As the time approaches for the convening
of tholeslslaturo the talk ol amendments to
Iho city charter Increases. It has been sug
gested that mealing of the city council nnd
lllzons should bo held In the ncur future
and the question of charter amendments
thoroughly discussed , in order that an Intol-
iRont conclusion may ho reached ns to wnat
Is necessary for the best Interests of the
city , and the South Omnhti member of tbo
legislative delegation may know what the
citizens desire.
In Its present form the charter is not ex
actly perfect nnd In many cases should ho
modified nnd In others Us powers extended.
Many fiugposuoni have been nindo in this
* record nnd several changes hnvo been
pointed out which could bo nmde mid bo of
vast botioflt to the city.
South Omnhn Is governed by the charter
of H city of the first class , baring moro thnn
10,000nna less tlian 26,000 Intiiiblttints. It be
came n city of the first elass by nroclmnntlon
of Governor Thoyer , when tbo charter pro
vided that such city should have moro
thnn 8,000 Inhabitants. This was
nmondcd rjy the last legislature nnd
Increased to 10,000 , hut Iho amend
ment is said to ho unconstitutional
because of the uosonco of n repealing clause.
The pondral opinion Is thnt this provision of
ttio charter should bo amended so ns to per
mit any city by special census to establish
tbo fn'et that It lias the icqulrcd pouulullon
to become a city of the llrst class. A si it now
lands Iho census of the United States or a
census taken by the state is used as u basis
to dolcrmiuo ttio population of u city.

The section which provides for the open'
Ing up of streets is very unsatisfactory. The
provision Is there for the commencement of
condemnation proceeding ! ) , and the money
must bo deposited previous to any action
taucn. vVbere Ibis money Is to como from
for the pronerty appropriated is the voxa-
tlous question. The suggestion is rando that
this section should be amended so ns to pro
vide that Ihe expense of opening up a stroal
should bo assessed aealnst tuo property
abutting upon the street opened.
The section which provides for the award-
leg of aamngps to propoity by reason of the
grading of a street Is also pointed out as de
fective. If nn owner of property damaged
Is not satisfied with the atvntd nf the ap
praisers , brings , suit nild secures judgment ,
the judgment ID paid out of the judgment
fund , and the vtholo city Is assessed to cover
thb umount. Tbo suggestion is thnt the sec
tion bo amended so that tbo judgment may
bo paid from a fund created by nn assess
ment nealnsl tbo property abutting upon the
street graded.
The provision for the erection of viaducts
and the awarding of dirnnges is not yory
satisfactory. Tbo. section empowering the
city to compel the erection of viaducts by
the railway companies over their tracks is
not explicit in dellning what power the
council has In this regard.
Another amendment , providing for tbo
means of raising money for Iho payment or
damages where viaducts nro orccted , hns
also been suggested. Instead of the entire
city boarinc the expense incurred bv rcasou
of such damages the' amount should bo as
sessed nguinst the property on tto streets
benefited.
A number of other amendments have bcon
suggested. It Is probable that at its next
meeting the council will issue a call f jr a
mooting of citizens lo discuas the amend
ments to the charter which are needed and
may bo suggostcd. t

latter company has enjoyed u monopoly for
four years on the furnishing of Hunt to Ihe
city and the appearance of a new company ,
which will commence operations within'a

ment then opened the case for the dcfonso

clarcd that Inms rnatlo himself sick by swal
lowing tobacco whllo hanging hy his
thumbs. Notwithstanding Colonel Stroator
pointed out the enormity of Inms' offense to
him In n fatboily manner , lams was defiant
nti.l continues so still.
Cniof Deputy Sheriff Gray , the first wit
ness , told of tbo situation tn Homestead before -
fore troopj uero railed out , and n certified
copy of the governor's order calling out
the troops was put In evidence1 , nnd the
court took n rceoss.
When thu court convened for tin after
noon , Colonel Stroller , ono of the dofonaants ,
wns cnllsd to the stand. Ilo told how Inms
shouted "i'lirco cheers for the man who shot
Frlek , " when ho heard of the attempted

Witness asked lams why ho had snld such
n thing , nnd thnt surely ho did not wnnt to

Ho uns then sent to the guard bouse. Inms
had previously boon sentenced to carry n
log ns punishment for desertion from cunrct
duty. Witness then conferred with Colonel

then decided on Witness Instiuctcd Ur.

the physicians directed , and ho especially
snld that no phvslcnl Injuty wns to bo per
mitted . Tno doctor suld that Inms wns slclc
from chewing tobacco , whereupon ho was
cut down. The case was then formally re
ported to Colonel Ilnwklns , brigade com
mander. Witness ordered lams' head
shaved nnd that ho bo drummed out of camp.
The putposo of tbo punishment , witness said
wns to piovcnt the recurrence of such u
breach of discipline.
Colonel llawlilns was then called. His
version of the occurrence did not dlfTor
materially from Colonel Stroator's. In
witness1 opinion tbo mode of nuntshmcnt
was proper. lams' offence , ho ( said , wns
mutiny , and bo bad scon men shot dead for
thnt. Colonel Stroalor's action was in nc-
cordanco with United States army customs.

was Archbishop Satolliof Homo. The church
was packed with people long before the hour
set for the ceremony. The structure is yet
unfinished , but Is the beginning of ona of Iho
most pretentious ecclesiastical odillces in the
world.
