Toi.nno , O. , March 1" . [ Special TclcRrnm
to Tin : lini : ] The Ann Arbor strike Is now
In worse shape than it has been at any time
since the trouble commenced. Commencing
this morning the1 engineers on all thu Toledo
roads and nil others making connections with
the Ann Arbor will refuse to huiullo freight
offered to that road. This Is by order of
CliieT Ai'thur , who stated that such was his
decision. He said ho tavo it for publication.
When uslccd what hu would do about thu
circuit court order that the men must not re-
ftiso to touch the freight , ho replied it was
ono of tlio questions yet to bu decided. Ho
said the immcdi.itc reason for the order was
because the Aim Arbor would riot take back
the men who left , the company's employ. Mr.
Arthur chnrcesStutoUuilroad C'onmiisiioner
Kirkh.v. who has been the peacemaker for
throe days buck , with betri.vitir ; ( the cause of
the men. Ho says a clause In the terms as
agreed upon was that all the old employes
bhoiild be given their former positions with
out projmlice. Mr. Arthur says this clause
was not presented to the company at all ,
which mndo u provision that all applica
tions must bo made in writini ; to thu master
mechanic of the road , who must recommend
tin1 men before they would bo re-employed.
This'is cnolvnluiit to saying none of them
could coino back. The Ann Arlior had con
ceded all that the men asked in the way of
wages , hours , etc. . after a long hitch about
the wage part of it.
Governor Ashley says that freight will
be offered today as usual. This may precipi
tate the general strike that has so long been
feared. There is much worry among all
railroad men here , who * had hoped Mr.
Kirkhy could disentangle the late itilllcult.y.
The Lake Shoru is having circular letters
printed which will bu presented to all engi
neers and firemen , containing a copy of the
statute to obey the interstate law about re-
fusintr freight and warning them of their
liability if they refuse.

"The Old Homestead , " -which comes to

so true to country life that even thu looKor-

enjoy the .spectacle , but to him who has been
an actual part and -parcel of the scenes so
truthfully ili-iiicted it is a theatrical treat
that gives the keenest pleasure. The sale
of seats opens at 9 o'clock this morning.
"The Danger Signal , " next week's attrac

scenes and stirring climaxes , made doubly
uffcetlvo by the realistic c.Tccts introduced ,
a monster locomotive of iron and steel , and
from which real steam issues , a ej clone
rotary snow plow , a freight train , and the
cannon ball express , consisting of a loco
motive , tender , three coaches ISO feet long ,

Unu. ] 'Hio recent llsticuffs between County
Coiuiuissloner McOrnw and ex-Commissioner
Shaberg iiromiscs to bo fought to a llnlsh in
the courts. There has been b.iil blood be
tween the commissioners for sonio time , oven
while Shaberg was in ofllce , and the personal
encounter lias simply f.uinc.l the llamc ' 1'ivo
years ago last fall the law Itn'roasing the
number of commissioners for Lancaster
county from throu to live , and the salary
from f.1 a day ami mllo.ige toI.S'.K ' ) a year ,
went into effect and three eommtssloiiera
were elected.
It was understood at the llino that the
commissioner receiving tlio smallest number
of votes was tu sarvo bat two yo.xrs , while
the other two were to hold ofllce for three
.years. On the .January follnwlnir the < i"es-
lion uf salary came up , but Kliuberg put In
a claim for but $70.S"i , the amount due under
the old law. llrawn , Iho other hold-over ,
put in his claim for $ lf > 0 , and both were
allowed. This brought up the matter before
the board , and the county attorney was
called upon for an opinion , which he rendered
to the effect that Shaberg and llrmvn nvro
entitled to drew fl.10 a month. The legisla
ture in IS'.ll ' passed a law repealing1 the ono
giving Lancaster live commissioners , and re
duced it to thu old number. That fall .1. 11.
Wescott was elected commissioner , but ho
had to apply for a writ of cjuo warrant * ) to
get hold of his ofllce , but the supreme court
llinilly rendered an opinion that he was en
titled to it.
At the election lu 18PO McOraw received
the smallest number of votes , ami it was
supposed that ho would step down and out
last , January. Ho refused to do so , however ,
claiming that in the various cnactmuits
atTccting the i-ommissloiiprshlp that clau-u
setting lorth that the commissioner Polling
the lowest vote should hold for but two
years had been repealed. The county at
torney began procivdings In supreme court
ostensibly to settle the matter , but It was
suddenly dropped for some reason , and Mc
Oraw drew tha salary for January. When
he came up for his February wi'i-rant , however -
over , ho found that one of Hli'iborg's friends
had appealed from tlio allowance of thu
claim and intended to reopen the supreme
court proceedings. Shaberj ; stated that lie
believed it was simply a dummy suit , and as
the supreme court had not passed oa the
vital point involved whether or not McfJraw
was entitled to hold for another year ho
proposed testing it.
This aroused McCJraw's ire anil he intro
duced the resolution , printed in Tin : llui : on
Wednesday , instructing the county attorney
to begin suit against Sh.iberg to recover
the difl'oreiicebetween the $ lsi)0'n ) yr.ir
salary he drew and thu amount Mcliraw
claims lie was entitled to under the old law.
The Insinuations rellccting on Shnherg's
honesty aroused his anger in turn , and the
pugilistic encounter followed. The point in
Shaberg's case was passed upon in the .su
premo court in the case brought by Commis
sioner Timmo from Omaha , hist year. lie
