Some days ngo , when Mr , ICnloy was irolng through the llles of the clerk's oflien , his legal cyo caught sight of un Information , charging ono Jim Davis with the crlmo of burglary , committed nearly two years ago. "Now , " says Mr. ICaloy to himself , " 1 will show my traduccrs that the flics never tarry on mo nnd I will also show them thut hero is a man who has been In the county Jail for moro thann year without having been culled Into court for trial. " Without making an Investigation the county attorney hugged the delusion , to his lircnst and smiled ns ho thought of the sen sation that would develop In the court room when ho presented before Judge Ko.vsor n man who had been deprived of his liberty for months nnd had never been called before a Jury of his peers. Buffering and over patient public. The find- Intr made by Mr. Knley was a state secret , though It was divulged to u few of his inti mate friends. Pocketing the Information , the county at torney pressed the sheriff , the deputies and all of the court bailiffs into the service , send ing them out to summons the witnesses to appear in court and testify to the fuels con cerning the burglary which D.ivis was al leged to have committed. The detectives of the city force were requested to look up what testimony they could and wore assured that Jim Davis was u bad man , one who ought to jo conllned In a place that was more secure than the county Jail. .Those detectives are not all foolsand when thoi'-wcro informed that Jim Davis , the burglar , was to bo tried , they winked at each other , but not a word did they say , though they know that Kaley was about to make a holy show of himself in attempting to try a man who was convicted ana sent to the penitentiary a year and a half ago and who has nearly completed his term of sen tence. They told Kalcy that they would have the testimony , and the play went on until when sonic sympathizing friend told the attorney that ho was on the wrong scent. This was the straw that broke the back of the county attorney , ns It were , and going to the court records for the ilrst time after taking hold of the case , ho found that what , the sympathizing friend had told him was only too true. Then Mr. Kaley culled in the deputies , the detectives and the summons. The officers ho swore to eternal secrecy and the court papers ho burned , scattering the ashes to the four winds of heaven , that they might tell no talcs , but somehow the secret got out und it IB worth a man's life today if ho asks in the presence of Jacob JJ. Kaloy , the question , ' 'When will Davis bo tried ! " Agnlnut Hiimluy Opening. As some of the members of the bar are already aware , Judge Scott is quite nn c thuslast in tbo matter of upholding the dignity of the court , and some rather inter esting situations have been the outgrowth of tills characteristic , but It was not until yesterday that the Judge nnd Clerk of the Court Moores became involved in an open difference of opinion. A case on the docket was not rondy for trial , and the court very promptly continued it , on his own motion , until October 15 , nnd ordered the clerk to make the proper entry. "October IB that Is quite a little time , " remarked the cleric sotto voce , as ho mtis- Inely scratched his "crazy bono" and laughed Inwardly as ho thought of the fun ho was going to havo. "What's that ? " sharply demanded the court , energetically elevating his voice nnd chin , nnd bestowing ou the clerk n look that was not nt nil diluted by being strained through a pair of deeply concaved glasses. " \Vhy-cr-cr , did I understand you to say October 151" ejaculated the clerk In as em W barrassed a manner ns it is possible Cor Mr. Moores to assume on short notice. "Yes , sir , that is precisely what you un derstood mo to say , sir , " replied the court in a December tone , with Icicles hanging from every letter. "Yes , sir , but T-er-I did not know but you had made a mistake , " said the clerk apolo getically. Then the court waxed hot. "It may as well be understood , ho declared , "that this court proposes to have Its orders carried out to the very letter. When I said October 15 I meant October 15 , rind I pro pose to hnvo the entry made accordingly. That order shall bo complied with , and , " ho added warmingly , "let there bo no error made in connection with it. " "Yes , sir. " said the clerk very humbly. "I only thought that inasmuch as thut day comes on Sunday It might not have been the Intent ion of" "What's that ) " demanded the court , "Sunday ! " "Yes , sir , " again said the c'ork ' very meekly , whllo n suppressed sob shook his delicate frumo. "Mako It October 10 , " was the order that then floated down from the bench. A look of intense relief flitted across tha countenance of the clerk , and ho replied , "Tho entry will bo most cheerfully made your honor. Huckleberry Drown , a colored boy , bare footed and as high as the attorneys' table , was arraigned on