Toboy. a former Blunite , shot hinv self through the temple last Monday night at a boarding house iu Milwaukee. The first that anyone in this city know of it was when a telegram came to his sister , Mrs. George S. Miller , who lives at < W3 Willow avenue. Toboy was hero aluut two weeks ago , and , after visiting his sister and a younger brother , left for Milwaukee. According to the information that has been received hero it seems that Tobey had been drinking heavily. He took the Kcoly euro at Blair about a year ago and later at Dwlght. III. So far as known ho did not in- ilulm ) his taste for intoxicants at all after tnat , and when it was learned that ho had been arrested in Milwaukee and lined for drunkenness it was a great surprise and shock to his friends hero. Ho raised money enough to pay his line by pawning a line diamond mend ring for $12. With what was left ho bought a revolver and a' box of cartridges. Going to his room ho locke.l himself In. A few minutes later a pistol shot was heard , and on bitaking the door onen Toboy was found lying across the bed with a bullet hole through his tcinplo. A note was found lying on the table from which it was learned that Mrs. Miller of this city Was his sister. As soon as Mrs. Miller received word of the sad event she wired her husband , who was _ in Minnesota , to go and look after the remains , which will he taken east for burial. The dead man was engaged at one time In the manufacture of patent sidewalk stone blocks in this city , and later on worked with ox-City Engineer Tostovhi. Ho also formerly resided In Nebraska City. A question has been raised as to an item of business which was transacted by the city council at Its meeting Tuesday evening which maybe of interest to the city from a legal standpoint. AH ordinance which has been hanging 11 ro for several weeks was passed , vacating the east end of Fourteenth avenue adjoining Deere , Wells & Co.'s imple ment house on Main street. Riddle's sub division , in which the street is located , was platted twenty years or moro ago , and. as is usual in such cases , streets were dedicated to the public. The question now raised is whether the city had any right to give up the street to a , private individual , or rather whether It had any title to the property to transfer to any one else. It is claimed that the city had merely the right to use the streets , and there its rights end. If this view of the case bo the correct one the prop erty owners in that part of the city , If there are any whoso rights arc seriously affected by the action of the council , or the original owners of the street in question , are likeli to raise a fuss. Streets have been vaeatct in this way before , but it has invariably been understood that after the city had re linquished its right the title reverted back to the person by whom the addition was platted. Some criticism is also made on the action of the council in giving up so valuable a piece of property for so small a price. The city let go of the property upon condition that the linn of Deere , Wells & Co. , would pave the intersections of the street at its own expense. This will cost not to exceed $100 , and that consequently represents the price paid the city. A piece of the same slzo on the opposite side of the street , it is estimated by well known and responsible real estate men , is worth not less than JT.iiOO. If the city had the right to sell the property at all , the other real estate men think they ought to have been given a chance to hid on it , as the city would cer tainly have been enabled in this way to ro- allzo a great deal moro from the sale. Shaw , a wealthy rancher of Grant county , was re cently found dead In the stall of a stallion in his barn , and on the testimony of a hired man named Gallln and Mrs. Shaw a ver dict of accidental death was re turned. Gallin at oneo took Shaw's place at his bed and board , which fed to sus picions and a search of the barn revealed , from blood stains , that Shaw had been killed in the barn away from the stallion's stall. There was only one important change suggested yester day , regarding the distance limit beyond tvhich a horse is declared out of the race. Where formerly the distance was 100 yards in races where less than ten horses started and 150 yards for a larger field than ten. It was agreed to make tlio distance fifty yards for races in which not moro than eight horses start nnd sovcnty-five yards for a larger field than eicht. This morning the committee mot and con tinued the dissection ot the two codes. President Johnson offered tlio suggestion that license to drivers shall be granted and that drivers must have ono If they drive in a race. Another important suggestion was that races consist of the best two in three heats instead of the best three in five heats. After these suggestions hud been discussed and agreed upon , the question of helping each other in the matter of enforcing sus pensions for nonpayment of entries and other moneys came up. It was argued that should .each . association enforce suspension , regard less of the association to which the debtor belonged , much trouble would bo escaped.
