CHANGED HER MIND BEFORE THE TRIAL iffow Her Allornrjr In Hiilnff Mr. l.owo for tlio I'co Ilo Kiprclrd to ( let front the Divorced Wlfn l.owo Never Kiiiplojod Him , With Judge Ogilen the case of John C. Yclscr against Hugh Lowe Is the principal attraction and the drawing card , as It Is being fought for all that there Is In It as well as to a finish. Thcro Is a long story connected with the case ami Judge Osborno of Ulalr represents the Lowe Interests , seeing that they are properly protected and watching Yelsor to prevent him from stealing a march in his efforts to steal a $500 Judgment. Some thirty years niro Lowe and his wife , Eliza , lauo , were wedded and In after years they inovo'l to Nebr.isca. ! settling In the vicinity of Illalr , where by practicing econ omy and bv tickling the fcrtflo soil thev ac cumulated a fortune that has been estimated nt $50.000. In the duo course of time a fam ily of bright boys and good looking girls grow up to cheer the old man and his wife In their declining ycais. Time continued to pass along as it has boon in the habit of doing , and as It passed a skeleton entered the closet. There was a rupture in the pleasant relations and the breach widened , until a couple of years ngo when Mrs. Lowe concluded that she was willing to try single blessedness once more. While slio was in this frame of mind , she employed Yelser to help her sever the matrimonial menial tics that had hold in place for tnoro than thirty years. She charged that Hugn , that husband of bora , was cruel and exact- lug , that ho was not a good provider anil that at times he had used force and arms to compel her to attend to the affairs about the house. The case w.as ready for trial when friends Interfered and healed the sores to such an extent that peace was tcstorcd in the homo of the I./MVGS. The case went out of the courts and Yeiser was loft to hold the sack. Ho was mad. and , of course , bo wont into tlio courts , where ho sued for $ .VJO , alleging , that his services had been worth that amount of money. Tlio suit was brought ngalnst Lowe , who now , through hi. , attor ney , claims that ho never employed John O. Yelscr to transact any legal business in his behalf. Suing Ills Landlady. In the district court Edward Lambert has Bund Mary I'elrsou in an action to recover the sum of & 00. As a starter he alleges that ho has a wife on his hands and that slio Is in poor he.ilth , in fact she is an Invalid , so ho avers. Along In the fall of Ib'.CJ ho routed rooms of Mary I'cirson at U101 Douglas street , agreeing to pay a rental of $ i > per month and an additional $ -10 per month when ho and his wife took their meals at the I'cirson table. Finally there was a row in the boarding house and the upshot of the whole matter was that the Lamberts went elsewhere. At this time Lambert alleges that the I'clrsons broke their end of the contract and that ho Is entitled to recover the sum of SiOO and all of the attending costs of the suit. Settled Out ofCoiirt , The suit of Antonio Aldl , brought by the administrator , and against the Hock Island road , has been settled by the heirs accept ing ? ll.r > in full of all demands. Something llko two years ago Aid ! was In the employ of the company on ono of the mountain divisions pumping a hanii car and working on the section. Ono day , whllo to employed , a fast train caught both Antonio and the hand car. The machine was smashed into smithereens nnd Antonio was trans ported to the hereafter. The heirs brought suit , alleging that by the taking on * of the mini they had suffered damages in the sum of r.r , ( MKi. On that issue the case went into , thn courts , and there remained until the set tlement was reached. Siilni ; Ibii City. The labored nttolnpt of the World-Herald to make it appear that the Eirst Congrega ' " tional church of Omaha Is about to go into bankruptcy and the sneering sarcasm flung at Dr. Duryca in the alleged "startling news" has created a great deal of indigna tion among members of that church. Speak ing of the absurdity of the article and the numerous lllppant slings and slurs it con- contained , a nromincnt member of the church said : "Thcro is nothing new in the fact that the First Congregational church is in debt. Where Is thcro a church in Omaha