Going down Into nuclont history , tn 1358
the Missouri rtvor claimed the anutor portion
tion ot this soctton 38vhlch IB located Just
ouisldo the city limits In tbo vloln-

statoof nrfnlrs existed when the original
government survey was made. The land was
platted us fractional lots , and so remained.
Settlers Itopt awn.v from It , regarding It
valueless on account of the nearness of the
rlvor.
Clnlmrd by the Stntn.
When Nebraska was admitted Into the
union , sections 10 and 30 In all of the town-
sinps were declared school lauds and set iiRido
to bo soldtho proceeds to bo used In support-
lug the public schools.
At the public sale which was held the lots
lu suction thirty-six , towushtD sixteen , ranco
thirteen , were offered nt public auction and
sold. Subsequent to tlmt.aato the rlvor had
gradually rocodod. leaving n wlda boitora
lying east of the laud originally surveyed ,
and in ascertaining who owns this tract is
what will cause the troublo.
The purchasers ot. the land In section 30
claim the tract under the laws of accretion ,
and point to the decision In the East Omaha
oaso1 as settling their tltlo for ovormora
They hold that the name law applies and that
they havq by this decision acquired tllla to a
largo body of land which is now very valu
able. Bat this not all.
As the rlvor receded during all of the yonrs
slnco 18. > 0 , squatters , with an oyoto business ,
bnvo watched and waited , and while so dolug
have Bottled upon the land lying between
the original survey mid thu present channel
of the stream. There uro half a
dozen of these parties and they hold that
tholr tltlo is the boat that can bo obtained , m
thay settled outside of the maunder linn of
tno survey of 185(1 ( , and at the tltno they
made tholr settlement there were no con-
tllctlog in to rests , The state did not claim
the land , neither aid the purchasers of the
fractional lots in suction thirty-six. Thus
tUo matter rested , all parties feeling hnppy
tn the possession of what they honestly believed -
liovod was tholr own. Probably they might
nlways have enjoyed this fooling of security
if the state had not taken u hand.
Not long ago Colonel Humphrey ? , the slate
commissioner of public lands , learned of the
existence of the tract ot laud formed uy
accretion and at once requested County Sur
veyor Smith to survey and subdivide the
tract into ten-acre lots. Mr. Smith obeyed
and in running his lines discovered about
"MO acres of land. This fact
was reported to the commissioner ol
public lands , who at once declared that the
lots and lanus were the property of the stato.
They did not belong to the original purchas
ers ot the lots in section thirty-six , nor did
they belong to tha squatters. Ho also de
clared his intention of soiling tbo land at
public sale and. turning the money into the
school fund.
Sijimttnrs Will Content *
When this information was convoyed to
tbo parties holding possession there was a
commotion in the bond of tbo river. The
squatters declared that they would not re
move unless thoy'wcro forced out at the
paint of the bayonet.
The original purchasers of the fractional
lots had nothing to say until they learned of
the court decision in the East Omaha case ,
and then they rose up 111 arms. They de
clared that the land was theirs and that they
would bold possession until tbo crack ol
doom , land commissionerstato and squatters
to the contrary.notwithstanding.
The original purchasers of the fractional
lots , or at least most of thorn , have held their
lands for speculative purposes' , while a few
have put on permanent Improvements.
"Squatters Have plowed , seeded and har

Invested their all and now declare that they
will die in tholr own blood if tholr homes
uro sold , or if they are removed without
being compensated for their years at labor ID
opening up their farms.
When tbo land will bo offered for sate Is
not known , but as soon as the notice of sale
is published than tha three-cornered light
will bogln. The squatters will trytoonjom
tha sale ; the original purchasers will extend
their lines to the present line of the river ,
and the state will bring suit to remove all
parties having conlllctlng Interests.
