8 THE OMAHA DAILY BEE : i THURSDAY , JUNE 20 , 1803. WAS NOT GUILTY AS CHARGED Botert Parka and Irtoncls Have Occasion to Ecjoicc , JURORS MAKE A VERDICT OF THEIR OWN Finding In n Sotilh Omilm HhontlitB Cn o Followed by n Suit lor DBIMHKCI JSml at tha I'ark-.IncUinnn C'nio Xot Vet Itcnclicil. The vcnllct of the jury In the criminal court , In the case of the state against Hobcrt Parks , charged with shooting with Intent to kill anil murder , has convinced Parks that ho was not horn to dto at the end of a rope , ns twelve men found him guilty of simply assault and battery and that the authorities erred when they charged him with the com mission of n more heinous crime. A few months ago Parks , who Is a n plumber , was In the I oo hotel and went Into the drinking annex of the hostelry. While thcro Khody Hcdman and John Jackman entered Into n discussion with Parks upon the subject of what the American Protective associations had been doing nnd what they could do If they felt disposed to draw the lines down real lino. Hot words followed nnd some blows were struck , and Parks drew a revolver. Some person struck the gun nnd knocked it In line with Jackman just In , time to send the ball crashing through his shoulder. Jnckmun has commenced a civil suit against Parks , In which ho demands a judgment for the sum of $10.000 for personal injuries re sulting from the shooting. ( IruiitPil nn Injunction. Judge Walton passed upon the case of the National Bank of Commerce against the county of Douglas yesterday afternoon , granting a permanent Injunction , restraining the county treasurer from collecting the tax levied by the county commissioners last July. July.Ono Ono year ago when the assessor called at the bank , the oftlccrs of the concern listed the stock and other personal property at the sum of $3 < > , iU3 , holding to the opinion that the shares of stock should ho assessed against respective stockholders to which it belonged and not against the bank In a lump. Notwithstanding this tlio commis sioners followed out the old established rule and assessed the stock against its owners , raising tlio value to fSU.-IGt. The case went into court , the bank tendering to the treasurer ? 'J02.02 ' , the amount of tax on $39,843 , the valuation returned to the as sessor. ' Thcro arguments were heard on the application for the permanent Injunction , whioh was granted yesterday. In passing upon the case Judge AVnlton hold that the commissioners could not ralso tlio valuation of property unless some freeholder Hied n complaint showing that the assessment was too low lower than that of similar property in the immediate neighborhood. Henry Martin , the young man who was charged with having robbed Hello Brandon a woman of the town , wiiilo she was drunli and asleep , of the sum of $ l'i > , was found gulltv by a jury in the criminal division of tno district court. Verdict lor Mmlli Onmliii. In Judge Ogden's court City Attorney Van Duson and the municipal government of South Omaha had great luck yesterday cleaning uo an oven $ J,500 , and going away happy. A year or so ago , when the F street bridge collapsed , James Hagcrman and James Powell - ell were caught in the wreck , each sustain ing injuries of ti somewhat serious nature nnd consisting of cuts and bruises. They imagined that the city was responsible for the defective condition of the urldijo nnd brought suits for 87,000 each. At the last term of the district court the llacorinun case was tried , the Jury returning a ver dict In favor of theclty. This term Powell's case was called and after u lengthy trial the jury found for the plaintiff , fixing the sum of $5.000 us the amount which ho was en titled to recover. City Attorney VanDuson hold that the amount was excessive nnd BO argued before the judge , who re duced itho verdict by cutting it in two in the middle. The city will appeal to the supreme premo court , urging that as there had never been any notice served , slio\ying Unit the condition of the brldgo was unsafe , the city was not responsible for injuries that oc curred by its collapse. May Do lUutliid In 1IU .MmlnrHi. Ansil Dickinson , a young man from Valley , ' was caught in the act of breaking open a car that was standing on ono of the side tracks at Valley. Ho was held to the dis trict court , but , being unable to give bail , he went to ] : iil , where ho has since re mained. Yesterday morning Ansll com menced to exhibit some rather peculiar symptoms , such as running about his cell and working his nrms witli a motion similar