ments , and all are cxpoctud to b ) eloquent.
The Interest lu tlis addraiscs to the Jury by
the several noted attorneys connoctoi with
thocaso promlsoto oxclto as much Interest
as did the testimony on the most exciting
a ay 3 of tha trial.
When court convened this morning Dr.
Lconhnrdt resumed the stand to complete
bin testimony. In reply to tbo questions put
to him bv Attorney Whodon for the defense ,
the wlno3i admitted that the fact that Ir
vine hud soon the visions described by him ,
thnt ha had suo'i a powerful nltootlon for his
wife and child , nnd that his wito bad bom
seduced by his best friend , might cause him
him to grow Insano. The stata Introduced
an Illustration of Judas Isearlot ns a central
figure , but when Mr. Wboiion put it In nn-
otbor form , with a man Urlvan to frenzy by
reason of Judas' bdtr.tyal of tbo Savior , tbo
witness admitted that U tbo man came across
Judas sitting betide a man uutnod Smith ho
would bn moro apt to &hoot Judas than Smith.
Dr. Uuvcs , nn assistant physician at tha
Lincoln Insane asylum for thirteen years ,
was placed on the stand. Ho hnd never
seen u case of transitory mania or frenzy ,
but bis description of the disease was very
similar to that given by the otbur exports on
both sides. On the sttito's hypothetical
question , which ascribed method to all of
Irvine's actions , the witness pave It ns his
opinion that Irvine was sane. When the defense -
fonso Introduced Its question , with its quail-
floitlons ol transition from great Joy to In-
tcnso grief , Iho hallucinations nnd the at
tendant results , iho wllnossstntod tbatundor
such circumstances the man wns probably
Insano. The Important elements of insanity ,
iu the question put by tbo defense , bo
pointed out * ns visual hallucination , Incoherency -
roncy nud want of inamory.
Dr. L. O. KhorteH of this city had treated
Insane patients in the course of a general
practice covering a period ol twelve years ,
but had uovcr sooa a case of mania trnnsi-
torla. To tiio hypothetical question Dr.
Kbodos w.ts of tbo"opinion that the man was
sane , knew what ho wns doing and was uar-
foctly able to govern ills actions. On cross-
oxamlnatlou Mr. Whcdon questioned the
witness closely as to his dotinltlon of n delu
sion. The witness stu'.od that Sir William
lllackstono belluvcd In vvltchos and de
scribed this ns a delusion. Mr. Wlmton
wnntod to know If tbo witness believed the
bible was the word of God. Ho replied that
ho did , and than tbo attorney asked him If
ho behoved that when the bible said there
were witches that tbo author wa < laboring

to admit that bo held to no such belief. At

Hearing the Arguments.
The argument to the "lury was opened by
.A ttornoy Adnms for the state this afternoon.
The apeaKer called tno attention of tbo jury
to the fact tbit tha prisoner at the bar stood
charged with murder In the first degree ,
with murder In the second degree and with
manslaughter. No mau , said the spealter ,
would ( jo farther In the defense of the chas
tity of womin than himself , but no man Had
the right to talto the law Into his own bands
by taking Iho life of n fellow man. He re
minded the jurymen that tboy wore iu the
box , not to try the sins of Montgomery , butte
to dncldo whether or not tbo man wlio stood
before thorn charged with murder was
guilty and wlmthor ho was responsible for
bis not of tnittne Montgomery's life on the
morning of May 2(1. ( Ho referred to the fact
that Irvine claimed to have so groatn love
for his wife , and tbon pointed to the lottow
from Mrs. Irvine to her husband , live of
thorn in four months , onch niltlcg for money
and complaining that "ho did not write to her.
The speaker contenuod thnt Irvine must
have had some suspicion of his wife's infidel
ity buforo starting for Chicago and pointed
to the fact that ho had been so caroftil to tiro-
servo copies of all tbo telegrams be sent her ,
aoclnring that Irvine had a desireto hunt
down his wife and so euro ovldonco to brina
about a separation.
Little Flossie hnd occupied her customary
seat on her tuther's knco durmor the opening
of Attorney Adams' argument to the Jury ,
buthnr grief nt the severe arraignment of
her father was so Intense , and her sobs so
affecting , that she had to DO rotnovod from
the court room.
ICovloit ed Jrvine'H Acts ,
Continuing Mr. Adams reviewed all of Ir
vine's acts from the tlmo bo loft Chicago
until be killed Montgomery , claiming that
none ot the acts were those of an msiinn
man. If Irvine's solo purpose In coming Vi
Lincoln was to throw his arms about his
friend Abbott' * node , why did ho not go to
Abbott's house und enact that scuno there
instead of first killing Mantgomcrv und then
sending n buck for Abbott. Attorney Adams
claimed that Irvine bud carried tbo revolver
all tha way from Silt Laku for thu purpose
of Killing Montgomery , that ho had kept
copini of the telegrams and secured his
wife's confoislon bacauso ho wns fearful of
mob violence , unless ho presented some
plausible reason for shooting down in cold
blood ono of ttio city's most , prominent mon ,
that ho trembled und grew palo because bo
realized the fearful consequence of his
crime , and that his subseiiuont conduct in
tliu Jail was In pursuance ol u cunningly con
ceived plnn to simulate Insanity ,
.Icsso U. Strode was tbo lirst sneaker for
tbo defense. Ho impressed upon the minds
of the jury the solemnity of their duty , nnd
J churgo'l them thnt thev must either find the
nccusod guilty of murder in the llr.it dovreo
or Hml him * gulltloss und mane htm a free
man. He went over Iho causes loading up to
the commission of the deed for which Irvine
t is bolng tried , and asked what public good
i would bo done by punishing him. Ho con-
i tended that tbo prisoner's previous chnrnc-
tor und reputation woioln utter contradiction
to thu theory ot premeditation. Alluding to
Irvine's apparent inolhod in collecting tliu
evidence of his wife's intidollty , Mr. Strode
claimed that tlioy were tbo moihuds of a man
i who had love und hot murder In his heart.
Mr. Strode oondamnoJ In strong terms tbo
