Another singular fact in regard to the Missouri Is ono that engineers are rather slow to concede * , ns it scorns not easy of ex- p'anation. It is this : Whenever the river tnltcs a straight shoot , cutting oft some bond , It always innlios some other turn to tnko its plnco , The Missouri has established tbo policy that ono good turn deserves another. The light between the railway commis sioners and the five great trunk lines operat ing in the state , which has bcon pending for the last two years , is now on again In the dlstrlpt court. Judge Deomor held a special session of court yoitorday for the purpose ot icaring tbo arguments of the attorneys in what nro commonly known as the "Jolnt- ralo' * * cases. Peter A. Day and Spencer Smith of the railway commission , were pres ent as spectators , nnd John T. Fish , attorney for the Chicago , Milwaukee & St. Paul , ap peared for his road. Smith , Mcl'horson and J. N. Baldwin appeared for the other roads , nnd Attorney General J. Y. Stone repro- entcd the atato und the commissioners. 1'Uo rends engaged In the litigation nro the Chicago & Northwestern , nnd Chicago cage , Milwaukee & SU Paul , the Chicago , Hock Island & Pacitlc , the Chicago , Burling ton & Qulncy and the Sioux City ft Pacific. Against each of those companies , excepting the last two , suits huvo D2on commenced , ono by the commissioners and ono by tbo stnto , tlioro being some uncertainty as to who should appear us plaintiff. But against the Stoux City only ono suit was com menced. The litigation grows out of the action of the legislature In passing a law in 1803 giv ing tlio stnto railway commission nulhorltv to establish n joint frcicht rate for the trans portation of Irelplit over two or moro ronds. Until 1SSS the railroads had n systora of joint freight rates in vogue , but when in that year the legislature passed its max imum rate bill , the railways abrogated their Joint rate system uud refused to carry freight ever two roads excepting for the s > um of the two sopnruto rates. Now they raise ob jections to the joint rate law nnd clulm that tbo commission has no right to establish a scheme of rates , oven though they refuse to do so themsnlvos. Tlio law provides Ihnt they shall currv freight for not to exceed 80 per cent of the separate rates. The railways claim that the power thus given to the com mission is unlawful and the cuso Is now brought Into court on a demurrer. The arguments will bo apt to tnko several days. Hear Prof. Walter E.