to that of the piston rods of nn engine. Tir ing of this lie would suddenly stop and In a loud voice exclaim : "Omaha ; change cxira for the asylum switch. Passengers for the penitentiary will keep their scats. " The authorities think that ho Is sham ming and that ho Is working his cards to keep out of orison , hut In order to glvo him a chance the case will bo Investigated by the insanity board. Kxnmlnor Cirllllth Snya Amorloin Niittonnl Depositors Will net Tholr Money. National Bank Examiner Grifllth stated yesterday afternoon that it was almost cer tain that the depositors nnd creditors of the American National bank would ho paid in lull , and that with anything llko a normal condition of the money market there would bb uo question as to the bunk being nblo to resume business. The comptroller of the currency has submitted a statement as to his position in the matter and Instructing the examiner as to the course to bo pursued. The stockholders of the institution are very desirous of resuming business , and it is simply a question of' the success that they will have in raising money in the cast. The present stringent financial situation makes this much more dinicuU than would bo the case under ordinary circumstances , but strenuous efforts are being made , with a possibility of ultimate success. The absence of fraud or the suspicion of any wrongdoing has strongly prepossessed the authorities In favor ot the hank , and all possible assistance and encournpo'.ncnt is being offered. The same feeling and dispo sition is manifested by the parties owing the bunk , who are voluntarily doing all they can to square up their accounts , whether in the iiuturo of overdrafts or loans , in the hope of assisting the stockholders to regain their feet and enable the bank to resume business. So hopeful Is the situation , that the examiner has not yet applied for a re ceiver , and will not unless it is apparent that such a course will bo inevitable. If it it found to bo impossible to resume business , the bunk will undoubtedly bo allowed to go into voluntary liquidation , in the absence of anything like criminal intent or action. Mimy Improvomcntii Contomptntcd , Among Them nil Are I.lKlit SjHtom Colonel Slmrp has selected a location nt Courtland beach for Ms now boat houso. The demand for bathing1 suits , ninonfr the Omaha stores , has rapidly increased since the opening of Courtland beach. The carrousnl at Courtland beach is being rapidly pushed to completion ; it Is located just south of the switchback. The now electric lights at the beach when in position will light up a fine ramble for these desirous of a strol ! within the enclosure. A number of Hhell boats and outrig gers are to bo brought over from Man n\\aby the owners and placed in the new bout house at Courtland beach. Arc lights are to bo distributee throughout the grounds at Courtlam Dcach as soon as poles can bo erected the lamps being already on the ground Many pretty bathing suits will sooi bo seen at the beach. The ladies are quietly at work putting on the finishing touches previous to taking their lira plunge. A very pretty and comfortable bath ing suit shown is of light weight Jersey cloth , in two pieces , for both ladies and men. Ladies can detach the skirt when they wish to swim. The favorite drive seems to bo north on the unpaved streets to Manderson street , thence east to Sherman avenue and north under the railroad bridge a block or two and over the now bridge in order to reach Courtland beach. In fact , it's the best road. The improvements contemplated by Manager Grilllth and the Courtland Beach association are many , but they all require time. It should bo remembered that this is an enterprise onlv a week old and that the management of necessi ty must move slowly at first. Several parties have requested per mission from Manager Grifliths to camp on the grounds of the Courtland Bench association. To ull requests ho replies : "If you are the right kind of people we'd bo glad to have you , but if you're not wo wouldn't have it for a thousand dollars iv day. " In all probability the present carriage entrance to Courtland beach will bo closed in n few days and n new oho 'pcnod ' tit the west end of the enclosure. This is a move that will bo appreciated jy the public , as it will do away with the necessity of driving through the sandy road. Teams can then drive over the bridge and the entrance will bo only a few rods nway. Per World' * Fnlr'VUltar * . Low rates ! Past time I Perfect road bedl Magnificent Pullman sleepers !