the charge of helping to burglamo the Altmau storo. With a look of supreme disgust ho listened to the read ing of the Information and was then asked , "Aro you guilty | " The lad acknowledged that ho was In on the division of the spoils , but that ho was not alone when the store was entered. Judge Koysor Is strongly opposed to nny such plan and sayt It should not bo enter tained. Ho contends that if the bench nnd bar has any tlcslro to attend the fair thcro will bo ample tlmo between now nnd Sep tember 10 , the day fixed for the convening of the court. Not only this , but an adjourn ment would bo expensive to the county , as the Jail is full of prisoners and boarding them another month would mean the unnec essary expenditure of a largo sum of money that could bo saved by convening the court on tlmo. Judge Hopowell said that ho should op pose any adjournment of the September term. Ho proposed to take his family and go to the fair , but ho would start next Mon day , stay thrco weeks and bo back in tlmo to take up the trial of nil of the cases on his docket. Ornutrd 1111 Injunction , Judge Walton has passed upon the case of the National Bank of Commerce against the county of Douglas , granting a permanent Injunction , restraining the county treasurer from collecting the tax levied by the county commissioners last July. Ono year .igo when the assessor called at the bank , the olllccrs of the concern listed the stock and other personal property at the sum of flV m , holding to the opinion that the shares of stock should bo assessed against respective stockholders to which It bcloncc'd nnd not against the bank In n lump. Notwithstanding this the commis sioners followed out the old established rule and assessed the stock against Us owners , raising the value to $ S'J,4ftl. The case went Into court , the bank tendering to the treasurer ftKti.DJ , the amount of tax on fi'JM3 ; ; , the valuation returned to the as sessor. Thcro arguments were heard on the application for the permanent Injunction , which was granted yesterday. In passing upon the case Judge Walton hold that the commissioners could not raise the valuation of property unless some freeholder filed a complaint showing that the assessment was too low lower than that of similar property in the immediate neighborhood. Henry Alartln , the young man who was charged with having robbed Hello Brandon , a woman of the town , whllo she was drunk and asleep , of the sum of $ l' > , was found guilty by n Jury In the criminal division of the district court. Dox , nn em- plo.yo of the World-Herald , was held up and robbed of some money , a cold watch and a diamond pin , Knowing that D.ix was a newspaper man , ho had the entire sympathy f the community until yesterday morning , ivhen the alleged robber , Frank Fisher , was brought into the criminal court to plead not guilty to the Information. SInce seeing Fisher , the alleged footpad , the bottom has "alien out of Dox sympathy stock. When the namn "Frank Fisher" was called by the bailiff in Judge Koysor's court the spectators expected to sco a bearded rulltan walk to the front , but instead of such personage putting in an anpcarance a lad : iot over 18 years of ngo faced the music. Ho mis thin , freckled and consumptive looking , mcli an individual as a man with a good , lealthy breath could blow away Of course , everybody docs not know Dox , but these who do know him realize that he is a man in good form nnd carries a list that would fell an ox , and in Ills right mind could not bo terror ized by a mere boy , u boy that ho could slap and put to bed. AViuitH thu Tuxes Canceled , The Crcightou university has brought suit against the county , alleging that during the year 1SS9 the trcasurer old some of the college lands for the tax of 1SS7 and that a deed has been issued on the tax certificate. Now the college asks that the deed bo set aside and the tax canceled on the grounds that the property is and was used exclu sively for educational purposes and is exempt from taxation. _ _ _ South Omnlm htroct Cuno. In the county court the hearing in the con demnation proceedings relative to the open ing and extension of N street in South Omaha has been continued until July 15 , in order to give the property owners and the appraisers an opportunity of getting to gether ou the proposition. Since the death ot her husband she has obtained n.meagcr . support by doing washIng - Ing and renting rooms in her house. Trouble with her boarders , howov.cr , has taken away that sourvo of Incomo. Early In Juno the two children were taken with the measles , and Dr. Totcr , residing at Eleventh and Pacific , was called in to attend them. Ho continued his calls for two weeks , until the children were able to bo up nnd about , notwithstanding that ho had learned that thcro was no prospect of remuneration. Dr. Tctor and Air. Smith of the neighboring drug store together defrayed the expenses for the medicines , as well