The court will overrule the demurrer , and the

nnd some twenty others , stockholders in the

pany. The petition sots up that tlio defend
ant company purchased some Sia.OOO worth
of cnlllpmcnt from the plaintltrs , but didn't
pay in full , and Judgments nro now standing
in the I'lattsmoulh courts for $8 , MO. They
set up that the company was and Is now in
solvent , but that there Is a largo amount
duo on assessments on the capital stock
from Mercer and others , nnd that the de
fendants , having failed to publish the arti
cles of incorporation ns required by law , are
individually liable for the debts.
The troubles of the Lincoln Normal uni
versity are ended , R P. Koose , who made
sensational charges of having been frozen
out , uy the moneyed backers of the Institu-
tlon . K. It. Sizer nnd J. II. McClay , appear
ing in court today and dismissing his appli
cation for a receivership nt his own costs.
The matter was amicably arranged , and
Slzcr and McClay will conduct the uni
versity hereafter.

Kd Pcrri a landscape gardener , was ar
rested by Detective Pound this morning on
the charge of burglary. The hide house of
Harpham & Dobson on Ninth and Ii streets
was entered some tlmo Wednesday night
and a hide taken. The thief sold it to Chip-
man & Sheen , butchers , who in turn disposed
of It to Harpham & Dobson , the original
owners. After they had bought and paid
for the hide , they discovered it was the
stolen ono , and investigation by the police
resulted in Perrin's arrest.
James Smith , colored , was arrested on the
charge of stealing a pair of pants from a
clothing store dummy.

County Attorney Woodward this morning
appointed F. Wi Collins
as his deputy nt a
salary of $1,500 a year. The law creating
the ofllco was passed by the legislature yes
terday and signed by the governor last ovou-
ing. Collins was ono of Woodward's oppo
nents for the nomination , but withdrew be
fore the convention.
Receiver Maefarland today removed the
effects of the Capital National bank to the
room at Eleventh and N streets , formerly
occupied by the American Kxehango bank.
The high rent demanded at the old stand
was the cause of the removal.
The Jury in the casoof James A. Dalley
against the Lincoln Street Railway company
returned a verdict today giving the plaintiff
$ i")0 for the injuries ho received in a run
away accident caused by a steam motor on
the defendant's West Lincoln line. Ho
asked for $10,000.
Tlio city council was to have held a moot
ing tonight , but owing to the fact that the
Board of Public Works had not prepared its
recommendations ns to the viaduct contract
it was postponed until Tuesday evening.
Water Commissioner 1'erelval has prepared
his semi-annual report to the city council ,
which shows receipts of &Jl,73l.0.'i ) and ex
penditures , for extension and reconstruction ,
Interest on bonds , new pumping station , sup
plies , etc. , of S2-I.1C0.40. The total amount
of water available every twenty-four hours
is 3 , 00,000 gallons. The total cost of the
system has been f 189,000 , of which $187,000
in bonds and interest is outstanding.

Leavenworth streets in Omaha and in com

boys had walked all the way from Omaha
and were tired out when they were taken in
by Landlord Sellomiro , who rccognizeu the
Vandorn boy , and told thorn that they must
stay with him. They started on a run for
the timber , but were overtaken after a half
a mile ehaso and will bo returned homo to
morrow. The boys were armed with an old
army sword and said they were going to

Allen with perjury. The document states
wherein she swore falsely when slio was
before the police court as a witness in the
case of tlio state against Dick Ilerlln and
Charles Hayes , the two Soutli Omaha men
who wore arrested omtho charge of having
murdered Mayor Miller. Attached to the
information are the names of twenty-two
parties who will bo called as witnesses
against the Allen woman. The name of Mrs.
Miller docs not appear upon the information.

taken the task of unraveling the diniculties
that oxlst between William A. Paxtou nnd
Julius S. Cooloy. Paxton Is trying to collect
a rent bill which has been duo for two or
three years. When tlio debt was incurred
Cooley < was a tenant of tlio Paxton block , but
or account of having failed to pay ho waa
put ' into the street. Now ho claims that It
was a case of forcible ejection and that his
property was damaged oy being treated lu
such a manner.

W. Phelps against tlio Homo FJro Insurance
company is on trial. The plaintiff is seeking

dence at 2018 Miami street , which was In

18S9 , the building burned , and now the com
pany refuses to pay the loss. The reason for
the refusal , so the defendant , alleges , is that
at the time of the lire the building was va
cant and unoccupied.
