tlio farmers of the northwestern portion of the county they would tlnd that nine out of every ton favored macadam. Tlio stone was good enough as far as It wont , but the appropriation would lay but about two mlles of pavement , whllo It would lay some seven miles of macadam. Mr. Ilroilloy said that ho could not ECO why tlio board would not give the pcoplo the kind of pavo- mcnt for which they had petitioned. Ho said that he agreed with Commissioner Wil liams , who only ono year ago went before the farmers of the county , and at their meetings read a paper advocating macadam as the proper material for use In paving country roads. Since that tlmo , ho said that Mr. Williams had become a strong ad- cata of stone and proposed to glvo the p'o- plo that material , whether they wanted It or not. There was no reason why the farmers should bo punished by having a stone pave ment when they could got ono that they wan toil. If macadam was not a success , the property owners and the farmers along the line of the road wcro willing to take the blame upon themselves and relieve the com missioners of all responsibility. Commissioner Williams said that If maca dam was laid under certain conditions then ho was still an advocate of macadam , but the conditions provided for In the specifica tions wcro far from being such as IIP advo cated In the paper read before the farmers' meetings. 13. L. Snow of Hcnson was before the board representing thirty property owners who pro tested against macadam and petitioned In favor of stono. Ho said mat ho started with his petition only a short tlmo before the convening of the board , and If ho had taken a whoto day he could have secured the signatures of hundreds of farmers who would have asked for stone. In fact , seven teen men out of every twenty , ho said , were against macadam. Robert W. Patrick , representing the In terests of some of the property owners along the line of the Dodge street road , protested against the use of macadam. He said that ho was willing to exchange with the people to the north , giving thorn the macadam and In return ho would take the sandstone. Ho did not think that the mac adam would lost six months , and In the end he was of the opinion that It would prove a miserable failure. Ho thought that It would be Just as well for the commissioners to take the $50,000 and dump It Into the river as to spend It In putting macadam upon the Dodge street road. After the speeches had boon delivered , the petitions nnd iho protests were placed on fllo and the board took up routine busi ness. Curtis C. Turner wrote that he and Quy C. Darton would like to appear before the board at some future date for the purpose of discussing the road question. The clerk was Instructed to Inform the gentlemen that they could bo heard next Saturday after noon. By resolution It was decided that the $150,000 , the proceeds of the Improvement bonds , should bo expended equally on the three roads. The committee on court house and Jail was Instructed to hire a man at $ < 0 per month , whoso duties should bo to keep the court house grounds In condition , thus doing away with the labor of county Jail prisoners , who In the past have performed the yard work under the supervision of the superintendent of the building. A gang of laborers engaged In digging a sewer trench at Twenty-fourth and Luke strets came across a relic of early Omaha yesterday. They had reached a depth of several feet with their excavation when : hey ran against what they took for a largo rock. They dug around It and found It to bo about ten feet long and nearly halt as much In breadth and depth. Further Investigation showed that It was not a single stone , but was composed of a number of largo rocks solidly cemented , together. No ono was able to gurmlso for what purpose the stone had been put there until ono of the old residents happened along and said that there was formerly a spring at the spot whcro the stone was found. When the street was laid out the rocks and cement were laid there to coyer up tlio spring , and In that way the water had been forced to seek some other outlet , livery ono had forgotten that the spring had over existed until the discovery of the rock served 03 a rein In dor of the fact. llnimirkiihlo Guru of HhuuniutUm.