that t.is nott The Idea of the isi church being in or an : ticipating a state of bankruptcy in the rankest sort nf nonsense , nnd It is unjust to the people connected with that organization to hold them up in any such light as that. Dr. Duryca stood the Insolence as long us ho thought it proper and then firmly informed Mr. Hitchcock that ho had better attend to his own business. Mr. Hitchcock quit attending church at the First Congre gational , and over since that event the World-Herald , has been seeking opportuni ties to counteract the effects of Ur. IS BELIEVED TO CONTAIN MANY CHARGES District Attorney linker Hnyn It Will Not lie OJIPII to Tulillo Impootlon Until .Mother U Apprehended Under It. Some very mysterious sidelights nro being turned on In the Moshur case Just now. An O nuh a attorney , who returned from Lincoln yesterday , says that Mr. L. C. Hurr of the Capital City Is red hot over the refusal of the ofllciuls of the United States court to lot him have a copy of the indictment ag.ilust Mr. Mosher. Ho had sent to Omaha for it and by tlio order of the United Slates district attorney the request had been refused. When questioned about the matter yesterday Attorney linker said : "Tho Indictment upon whlen Mr. Mosher was apprehended Is a matter of record and is open to anybody who may desli-o to sco it. Hut those who want to see the other Indictment , If there Is another one , and I guess thcro Is or the newspapers would not have s.ild so , will have to ire to the court to got It. 1 liavo no right to let them sco it , and 1 should advise the clerk not to show it or furnish a copy ol It. Mr. Mosher has not been apprehended upon that Indict ment yet , and it Is not proper that everybody should have access to it. " It is understood that the indictment which is being withheld from the Lincoln attorney charges Mosher with almost all the crimes that a defaulter and embezzler could com mit , whllo the ono upon which ho was appro- bended only charges him with falsifying the records of the bank and issuing fraudulent certificates of deposit. It is a rather mys terious byplay all around , and Mr. llurr will probably have to appeal to Judge Dundy be fore ho can get a copy ot llio Indictment lie Wants , and he may not get it even then. UNSUCCKSSKUr. SCHKMi : . Why Uin.ihn Jobber * Did Js'iit , Ship Goods Ordered. What was apparently intended as a neat little swindle upon a number of the whole sale merchants of this city was attempted a few days ago by a man in Nebraska City , who gave his name as J. W. Catcrn. Had the scheme worked , the dealers might have suffered a loss of nc.irly S-OJ , but as it is they are now laughing in their sleeves over Mr. Catern's dismal failure. It seems that Catcm recently arrived in Nebraska City , from Galena , 111. Ho imme diately had some tasty billheads printed , which reptcsentcd him as doing a cigar , confectionery and news business at 006 Cen tral avenue. On March 1 ho sat down and ; \roto out orders on nine merchants of Omaha for goods in amounts ranging from $10 to $40. These ho placed in the mail and awaited results. On receiving these orders the Omaha dealers consulted the commercial agencies for Information as to Cittern's financial standing. They could give no Information ami on sending to their Nebraska City corre spondents got no satisfaction. Thursday came news that no preparation ? had been made to fit up 000 for business , and it was rumored that Catern had loft the city. The following is a list of the persons who received orders : D. Wood , the traveling man who was arrested . by Onlccr O'Gormun the other day for peddling without a license , threatens to make it warm for that officer for his tem porary loss of liberty. Mr. Wood says that ho I was taken to the police station at .1 o'clock in i the afternoon and although ho had plenty of money on Ills person nnd offered to put up a ; : cash bond for Ills appearance ho was kept thcro tt until (5 ( o'clock , when , through the in tr tercession of a friend , ho was allowed to call a messenger boy and send to Judge Bcrka , who fixed a bond , which ho furnished and was released. He claims that the police even refused to allow him to telephone to any of the Jobbing houses , or his hotel , where ho 1I had 1 friends