\Vhon the attention of tbo olllcors of In

that the Union 1'iiclflo was breakint ; Us

and seeking an allmni-o with the Milwaulcoo ,
they with ono accord denied any knowledge
of such a change.
General Passenger Agent Lomax
of the Union Pacilio said
there wai absolutely nothing in It. The re
lations of his road ana the North western , ho
declared , worn most friendly nnd the ex
change of trnllle entirely satisfactory. Ho
thought this rumor might ho the echo of a
story darted In Chicago a few woolts ago.
lU purport was that tbo Union Pacillc was
dissatisllcd with the Nortuwcstorn's method
of handling continental business and In-
tonned to open a ticket ofllco of Its own
in Chicago :
The current rumor also Involves the Now
Vork Central , and Mr. Lomax tiiougnt this
might have grown out of the fact that the
Vandcrbill road was arranging n series of
California excursions , beginning next month ,
to compete wtlli the Pennsylvania's trans
continental tours. Tho. > chenio is .o scud thu

booiLUimblo to look up the law on the case as
tmiub a * ho wished and would uo compelled
to withhold his decision until \Vcdncsdny.
Mr. Sltner.il , attorney for tliu pliilntllT ,
stated that ho would Ilka alttllo mot'u time ,

I lo said tint , tlio case had been submitted
and that a decision should bo given nt once
without keeping his conm.uiy on tuo anxious
scat any longer.
City Attorney Poppluton then wanted to
say a word. Ho clalmm ! that ttio doilro of
the plaintiff , was to stave off tlio decision and
get some of the members of the present city
council out of ofllco bnforo the case was de
cided , and ho protested against any such
delay.
This suggested a now idea to the
Kotcnam attorney , and ho declared that
either Mr. Suneral or somebody behind liim
desired to smirch his company an < l to throw
the roth-Ing councilmcn on a cold and un
feeling world with a smirch upon their char
acters.
Mr. Simernl expressed serious doubts as to
whether any now smirch could seriously
ulTcct the council a ? It had already been
smirched so much.
The judge stated that ho would adhere lo
tils original intention and render his decision
Wednesday , and ho thought that If Mr Hlm-
cral had anything moro to Introduce ho could
get it ready in that time.
This called tor another outbreak on the
part of the champion of the furniture com pan <
who said that ho would want to submit
some oral uroof to meet the iillldavii.'i. The
prospect of such a thing was too much for
JudgoUoiinc , and ho promptly declared that
ho wouldn't go into such a thing as oral proof
in the matter , The council had held a long
and tedious Investigation , listening to a lot
of oral proof , and ho didn't , propose to go
through any such ordeal himsulf.
And that settled It.

They were all to bo hoa'rd at once , but as

Judge Doano decided the case of Wells

Attorney A. H. Talbot lllod n motion for anew
now trial In the case of Maltby against the
Modern Woodmen.
Assistant City Attorney Shoemaker lllod a
motion lor a dissolution of the Injunction In
the case ot the city against the Kansas City
Sun. Ho hold that the wording of
the original motion enjoining the citv
authorities from interloring with the cinu- :
latlon mid , sale of the Kansas City Sun , went
so far as to prohibit the authorities from
suppressing the sale and circulation of tlio
imporot'nii if it wore not in violation of law.
Judge Dundy said if that were true ho
would modify the order so that it would
only enjoin the city authorities from Inter
fering with the lawful sale and
circulation , nnd leave the matter
in such a shane that an un
lawful publication at any tlmo could ,
if necessary , be suppressed. Ho hold further
that ho did not think it within the jurisdic
tion or power of the court to suppress the
publication of u newspaper entirely simply
because one issue or half a dozen Issues were
objectionable rather because the Issues that
followed might bo perfectly proper and law
ful. Ho seemed to think that the court
could , In this case , only take Into account the
particular Usuo about which thn complaint
Imil been raised because no ono know but the
publishers what their next Issue was going
to contain.
