Corn opened with thu trade apparently

terday. The cash market was not especially
promising , with export orders to liny usually

Property owners and residents along the
banks of Mud creek , which winds its tortu
ous course through the southern part of the
ulty and Albright , declare they will continue
to stir up the stink until they get relief.
Mud creek is the small stream which drains
the country from the poor farm south , run
ning just west of the Union Pacifictracks. .
All the country about the old Shccly station
with its now dense population and all the
northern part o South Omaha is drained by
the little stream , which adds to its waters
the drainage from the stock yards and the
sloping banks of the city proper further
down. The creek carries no sewage , but is
the natural outlet for all surface water , and
the amount of fllth carried down by the
water is immense.
The only remedy is the building of a sewer
to connect with the large tunnel through the
hills , and that means an extension of the
eight-foot brick sewer and an outlay of at
least $100,000. At present the tunnel through
the hill carries only a two-foot pipe , which
is already taxed to its full capacity , but it is
understood that the city nnd stock yards
will at any time join in laying n second pipe.
The rub will bo the paying for an extension
of the largo brick sewer. It is by no means
certain that ttto stock yards company will
agree to bsar half the expense , should the
work be undertaken , anil oven If it ill , the
half of $109,000 is ti big sum for the city to
appropriate nt this time for n single purpose.
All the same.it is only a question of a short
time when the sewer must bo built or prop
erty along the stream will bo depreciated.

The deeislon of the supreme court in the
school board mandamus ease settles the
question ns to which is the tax levying body ,
the city council or the Hoard of County Com
missioners in cities having o\er 8tKH ) nnd
less than ! i" > ,000 inhabitants. Such n pro
nounced nnd general difference of opinion
prevailed In this city last spring as to cause
legal proceedings ns the only way to settle
the matter.
The city council , though never asked di
rectly to make the levy , let it bo known
that it would not do so. Then the county
commissioners were appealed to , nnd they
refused on the gronmt that it was the duty
of the city council. Their refusal was
backed by n few citizens of the city who
were opposed to a levy for school taxes from
any source , and the business was purposelv
delayed until after the date prescribed by
law , when it was supposed nothing moro
would bo done.
The attorney for the school board took the
ground that , us the demand hail been made
within the titno prescribed , tiny subsequent
proceedings would relate back to theoriginal
action , and ho began mandamus proceedings
against the county commissioners to compel
thorn to make the levy.
The cnso came before Judge Irvine and
was decided against the school board. At
torney Farnsworth at once carried it up to
the supreme court , had it advanced on the
dooket and yesterday received a postal card
informing him thnt the decision of the lower
court had been reversed.
The school board asked nlso for a ruling ns
to whether the tax levying body has discre
tion as to the amount of the levy or whether
the estimate of the school board shall bo

When the text of the decision shall have
been received it will probably also settle the
question as to whether or not it is necessary
to take the census before enforcing the
$1,000 license law in this city.

victory , and can now go ahead with its
plans for the future without fear of tin