ns for food In sev eral instances. Then , just ns the children were recovering , the mother bticamo sick , Dr. Totor found that she was suffering from chronic cystotls and unable to glvo such a charity case the attention It requires , ho de termined to report it to the county physician. Ho scut n tolcphono message to Dr. Lanyon's drug store , but was brusquely In formed that the doctor was out. The telephonent the doctor's residence gave a similar reply , but the call was left at both ulaccs. Not until late lu the day did any ono make his appearance at the Weston house , nnd then it was a student acting In the pluco of tha county physician. Ho guvo his name as Dr. Johnson and loft a prescription to bo filled. Airs. Weston says that another pliynlol.in , presumably Dr. Lanyon , made a visit last wcok , but had not reappeared since then. The calls of D.r Johnson , too , were so irregular that she was compelled to send for Dr. Tutor again. Kvldcncu of Neglect. On Saturday last Airs. Weston was in such great agony that she sent at the same tlmo for Dr. Tetcr and for a priest. Dr. Totcr responded and , seeing that she had not ban the amount of attention which her case required , again reported the matter to the county physicl-iu. This time ho c.iught Dr. Lanyon himself at the other end of tbo telephone. "I hear you have been meddling with ono of my cases , " began the county physician. "That is my caso- and I want you to mind your own business. " "No , I won't tell you who has the case in charge. It is none of your d n business anyhow. I can attend to my own cases , and I have forgotten moro about medicine than you over knew. " Dr. Totcr said that Lanyon ought to sco the woman himself , that that was why ho was drawimr a salary from the county , but received in reply only another volley of abuse and an invitation to call at Lanyon's drug Btoro und got a sound thrashing at the doc tor's hands. The next morning , Sunday , Dr , Tetcr was again summoned by Airs. Weston , and found that no ono had attended during the interval. Since the telephonic fracas the visits of Dr. Johnson have been somewhat moro regu lar. For some days bo has been telling Airs. Weston that his chief was coining to make a personal examination of her condition , but his pnvato business has been so exacting that ho has deferred it time and again and it has not yet taken placo. Yesterday Dr. Johnson left two moro prescriptions ono for somo'capsulcs , the other for a stimulant both of which have ben filled by the county pharmacist. Airs. Weston has re quested the attending physician to have her removed to a hospital or to Kivo her someone ono to wnlt upon her , but no attention has boon paid to her wishes. Chttiico for Investigation. An inspection of the register of physicians entitled to practice in this county reveals the name of but ono Dr. Johnson , and ho is at present In Wyoming. The other Johnson is simply a student studying medicine with Dr. Lanyon. Ho claims to bo nothing clso although ho feels no compunction in allow ing the patient to call him ' -doctor. " Dr. Lanyon's version of the case has but few variations from that detailed above. Ho says that Dr. Totor in his impatience ncclcctcd to leave the call the m'st two times that ho telephoned for him , that ho expected him to pay moro attention to the county charges than ho gave to his own private patients. The boy at the drug store who received the message claimed to have been insulted by Dr. Teter. So when Toter sent in his message last Saturday , Dr. Lan yon decided to anticipate any Kicking and made use of the vigorous langu.igo attributed to him. Dr. Lanyon insists that Airs. Weston is receiving all the treatment that her condition requires. "I doubt very much whether she is not playing it upon us , " ho continued. "Sho has been receiving aid from the county right along. She got out of bed the other day to indulge in a squabble with one of her boarders. I do not think that she is sick nt all , " and the doctor gave emphasis to his as sertion by applying several ungentle-manly epithets to iho woman. Others differ with him and say It is u deserving caso. Condition of the I'ntlont , Airs. Weston , lying in bed , certainly gives no very great encouragement to the con tention that she is feigning illness. She had mentioned her trouble with her roomers and had said that she had so far lost her temper that in splto of her weak condition she had risen from her bed. Thu effort was , however , too much for her and she could scarcely rnovo for some tlmo afterward. As to sending his student , Johnson , to attend upon Airs. Weston , Dr. Lanyon main tains that ho was not acting improperly. Ho allows Johnson to act for him under ills direc tions in many simple cases. Ho oven per mits him to write prescriptions , signing them with his , Lanyon'u. name. In this ho has'made no discrimination between private and county patients. Balloon ascension tonight , 8 o'clock.
