Countj' Commissioner Williams scored the first and an exceedingly important point i yesterday in the effort being made to oust him by William Olmstead , Judge Ellcr yes terday decided that unlcso the contestant could show fraud by competent witnesses he would refuse to order a recount of the ballots. On Wednesday Olmstead alleged there bad been fraud , misconduct and partialltj upon the part of the otllccrs of election it Valley , Elkhorn and East Omaha products and that votes cast for him v.-cro counted foi Williams , and that a recount was necessary Ho offered no testimony upon the point am : the court took the matter under considera tion , yesterday handing down the dccislot above. Judge Ellcr said that ho had made i careful study of all the authorities treatinf upon the subject and that the ballots couli not bo introduced until the oral tcstinion ; I was in. If at that timolt was apparent thu there had been fraud perpetrated the ballot : could bo considered , but it was not the in tcntion of the law to have the ballots re counted aud then build up a case from whir they might disclose.