who could have effected his re lease. I The case against him has been dropped and ho now proposes to bring suit against Officer O'Gorman for false Imprison meat. ArrcKtcd on ( loiiuriil I'rlnrlplee. Detectives Savage and Detnpscy arrested a smooth crook yesterday who gave the name of George Smith. The oflicers claim that their man Is a member of a ganir of thieves at ] present working both Omaha and Council Bluffs and with headquarters in the latter city. Smith Is not charged with any especial offcnso , but is considered good people to keep locked up. When taken before the police Judge Smith was given fifteen days at labor in the Jail. Ho begged to bo allowed to work with the street gang , but as ho is something of a sprinter his request was re fused. Piles of people have piles , but Do Witt's Witch Hazel Salvo will euro them. SVE.VUS y.v 'VH.IXQE. May Wheat Olves Cliloiiffo IlroKcrs Somo- tliliiK to Think About. CHICAGO. 111. , March 10. There was a wild scene on the Board of Trade today. In twenty minutes May wheat bulged nearly Si cents u bushel. Shorts became panio stricken and fell over each other in their anxiety to cover , traders yelled themselves hoarse and for a time the tumult double-dis counted anything seen in Chicago In a good whllo. It was emphasized by the fact that while May wheat was kiting into the blue cinpyrian , July presented the phenomena of dropping at an alarming rate. The extraordinary separation in prices has removed any doubt but that a great corner has been run in May. May closed last nigh iitTG'centsnml July at 74 cents , the lowest price for the week , nnd when trading begat : this morning sales were made at 75 cents to 70 cents for May , and July remained it Not Always the Fflour. Naturally the price began to climb , ami local shorts eauio to cover with such a rush that In four or tlvu minutes It seemed as If nheol hail brolccn nway from Its fastenings. Then the rotrogriulo movement In July began , which added to the din , and It was noticed that many of the buyers of May par- tlelpatuil In the heavy selling ot later ou- tlons. The market was like a powdrrmhic , which only needed a match to touch It off , and the lire was supplied by the representatives of the northwestern milling interests. After the big bulge a general decline , took place , until at noon May sold at 77 cents aiid July at : i' < cents , but tlio market was nervous ami In a state of suppressed excitement until tliocloso , guesses as to the government fig ures on reserve wheat varying all the way from M.OOO.OOO to HO.000,000 bushels. Kgglcstou , the cash wheat magnate , Is quoted as having declared that the market today was demoratizo.l as a result of the re port of a corner In May by James H. Ivceiio. In which the latter hopes to recoup himself for tlio skinning ho received at the hit nils of Chicago speculators fourteen years ago , when ho left about * 0,000UJO here as a souve nir of his experience with the Hoard of Trade. Mr. Kggleston claims that this morning's action was caused bv orders to llvo leading llrnis from Dulutli p.irties to buy 1XX,000 ( ) bushels of May ami sell a llko amount of July to cover a big str.ululu made lu this market sonic time ago. But there are other operators who laugh ut this ami say that Mr. Kecne Is selling July with the same rapidity and that he is taking on his load of May so as to have a dumping ground ready when the short ? have tripped up to tlio counter anil settled with their cashier. A dispatch from Mew York saying that ICecne states ho has no Interest , directly or jointly. In produce , was taken with consider able doubt. It was remembered that Har per flatly denied that ho was doing a thing in wheat until he was under indictment , and "Old Hutch , " always disclaimed any inten tion to corner. It is Just fourteen years ago today that Kceno's famous message to Archie- Fisher was received. Instructing him to purchase 2,000,000 bushels of wheat. Thcro was a mistake made somewhere and instead of bin ing , Fisher sold the L'OOO.OCO. This broke the market and May declined from Ul to 87cents. It was the climax of the great transaction and Kecno has been care- lully nursing his wrath. Baby Cured Scall Head Mad Case. Two Doctors No Good. Tries Ctiticura. First Set Helps.
