three are H. U. Duncan , George Leslie and
Gus Lockner. The three petition candidates

The committee was takoti completely by
surprise while in session by receiving a com
munication ul 4 o'clock from tbo stitto cen
tral committee at the headquartere at Lin
coln , announcing that the campaign would bo

Crounse and sovornl of tbo other party
lenders would bo present. The committee -

Charles H. Paul In the ombozzlomant of
county funds , continued Its side of the naso.
William Kerr , president of the Adams
County bank , testified that Paul had mada a
lot > n of $20,000 once , about the tlmo
of the last eemi-annual stntoment of
tha treasurer except ouo , the witness
supposed In order to aiako n showing with
the board , The court ruled out all testi
mony tending to shotv that Paul had paid out
4J3.000 to the Hastings Dry Pressed Brick
company on orders from the Hoard of Super
visors before the bonds had boon negotiated.
Deputy Fist thou took the stand. In making
out the Boml-anuuul statements , they were
made to correspond aa much as poislblo with
the books. Referring to "tho Cherry
Items , ho said that recoluts hail
been given uud the chocks and war
rants given were duly deposited , The sumo
wus true of the Little Blue Items , Paul
wus In the ofllco every time that Cherry
paid any money.

tion lo the Cherry Horns , but Paul nskod

county money was in the Adams county

vestigation. Mr. Karr , president of the
uunii , told Fist that If Clarke wanted to
Know how tbo county funds stood ho could

night , u while nftor , Fist transferred
the county funds from the nuruo of C. H.
Paul to Adams county. Ho donlod all of
Paul's testimony about Fist's statement that
"thoy will never catch on" to the Chorrv
items , und said that he bad objected lo tbo
burning of the returned chocks. Hero the
defendant's attorney handed the wltnoss over
to the state for cross-examination' .
Mr. Fist denied that ho had first opposed
Paul's candidacy for ofllco , and then had
worked politically In his favor. In tbo ab-
senoo ot Mi. Paul , or If ho was busy , the
wUuoss was accustomed to maKe out checks
and pay warrants.
" Why Flit Was Silent.
Continuing the cross-examination Mr. Fist
said that ho did not think It necessary to toll
the county supervisors that the Cherry item *
worn left off , as Paul said that ho would take
care of that himself.
A fuiv questions when the court met in
the afternoon and the cross-examination was
ended and the defense rostcd. In rebuttal
the state called J. U. Keedlo , formerly a col
lector for tbo Queen City Land company ,
who testified that ho once called at thu treas
urer's ottlce to collect tbo money duo for cu-
Kravings of Paul's and Fist's residences ,
which were inserted in n pamphlet adver
tising the city. Paul was not in the of-
tico , and as Keedlo turned to niovo
away Fist took the money from
a drawer in tha counter and paid both bills.
Mr. Paul wus called again and rolteratod
his statement that his tlrst knowledge of the
irregularity in the Cherry items was ou-
tuluod In December , 1S91 , when Fist made
out the ilnal balances. The second con
versation in regard 19 tbo Charry Horns with
Fist was in the vault of the treasurer's
of.lce.
Concerning the I.lttlo Itlnn Items.
The Ilrst Intimation of the fact that he
ever got that the Little Blue Items were Ir
regular was through his attorney Mr. MR-
Croary after the export's report. Fist
always had access to tlio bank pass book.
On cross examination be said thut the loam
madd from Kerr and others were for the pur
pose of keeping his time. Ho bad a number
outstanding loans.
Mr. A. L. Climio testified that ho remembered -
bored nothing ot the shortaco In the Little
Blue items until noout the tlmo that the ex port
began his examination and In fact that Mr.
Fist sale in the conversation in the vault
that aside from the Cherry Items everything
CJBO was correct. The witness lofttuo vault ,
Fist tellinir lilm to .step into the next room
and ho would bring the receipts. This was
lu rebuttal of Fist's statement in tlio morn
ing that ho did not tell the party to got out
of the vault.
John M. Hagan did not learn of uny short-
nee In iho Little Blue items until ho hoard
Mr. Clarito examined a moment bptoro.
Chris Hoeppnor , county attorney , took the
stand for the state. Ho had received a num
ber of receipts from Mr. Hagan , but the
Little Blue items were not among thorn.
