To the Editor of TncBii : : 1 bavo the honor to ask your opinion of the desirability of the adjutant generals of the militia of the several states memorializing congress on tbo subject of there being established a special branch cf tbo War department to bo known ns the militia department. This department to bo " Under the control ut the secretary ot war , nnd to have as Its chief an o nicer of the rank of brigadier general , who shall have a stilt- nblo staff ; the chief and staff to bo onicors of the regular army. The object of this de partment being to promote the oOlcleucy of the railltm. It Is believed that a department of this Id ml would bo of great assistance in aiding thu organization , equipment , drill , offootlvo ness and vuluo of thu militia. Under tlio general direction of such n department the national militia would bccomou homogeneous body of soldlorn of far greater vuluo than Is possible under the dlverslflcd systems now lu use throughout the union. The chancre being prln cipaliy to secure to the state creator advantages ef uniformity of organization , equipment nnd drill , nnd u botly of highly euuciitcd ofllcors , whoso entire business would be to advlso and Instruct the militia. Mlddloton , a colored soldi sr,1 charged with making a criminal assault upon Mrs. Luzla MoElroy , who resides near Fort Robinson , was tauon up this morning In United States court. Tbo accused wai de fended by a colored lawyer , Mr. Silas Rob- bins. . The assault was rnauo fan the 18th of May , while Mrs. MoElrdy' " was on her way homo from Crawford , Nob. , nnd within about one mile of Fort Robinson. She was driving a team and wugon alone and ovartook Mlddloton on foot. Ho asked her If ho could ride and she permitted him to get into ' the wugon. As they passed through n , 'deep ravlno Mlddlo ton suddenly seized tho' .woman , stopped tbo team , and throwing bH < vlctlin to the uottom of tbo wagon box bo forcibly aud brutally accomplished his purpose. Identify Mlddloton as the man bo saw spring out of tbo wugon and scamper away over the hilts. Tbo defendant will endeavor to prove an alibi. The policy of the defense ls to shew that there was Hi feeling between tbo moat man and tbo defendant , und that tt.oro a conspiracy entered Into by the woman nnd several other parties , including the meat man , for the purpose of getting Mlddlotou discharged from the army In dlsurnco. Mrs. Mlddloton was the first witness placed upon the aland by the prosecution. Her story was substantially tbat outlined above. Mrs. McBlroy U n frail , plain , coun try woman who bays she has lived thirty. throe mouths nil a claim about 11 f teen miles out from Crawford. She told her story In a roleblfoiword pud grapblo manner that appeared to Impress the Jury. In case Mld dlotou is convicted of the crlrao with which bo is charged his punishment will probably bo the severest known to human law , for under the United States statutes the penalty for such nn offense Is death.
