Trouble Over Compensations.
A petition has been tiled in the district
court to nnvo the proceedings In tbo estate
of the latoJ. M. Phillips reviewed and the
approval of Administrator Askwith's bond
and the fixing of his compensation
sot aside. The plaintiffs In the
case are N. C. Phillips , J. N. Phillips , Gron-
villo D. Phillips , Mary O. Phillips , Uuth M.
Shepherd and Emma VoswinUle , all of them
heirs of the Phillips ostato. A.V. \ . Askwith
was appointed administrator and ashorttiino
ago his compensation was ' fixed at J 1,500 , to
gether with other special' fees for special
services which ho claimed to have rendered.
The heirs now claim that no has not done
labor In connection with tbo CHHO that war
rants the granting of such u fee. 'Many of the
services for which Askwith claimed com
pensation. It is alleged were performed by
other parties , some of whom were members
of the family. Some of the settlements
which he claimed to have made with the
creditors of the deceased were paid
for by other parties , and now Ask-
with wants a double fee. Some of the
proceeds of the sale of the estate , to the
amount of ? < ll , It is claimed , have never been
accounted for in any way. In view of those
allegations the court is asked to sot aside the
award previously made.

The report of City Physician Jennings for
the month of August contains some state
ments which will bo interesting reading , and
which also speak well for the sanitary
condition of Council niufTs. According
to It thcro have been but nineteen
deaths during the entire month , fifteen
of which were females and four males
Of the nineteen all but six were less than a
year old. None of the deaths were the re
sult of contagious diseases. There have
been but six cases of contagious diseases re
ported to the city clerk and they have boon
diphtheria. There bas boon only ono death
In a public Institution and that \vai an in-
nmto of the Christian home.
